So, maybe that explains Cindy's sour puss at the "emergency" (NOT) Hearing last Friday - if she got the subpoena a week ago!

I actually feel bad for Lee. I wouldn't even want to be in the same room with my sister if she accused me of sexual abuse. He's done a good job of distancing himself from all of this (which I respect) and here he gets dragged back in, only this time as an accused (falsely, I believe) sexual predator.

It's going to be interesting to see how Lee answers questions and if he makes any eye contact with Casey. It will also be interesting if Casey can actually look at her brother after those accusations.
 
Question..... will the "use immunity" cover Cindy when she testifies on the 15th, if (when) she perjures herself?

I really think the only thing Lee is going to be asked to testify to is the night of 7/15 when they were trying to get Casey to explain why she "couldn't" take CA to see Caylee that night. He was the one in the room while CA was pacing in the garage. It goes to the why and when the 911 calls were made. And specifically in re. the SA's motion, it goes to the motive for KC to concoct the Zenaida kidnapping story. She was busted and the police were on their way.

I am praying he doesn't perjure himself trying to save his sister who has thrown him down on the train tracks.
 
If Lee falls back into the Anthony camp on the stand I will be extremely disappointed....I've been hoping Lee has seen the light since he removed himself from the circus.
 
I'm thinking if Mallory shows up to support Lee, that he will be truthful and he finally sees Casey for the monster she is.

If he sits with his parents and Cindy rubs her hands on his back, then he is still one of them.

I know during the trial they would NOT be allowed to. I am assuming the same rule will apply at this hearing.


Let me clarify - the one who testifies first would be allowed to hear the second witness' testimony, UNLESS there is reason to think the first witness would need to be re-called to the stand.
 
And THIS is exactly where the defense is going to BOMB and what RH was referring to in his blog. The defense is going in prepared to rebut the "excited utterance" and/or "spontaneous statement" exception to hearsay and that is not at all what the SA is asserting in their motion.

That was also EXACTLY what Linda Drane-Burdick was trying to get through CM's pompous hard head at the hearing on 6/21 when she said, (para) "The defense doesn't understand the basis of our motion."

I also wonder if there will be anger at CA for the incest lies in her letters. That can't sit well with him. I wonder if he'll ignore his whole family, or just Casey. Or worse case scenario, I am going to gag if it's a lovey dovey family reunion. Oh please. Like anyone is going to believe that.

I'm also wondering how big of a headache Conway has right now, and if he's hit the sauce yet. Knowing how those two were the last time they were on a stand, he's got to be worried about them this time too. There's no guarantee they are going to behave and not act inappropriately up there.

Btw, it has to be the SA that issued the subpoenas. There is no way, unless Baez truly has no brain, that the defense would possibly want to turn the courtroom into a circus again. That won't look good for Casey or her family. He would be crazy to be the one to issue those subpoenas. But the SA, oh yes, I can definitely see them wanting to tear the two apart on the stand to give them a glimpse of what's to come at trial. SA so issued those subpoenas.
ITA...Lee's testimony as to the development of Casey's story will collaborate the 911 calls. I don't know why, but I never thought about him coming in and testifying. He's done a good job removing himself from the scene. I had forgotten about him...lol.

*wakes up* OMG!!!!! This will be a hell of a hearing! I wonder why George isn't testifying as well? Damn, I may have to take the whole day off for this hearing!

At least we'll get to see Lee and if he's still on Casey's side at this point, which sadly, I think he will be. I am not getting my hopes up. I wonder what Casey's reaction will be at seeing him for the first time in so long?

Still, I can't wait for this hearing! It'll have more fireworks than the 4th of July!

Think of it this way - when JA and YM escorted KC to Universal and she reached the end of the hallway to her non-existent office, she was BUSTED. She had no office. No job. She had no choice but to admit she lied.

Same thing with the SA's motive/context argument. CA had finally found Casey and brought her butt home. Lee was there. They were not accepting her plea for "one more day". Cindy had called 911 twice already and the cops were on their way. Lee even asked Casey, "What are you going to tell them?" At that point, Casey had no choice BUT to concoct a story. She was out of 'outs'.

That is the legal basis for the SA's argument. Don't get me wrong - EVERYTHING ELSE is icing on the cake! Those calls are damning in every sense. So, CA's "there smells like there's been a dead body in the damn car" will be in there, but that is not the legal basis that the SA is attempting to get the 911 calls admitted.

So they have to set the stage, in other words...because the phone calls preceded the trip down memory lane at Universal. IMO there's only one reason or motive for her lying...she knew she was guilty of something (trying to be diplomatic). Hmmm...the defense will have their hands full.

Personally, I think Casey's "no affect" response will sink her.

Thanks for that link and quote from LDB! I have been trying to locate the SA's actual motion and can't find it. It does appear she is claiming it goes to show her consciousness of guilt.


To clarify - I only used the Universal scenairo as an anology. It doesn't have anything to do with the admissibility of the 911 calls. Basically, I was trying to show that she was BUSTED both times. She admitted she lied to JA & YM. However, her 'out' when confronted by CA and LA was to fabricate the Zenaida kidnapping story. The timing of the 911 calls put it in context and the fact that she could not produce Caylee goes to motive of why she chose to tell that crazy story.

After reading that motion, I must conclude that CM had NEVER read it when he spoke at his press conference on 6/21. LDB is very clear and included numerous citations in her legal argument.
