2010.06.18 Defense Reply to SA Response Regarding Admissibility of 911 Calls (Filed version)

Perhaps I am being picky. The Judge's Order states:

"The state shall file a written response by June 10, 2010 at 4:00 p.m. setting forth its theory of admissibility regarding these calls, and the defense shall file a reply by June 21, 2010 at 4:00 p.m."

From the Clerk of Courts records:

06/09/2010 Response --State of Florida's; to Court's May 10, 2010 Order Regarding Theory of Admissibility of 911 Calls

06/22/2010 Reply --Defendant's; to State's Response Regarding Admissibility of 911 Calls

They arrived together--ca took their car home and ga drove kc car home.....with the windows open due to the smell
Didn't they (GA only?) go and find out cash was needed to get the car out...then they came back with it? IIRC, though, they only got near the car when they actually retrieved it. Help...is that how it went?

Thank you so much Muzikman, I printed both, the documents are identical, how or why it was filed after the fact, is anyone's guess. That is the least of Cheney's worries, he has real things to worry about in this document.

Let's count the incorrect facts Mr Mason puts forth:

The car was NOT "in the impound lot with the police department".

Cindy did NOT go into the car at the tow yard.

According to George's LE statement, Cindy said to him "Jesus Christ, what died?" when the car was at home. If, as Cheney says coworkers say, "George told her the car smelled like a dead body had been in it." That is just extra special, but the point is she thought and said those words too. She also relayed that to Amy. Did Cheney read any of the police statements folks made, any of them?

Cindy went home and found Amy's phone number - IN CASEY'S CAR!!! Ya think she might have smelled the dead body then???:furious:

It was not an OCSO substation, it was an Orlando PD substation.

The second call was made at home, not in the car.:banghead:

Cheney apparently does NOT understand that the excited utterance was made immediately after Cindy learned for the FIRST TIME that Caylee had been "Kidnapped!!!":banghead:

Good lord, guys! You just can't make this stuff up!!!!!:snooty:

Wonder how the , how was your trip Jose phone call is going?
I can't begin to tell you how all this just stirs up the anger in me. Two years and still no justice for this precious child.

George went first, found out he needed cash or more money. He called Cindy, she went and got the money at the bank/ATM and met him at home. They rode together to get the car. While Cindy was paying the woman (arguing about the amount and how they should have called them, etc) George walked with the man that works at the impound lot to get the car. George smelled the car first, saw that the car seat, backpack, etc were in the car. Cindy briefly smelled it when George pulled up to her before driving the car home. George told Cindy before going home something to the effect of the car smelling so bad that he was having to drive it with the windows down even with it raining.

To add, CA went directly home, GA arrived at some point back at the house not sure of the timing off the top of my brain cells. GA removed the Pontiac battery so the car would not be moved. CA sent GA back to work, cleaned the Pontiac trunk out and went back to work herself. She had more than enough time to throw wash into the machine and dispose of any incriminating evidence she felt would harm ICA I believe from GA, not necessarily LE at this time.

I still haven't been able to nail down the time where CA actually went into the front of the Pontiac to search for info to track down ICA since ICA was not returning calls and texts and found AHs contact info.

I refuse to make any assumptions about their stated time lines for they lie with ease and conviction.

Not to worry RR. The Anthony family is going to be called and have to testify and testify truthfully and all their bullchit is going to go out the window. And Chaney is a case "changing" lawyer and Lyon is a "genius". I don't think they have won a motion yet. Maybe one where the prosecution had to lay out the reason for their asking for the death penalty. Not a huge win since it focuses on the inhumanity of their client.

I do not think she will get the death penalty. Lyon will center on her age and the fact that CASEY was sexually abused. She is going to use that definitely. And even if they don't believe that, the jurors will say, well you never know - I doubt it, but lets give her life w/o parole.

The sad thing is that the people who professed to love her so much (Caylee) are defending her murderer.

That pretty much sucks also.

also covered in that was ca told ga that she would drive the car home if it was that much of a problem....(IIRC :blushing: been so many tales that its hard to keep track of!)---:waitasec::furious:

Despite Cheney being so rude to Kathi , she just stayed steady to the course and kept asking questions. My very, very favorite was

KB What do you have that shows she was not there in June? That is when Caylee disappeared.
CM: We don't know when she disappeared?

Is he basing it on Casey claiming she talked to the baby once? She was still missing, call or no call, right? Unless she is returned safely..she is missing. imo [ame]http://www.youtube.com/watch?v=yXS8rPiXglo[/ame]

Dear God, we assume you heard your client say her child has been "Missing for 31 days!" Guess what month that puts us in .....June!!!
How can her lead attorney say we do not know when she disappeared? charlie 2.jpg

In the words of Judge Perry, "Just so all minds are clear," check out what Cindy's co workers said in their police interviews, two years ago!!!! There is nothing , absolutely nothing new about them saying this in any depo on Thursday. This has been their account all along.
She returned to work alright, and was sent home with the advice to call the authorities. Nothing new here if they repeated this and it is new to Cheney. I think that is the distinction...truly new news or something that Cheney is reading or hearing for the first time thinking he is Moses coming down from the mountain with the tablets.

From Charles interview

Q Did she say anything about the car when she got back to work that day

A Yes, I recall when she got back , a lot of us were standing right here by the front door when she walked in. And she made a statement about the smell in the car. She said it smelled like a dead body. And we told her to call the police.

Kathi mentioned to Cheney that these co workers said these exact same things in 2008. He answered her "No she didn't. No she didn't!"
So, in case you are reading here today, for your edification, I have posted their actual interviews.

You just can't make this stuff up.

If I were a taxpayer in the state of Florida, I would be livid. These statements were given to LE in November of 2008, they are hardly new, even by Moses's time table!

What I am confused about is when Kathi tells him, several times, that these statements were given to LE already, he dismissed that altogether and said something to the effect of nothing that was said before matters. Is he thinking that their testimony in a depo will squash a different account they may have given under oath much earlier ( a year and a half ago) contemporaneous to the events happening when one could infer their memory would be the most reliable? In the words of Judge Strickland, "This is where posturing can get you into trouble".

If the defense calls witnesses to the stand on the 15th, it will help Casey's case about as much as it did when the defense called pop to the stand to illustrate that whatever Casey may have said to Tracey or Rob fell under the agency relationship. Hello!!!!! Does anyone remember that little gem, he took the stand and told how they (the family) was under the very distinct impression that they were there as body guards only, and a litany of other things that proved the state's position? [ame]http://www.youtube.com/watch?v=X_kbZ_WENzs[/ame]
That is what will happen when the defense gets mom on the stand, she is going to prove the state's position is correct. She wont mean to, but she will. Between now and the 15th the defense better regroup, if they have to call Cindy to the stand it will be a disaster of biblical proportions, imo.

Wonder at what point Cindy exclaimed (per George in his LE interview) "<Expletive> What died?!" upon smelling the car. I am thinking it was after she entered the garage for the first time after George drove it home. IIRC George attributed that quote to Cindy more than once, perhaps again in a media interview, but don't recall exactly.

Cindy herself stated in a media interview that the "dead body" call took place after she learned Caylee had been taken by Zenaida. The panic in her voice and the audible crying and almost hyperventilating of Cindy (not to mention the 911 operator telling her to calm down) in that call make this the most obvious "excited utterance" I have heard of in real life. Here's the interview after the calls: [ame]http://www.youtube.com/watch?v=UodiwWf7fHw[/ame]

You are AWESOME TWA!!!! Thanks button wasn't enough. Comparing Cheney to Moses, LOL. He WISHES he could be Moses!!!!!

You are totally right. This just freaking baffles me - it's like he's saying if I haven't heard or read it, then it doesn't exist. Hate to break it to you Cheney, but you aren't Moses or God for that matter.

I cannot believe the convoluted, ridiculous logic the defense seems to be slipping into more and more, not that they EVER had a good argument, but good lord. They and the A's must think the jury is going to have lobotomies before hearing this case.

I can't wait to see them smushed into the ground like bugs on July 15th. You won't feel so self important then, will ya Cheney? I really hope they put Cindy on the stand, oh please do that for our viewing pleasure, er, to properly defend Casey!

