Is is different from the one they filed in March? In the defense motion re Cindy's 911 calls,
http://www.wftv.com/pdf/22797784/detail.html
Do we have the actual document they filed today? Is it ..let me guess...authored by Mason, since the first one was Andrea's? Did they make any NEW points?
I am posting the state's document just for quick comparison. http://www.wftv.com/pdf/23858915/detail.html

I assume it is a new one it was dated -
POSTED: 3:52 pm EDT June 18, 2010

And WESH said it mentioned Cindy's interview - it gives very little other details - Read it here:

Now I am sure of wht George and Cindy went on GMA - I just read on WESH that JB file a new motion today about the 911 calls and -

That just struck me as sooo funny! The idea of filing a legal motion based on something one of the A's said! Ha ha! Ha ha ha! Bwahahahahahaha!
:floorlaugh::floorlaugh::floorlaugh::floorlaugh::floorlaugh:

Could the defense be more obvious? Wow. Just....Wow. If this case hinged on everything Cindy has said, it would be an entirely different case. HHJP is going to laugh so hard when he reads this 6/18/10 filing (I so wish there was going to be a hearing for this. I would pay to watch it).

I can just see him calling HHJS on this one. "Stan, you will not believe....okay, maybe you will believe it, but still, this is hilarious!" and he goes on to tell HHJS about the latest filing on this motion, and they both end up on the floor laughing. I imagine even the SA is getting a kick out of this one!

The defense must either be desperate or really don't have any other way to try and keep the 911 calls out.

I like your tag line. Why do people kill people, who kill people, to show people that to kill people is bad?” Two wrongs do not make a right in my opinion, however I make no effort to stop it simply out of respect for the victims families. I have no sympathy for this man last night that was executed by firing squad last night in Utah. This case is different, the victims family is Kc's family. To put her to death is to punish the victims family. I do not support that in anyway. I find it barbaric in nature and not very becoming of a peaceful nation. I move forward reluctantly knowing that I am part of it.

To keep it on topic, what you said about the broken record is so true. I have heard it over and over again. I wonder how many times the Jury will hear it? once or twice? what do ya think?

Thanks! I was just flabbergasted that they actually executed him firing squad style. I was discussing this with my DH and I actually watch the video of how this whole execution style takes place. It seems so archaic! I would hate to be one of the people who execute the execution...

BUT, back on topic a bit more - My DH hardly knows a thing about this case and I started telling him a little about it last night and...

he said "wait, you have to understand if it was your daughter facing murder charges for killing your grandaughter and might possibly spend life in prison or execution...wouldn't you want to defend your daughter if there was even a very small chance that it might not have been her? Wouldn't you cling to every ounce of hope that it was some Zanny the Nanny kidnapping plot or conspiracy that forced Casey to lie through her teeth to nobly protect her family from death? Whether you think its right if she might have done it or not, your granddaughter is already taken from your life and to admit that your daughter might have committed this unthinkable murder would be losing your daughter as well."

I told him, I wouldn't do anything to further incriminate my daughter, but I wouldn't lie to LE because it would be an obstruction of justice for my granddaughter.

He said, "you can't even judge the Anthonys until you're in their shoes and are facing the terrible loss that they wake up to every morning"

I said "yeah, but....errrr you should hear how unbelievable her stories are!!" LOL
Some food for thought... :waitasec:

What's really amazing...we all had the same response!

Oh good grief. The defense always files these motions at the end of the day on Friday too.

Both.

As Judge Perry stated, "Well, you can always ask!" The 911 calls will come in, no doubt about it. Cindy's comments to others about the car smelling like a dead body are attached to her original comment to the 911 Operator.

Also, as far as the Defense's latest Motion today, too bad for them that they didn't phone 911 immediately and have that car inspected. They most certainly should have, but George buried them both with his comment at the tow yard, "Please don't let this be my Caylee", proving that he did, indeed know that car smelled of human decomposition at the tow yard, prior to, Cindy's phone call.

He also admitted it to the FBI. Cindy also told George, "We lost her. We lost Caylee."

There are far too many tangibles to their human decomposition comments for Baez to attempt to play off Cindy's lie that she was "only trying to get the officers to respond quicker".

If it weren't so serious that Caylee lost her life in this mess of a "family", the weakness and desperation of the Defense to get Cindy to lie about this would really be laughable.

If ever in life there comes a time for truth, it is in a murder case, particularly of an innocent, defenseless baby. And that's no matter who you are that is testifying, and no matter who you are in relation to the defendant. Murder, above all things, calls for pure truth from those who raised such a vile being as Casey Anthony.

