Yes that is actually a common expression. My wife commonly expresses "OMG it smells like something died in here" with in an our or so of chili dinner night.

However that common expression is not commonly used in the context of CA's 911 call. By saying my grand daughter is missing and we found my daughters car today and it smells like a dead body in the trunk (paraphrased). Cindy during that excited utterence is clearly linking the smell with her missing grand daughter as well as linking that smell to the trunk directly and mentioning the key words "dead body".

This is very different then the example of my wifes comments regarding my love of spicy chili and it's after effects. Which I would say is the more common vernacular.

It's kind of like saying "I'll kill you". People use it all the time usually in jest, or out of embarrassment and surprise. However not many people say I'm going to "I'm going to kill you with my bare hands" then a couple days later that person turns up dead from strangulation and not be considered a suspect.

CA's comments in the 911 call really need to remain in the context of what was transpiring at that moment or mere moments before. Analyzing them outside of that context would be an effort by the defense to twist the truth and not seek it.

IMO JP seems to be okay with having more details heard in the case, as opposed to hearing less details - unless there is a very clear reason it shouldn't be relevant. (If it holds any value to the jurors good or bad, its better for him to allow it than if he denied it and it turns out that it was in fact relevant) With regard to the 911 call, I think he will find it relevant and allow the call to be used in trial.
 
Well regardless of what the comment "actually" means to anyone - I think it will and should come in and then the defense can explain it away if they wish, but it should and will be up to the jury to decide - that's our system and it is the right thing to do.
 
Come down to it, if the car in fact DID NOT smell like there had been a dead body in it then this would be a non-issue. The "utterance" plus the fact that it was an "accurate utterance" is why IMO it should and will come it to trial.

Sorry, I was responding to Az post about what Ca said to Amy. I am not argueing whether Ca said it in the call. I am trying to find some back up to Ca saying it to so many people and have only found the 911 operator and Charles C so far. thanks
 
What is nutty to me is, orginally CA says she used the auto theft/money stolen story to get police out to her house faster. Somehow this late in the game that story has morphed into her using the dead body in the damn car to get police there faster. She was stuck on the pizza story for so long in reference to the car, I guess she abandoned this idea. JMO.

IMO Like a figure of speech. IMO

I will agree with this. After my dh uses the bathroom I will ask him "what died in there?" I wouldn't say "it smells like a dead body though"..big difference.
 
It gives me the most frightened & despairing feeling ,CA embellishing lies
& diminishing the horror of what happened to someone you cherished. Your own flesh & blood ,the hugs , smiles ,the kisses. I feel physically ill. Now they treat Caylee as if she was a bug that crawled across their floor&got squashed,not a glorious beam of sunshine, of love, beauty & purity. What a memorial!!!!

Sickening, isn't it? I half expect them to go on tour after KC is found guilty and blame it all on Caylee. :furious: CA: "You know, it's hard looking after a toddler! They can drive you crazy! KC shouldn't have to rot in prison because Caylee couldn't behave!" :sick:

Another big difference is ,it doesn't ACTUALLY smell like a dead body,the way KC's trunk does. I also doubt that you have someone missing ,later found dead.

What about Cindy's statement? She explicitly said it smelled like a dead body. Do you not want to see the obvious? I'm confused here.

If Cindy would have only spoken it to the mailman as well as her 911 call, would it matter? No, it wouldn't.

The fact is, she is lying now to try to cover for Casey, AGAIN, by trying to deny that she really did smell human decomposition in Casey's car.

The fact is, Cindy and George (and Lee, for that matter), all spoke of the smell of human decomposition in that car to numerous people. The fact is, several Forensic tests have proven that to be true, as well as the dog hits on the car, the car that only Casey was driving.

The saddest fact is, Caylee is dead. This baby deserves some respect and credence in the fact that not only was she murdered, but her mother cared so little about her, she stuffed her in bags in the trunk, then tossed her away like garbage and intentionally waited 31 days for her little body to nearly rot into dust in order to obliterate the evidence.

The most pathetic fact of all is that Casey never reported her own baby missing, her grandmother finally did, and even then, only due to the car being found. :rolleyes:

Caylee's own mother gave her none. Caylee at least deserves what dignity we can give her in death.

I've repeatedly heard her say it as there is a recording of her saying it which is readily available, and it is no less wrenching each time. It is the desperate, panicked voice of a grandmother who is peering into the abyss. I would provide a link but I was raised on the adage, 'The Lord helps those who help themselves.'
 
NTS why are you looking for links? CA said DIRECTLY to the 911 Dispatcher "it smells like there's been a dead body in the damn car"!

Who knows who else was standing there with Charles C? I am sure LE has interviewed every person that works in CA's office. CA also told her supervisor Debbie P that (paraphrasing) "she didn't know what she would if the baby was dead". So my question is, why would she mention the "baby being dead" to Debbie P if she didn't ALREADY know in her gut (because of the smell), not her mind, that Caylee was indeed dead?
 
A few weeks ago in our local general district court, I listened to a case where a tractor trailer driver had rear-ended a car in front of him, and he was charged with reckless driving (ultimately to be dropped to improper driving).
The officer testified that the trucker was following too closely when he accelerated upon a red light turning green, and he hit the car in front of him.
The trucker testified that the car in front of him had started from the light with normal momentum and he had given the car sufficient following distance-but the car suddenly slowed, too abruptly for him to stop his heavy truck. He reasoned that he was an experienced truck driver and had a good understanding of what occured.
The judge considered the trucker's career experience. However, as Her Honor noted, the police officer is specially trained to recognize these things (following too closely), and as such she would rely more heavily on the officer's testimony than that of the professional driver.
The trucker was found guilty, though she gave him leniency in the charges.

Whether they let this call in or not, whether CA is impeached or not-The state will have the testimony of an experienced officer that he smelled human decomposition in the Pontiac. CA and GA may be 'experts' in recognizing decomp, just like the trucker was a pro driver, but at the end of the day they have something to lose if they stick to the facts. I think the jury will rely more heavily on YM and JA's testimonies than whatever CA, GA or KC say in a 911 call or under oath.