See, this is the part that has me somewhat perplexed. CA was home when GA arrived back at the A compound. CA makes that statement to GA, he says "pizza". GA takes the battery out and CA sends him back to work. This all around 2-3 pm. CA goes back to work, gets sent home and begins or continues her coverup. searches the car, finds AHs phone number around 5ish or later. Goes to get ICA, goes to wrong LE station, goes home. LA arrives same time or within minutes. CA makes 2nd call, LA and ICA are kabitizing or what have you, and the third and final call was made while GA arrives home and walks up to CA as she is still on the phone with LE.

Why did CA go back to the A compound instead of going directly back to work hours later? Why ????......it's more than the unanswered calls and texts to ICA. They certainly aren't telling a lie about that one because it has never been asked of them. CA knows more than she told LE or LE hasn't released this crucial piece of info yet.

bbm lol!!

PS Good Question!

Do you guys feel even more offended on behalf of Judge Strickland? I don't know why, but I do find this guy more offensive than Baez. With Jose we can chalk some of the mistakes up to inexperience.

fifty three second mark [ame]http://www.youtube.com/watch?v=54JbOxl30U0[/ame]

This man strutted into the courtroom, insulted Mr. Ashton ( remember he referred to him as ignorant, in open court just because Mr. Ashton chuckled at something).[ame]http://www.youtube.com/watch?v=1vLhUaYCetk[/ame] [ame]http://www.youtube.com/watch?v=avpNxTvQfBc[/ame]

He may come with his A game after the public lashing he is taking on this 911 motion, but so far I am not able to call this anything but hubris. I do believe Mr. Nejame called it what it is, "Either laziness or sloppiness" Mr. Hornsby looked up Mr. Mason's record when he first came on the case and found it to be not at all impressive based on results. If we want to know if he can work magic with this case we could ask his most recent client. He is sitting on death row. [ame]http://www.youtube.com/watch?v=A8Hx5BKP4lA[/ame] The thing someone ought to implore upon him is the charm of a southern gentleman is that he is indeed a gentleman. If he is condescending to the hardworking , good tax payers of the jury the way he was to Ms. Belich, and how he is about the JAC in the four minute mark of this tape, I don't expect folks to appreciate it.

If JA and LBD watch CM's interviews with media I bet they are tickled pink- he is so befuddled.... he trips himself up with each statement.
I cannot wait to see him in action at the trial, he doesn't know what he's talking about, so many inaccuracies it's stunning. He is a gift from God...

This is like the movie" Dumb and Dumber", where's Jim Carey?
It seems we try to make sense out of sheer non sense!

"He is a gift from God!"

That is , by far the funniest thing I have ever read in this case!!!!!!
Indeed he is.

I watched that video 4 x yesterday. Absurd.

Still confused, but thought the same as kentjbkent suggested on the 'flip-flop' thread - what are WE missing? This man is KC's defense counsel, with years of experience, is 'death qualifed' and, by many accounts, is respected in the Orlando legal community...so, my reaction was still that WE must not be understanding what he is implying...

So, I give it another try......

3rd replay:

 I studied CM. He just wasn't making any sense. It wasn't that we didn't understand some new defense grand plan. It was clear that CM doesn't 'get it'. Simply, he really can't understand some of the facts of this case and say some of the things he said.

Because it was so absurd, I considered what Expecting Unicorns suggested (on the flip-flop thread), "Could he be ill?"

4th & last: I resigned to :shakehead: , :tsktsk: and :banghead:. With a little bit of

It seems he has the attitude of one who thinks he is beyond reproach and does not need to bother with all the minutiae and facts of a case. HE will tell you what he has to say and you will like it. You have no place questioning him because you didn't go to law school. He will answer your questions quickly, confidently and in a way that makes you sound stupid for asking them. Forget substance. Forget facts, it's all a 'sale' to him. This may have been great back in the 70's, before the internet age, but he comes across imo as a bit of a relic. He tries to cash in on the 'good ole boy' vibe, but he doesn't understand - the world has moved on.

This is my opinion. I really don't get how people like him sleep at night or how they feel good about what they do...it's not a defense he is putting up, it's just a shell game and a prayer that the prosecution screws up. In a perfect world he would be sanctioned for his obtuse arrogance and shameful unprofessionalism.. Again, just opinion. Sorry if o/t

cheney mason should have staid retired jmo.

he mumbles his way thru every hearing and doesnt seem to have a basic grasp of the facts of the case. is this all intentional? are they setting casey up with as many incompetent lawyers as possible so she can win on appeal?