What has continually been very interesting to me for the past two years is that if the Anthonys really did believe Casey is innocent, then they should also want the true killer found, right?

But nary a word from the Anthonys about the "true killer" of their supposedly beloved granddaughter.

Not only should they demand justice for her, but also demand protection for all of the vulnerable little ones alive that are this "killers" next potential murder victim, right?

They know it's Casey, but they're willing to sell their souls to the devil, and that puts Caylee out there as a forgotten entity.

snipped:

Yet the thrust of today's defense filing is that Cindy Anthony made the 911 calls after hours spent learning new information, discussing matters with co-workers, meeting her husband and picking up Casey Anthony.

It says she held discussions with co-workers "in obtaining suggestions as to her course of conduct. They, therefore, could not qualify as spontaneous or excited utterances."

The defense reply cites recent depositions of Debbie Polisano, a co-worker/supervisor of Cindy Anthony, and Charles Crittenden, another co-worker.

Both testified that in July 2008, Cindy Anthony had a call from her husband about the car Casey Anthony drove being held at an impound lot.

The husband and wife met at the lot and discovered "the baby seat, backpack, and alleged 'favorite doll' of Caylee," according to the two witnesses' recent testimony. Cindy then returned to work and told co-workers about the incident, according to the filing.

"Cindy Anthony discussed the smell of the car with both Debbie Polisano and Charles Crittenden and told them that George Anthony had said that the car smelled like a dead body had been in it," according to court records.

Polisano told Cindy Anthony to go home and suggested going to the police, but Cindy Anthony returned to her desk, according to the testimony. She was later ordered to leave work.

I really want to see what the actual motion says compared to the one they filed a few months ago. Does anyone have the document that they filed today? TIA
It isn't showing up on the local county clerk site.

I'm thinking after this motion, HHJP is SO going to regret telling the defense they could ask. I can't believe Cindy is just going along with this either. Wouldn't her nursing degree be in jeopardy for saying she sat on this information for awhile before reporting it? And all of the lies since then?

It's too bad that the defense and Cindy doesn't have to argue this in front of HHJP. I would take the day off for a front row seat to that. Then again, maybe HHJP is glad he doesn't have to hear this argument. I wonder how quickly it's going to be denied now...

I mean shoot, if Cindy's word is that good, let Casey out of jail! She must be innocent because Cindy says so, right? Puhleeeeeeeaaaase.

Well I guess we all know why Cindy and George made this last television appearance. So that the defense could file their response. Unbelievable. I don't have any idea how those two sleep at night.

BTW the defense needs to make up their mind. Either Cindy knew that Caylee had been missing for 31 days so there was no emergency which wouldn't make the remark about the smell of the car an excited utterance. Since there was no "new information" to make the remark an excited utterance. Or it wasn't an excited utterance because she DIDN'T know Caylee had been "missing" for 31 days and she made the remark "to get the police there quicker".

So which one is it?

That just struck me as sooo funny! The idea of filing a legal motion based on something one of the A's said! Ha ha! Ha ha ha! Bwahahahahahaha!
:floorlaugh::floorlaugh::floorlaugh::floorlaugh::floorlaugh:

I predicted this in the GMA thread the minute I watched the video and heard Cindy's excuse. My first impression is that she had been coached by an attorney to plant that seed in a desperate attempt to bypass the excited utterance exception. I said then and I'll say it again - it is total BS and it won't fly.

IMO: This is not about the defense filing a motion based on what Cindy said, it was the defense using Cindy (albeit willingly) to tip off the public what their next move would be. They KNEW they were going to file this motion before CA ever said a word, imo. It was pretty clear to me that she had been coached. What I don't understand is why on earth they think using any of the Anthonys to relay anything to the media is a good idea at all. I have never seen it have a good outcome, from a defense perspective.

These motions don't worry me. In fact, I see these motions as positive from an appellate viewpoint. Every desperate motion they file is another reason that KC could never file an appeal based on ineffective counsel. Heh, no matter how silly they may seem to some of us, at least they're giving it their best shot. ;)

eta: When I say, "these motions don't worry me", that is not to say there is no chance in hades...there is always a chance, if someone could make a good, compelling argument that the SA could not refute. I have not seen that yet out of any of the defense attorneys. Let me just say - if JB stands up to argue, I will call "Game Over" instantly. ;) I'll give a listen to CM, although I still don't think it'll fly. lol

Rats!! I'll be on vacation in Key West :(

As much as I love the hearings, I'd take Key West any day. :D Especially over a status hearing. At least you aren't missing a good juicy one. The TES motions hearing is July 15th. ;)

Have fun on your vacation, Amil! :blowkiss:
