2010.06.09 Prosecutors File for 911 Calls to Come into Trial

I checked the county clerk records and it is not filed. That is why I keep asking if I am going crazy or does anyone have it? IIRC, if I recall correctly, and help me if I am wrong, they did this once before or twice before. I vagely recall it coming up that Baez handed a unrecorded sneak peek doc to a reporter, denied it, said it was faxed or shared in some other manner but effect still the same, it was un recorded.

Then some doc was shown to reporters that still had mention of Judge Strickland on them, when they got filed that was different, do you remember that, or am I way too sleepy?

Yeah, I remember the accusation, but I also remember the defenses response. I am not sure what the point is unless they never file it. Its late Friday, I wonder if the Clerk updated the website. The defense would be pushin their luck to do such a thing. Can't see it. sorry I hope they have it updated and time stamped by morning.

You are both right, from what I could tell by reading the media reports.

It has been a few hours since I read the links, but I recall them saying (paraphrasing) "the defense filed...." . However, TWA is also correct in that previously the defense provided a drafted motion that was NOT file-stamped to a media rep and it was released. We were able to view that doc (I can't recall off the top of my head exactly which motion it was...maybe a motion in re. TES docs?). Then several hours later, if not the next morning, they filed the final draft with the clerk. It differed slightly, from what I can recall.

I feel confident that they will file, if they haven't already filed this motion.

As to the ethics of releasing it to the media before it is filed, I'll leave that one to AZ. Personally, I find it extremely tacky, but not sure if it is considered legally unethical.

If they haven't updated the site by now, I seriously doubt we will see anything before Monday. Well, unless one of the media outlets provides us a file-stamped copy. I find it odd, too, that we have not seen the actual document.

I think the point is that it appears that filing a document so late on Friday suggests that the filing party is playing to the media. . . and even more so if the official filing has not even been accomplished at that point.

IIRC, HHJP even talked about courtesy copies being sent to all concerned parties during his discussion of late filings. (I hope I'm remembering right; it certainly wouldn't be the first time I've been wrong!)

It should have new stuff in it according to OS. IMO Someone has deposed Cindy's coworkers recently and they cite things that were said. IMO That can be very new and powerful stuff, especially if Charles C is now saying Cindy told him that Ga told her it smelled like a dead body. That is clearly hearsay. IMO I think it is possible that Os just added that on their own. IMO

Well, either the defense gave Orlando Sentinel an early copy or they are making it all up. Because even if it were in the depositions the Sentinel wouldn't have access to that information as it hasn't been turned over to the prosecution that I am aware of ~ Right?

I don't know who deposed them, but I believe when they do, both sides are present. IMO I think the Os is saying that the depo's were cited in the motion. IMO

Yes, they will! And, I hope after they play this tape, they will play the 911 call KC made about the protestors outside the A home. She certainly had some urgency and fire in her voice then, telling the operator that they needed to get someone there IMMEDIATELY! Just not so much when her daughter was "missing"!

Remember in April, on the motion they had originally filed, seeking a disqualification of Judge Stan Strickland, at the bottom of the motion , J. Cheney Mason, notarized it himself; but Mason's certification as a notary expired in November 2009? He refiled the document of course, but it was odd, especially on such a important document.

I think what I am remembering was released to a reporter, was some death penalty motions, that still had Judge Strickland's name mentioned, then when they filed them they were different.

Either way, the 911 calls are coming in, imo.

Just off the top of my head I believe she told Greta, Nancy,several local reporters, Geraldo, LE in the videotaped interviews, likely the Federal Agents, LP, Tim, certainly Lee, I believe Amy, et al

Greta says there are very important clues to be heard if one listens closely. Caylee says in the first two phone calls she did not know the baby was actually missing from Casey. In the third one was the fact that they cannot wait, they now need for dispatch to send the police now.

In Lee's depo with the state he describes Cindy at this point as very, very frantic. Casey by contrast is calm as can be, all emotion removed from her.
 
how many ways can they file this? and how many times can a Judge say "no".....:banghead::banghead: ca has been backing away from this comment since day 32 when kc was arrested and yelled---when she realized that ooppppppppsi.....:loser:

I just wish they would move along and actually put together that shock and awe moment that we have heard about---the reason one would wait 31 days for a missing child--party like a rock star and every thing else....:furious:
 
Can anyone provide a link to where more than one co worker said that Ca said the car smelled like a dead body? I am seeing posters state this as co workers as in plural, but am not seeing any documentation to back this up. So, if that one person gets on the stand and says that, will the defense not show an exhibit of the others that didn't say it? I find this to be on topic as it relates to the 911 call. IMO Many are using these co workers to back up claims of excited utterance. I hope someone can help, because many are making it plural and I don't know why. thanks

NTS, sorry if this has already been addressed, but I totally agree with this post! I rarely agree with your posts, but this issue has bothered me for a long time. I simply cannot understand why no other co-worker has come forward about Cindy's comments about the smell in the car. Thanks!!!

Hello. It is Charles C., one of the coworkers who said "We", (plural) were all standing around by the door when Cindy came in from picking up the car at the tow yard. AZl lawyer helped clarify for NTS that Cindy having told her coworkers (whether "we" meant two people or three or ten doesn't matter) actually diffuses some of the excited utterance claim, not bolsters it.

Indeed later in the day after AZ lawyer pointed that out, low and behold the media were shown or given an unfiled copy of a new defense document asserting just that...that it was not going to qualify as an excited utterance because Cindy had discussed it earlier with coworkers and her husband it was not a new discovery at all.
There is an entire thread about what Cindy said to the co workers and what they observed. IIRC at least three gave statements to the police.

- All three were under the impression that Casey was working, as KC would often drop Caylee off to her mom at Gentiva "so she could go to work"
- CA mentioned 'smell in the car' to all three co-workers when she returned to Gentiva after picking up the car on July 15th
- All three found it strange that CA believed KC's stories about the Tampa accident and reasons why CA couldn't talk to Caylee
- two coworkers (the Debbie B and Debbie P) both advised CA to call the police on July 15th after hearing about the car
- Both Debbie's also noted that CA said KC was fighting/yelling a lot at GA

- KC was often seen wearing an ID tag when she visited Gentiva, but no one noticed what was on the tag"

Many lawyers, and indeed the state in its motion opine that the 911 call is still coming in to the trial because although the condition of the car was weighing on her throughout the day...it was the moment that she learned Caylee was missing from Casey that , anyone can hear it in her voice, in the words of Lee she became "Very VERY frantic!" If the learned judge should determine that the 911 calls will not be coming into trial, there is still plenty to work with for the state to put the other pieces of the puzzle together for the jury. Not that they would be permitted to testify to them, but I have found various and sundry examples of how often mom and pop told others about the smell in the car. If I am on the jury, I am perfectly satisfied just taking the opinion of a homicide detective. All the mom and pop stuff...I have already set aside because imo the jury will find them to be beyond biased if not biased and troubled and dismiss their testimony in its entirety.

From personal experience, my mother had been very ill with pancreatic cancer for a while and I had discussed it with doctors, family and friends many times. It was not until a new oncologist stated that she was terminal that it all hit home for me. Then my next call to someone close to me was an excited utterance about her impending death.

Just thought that was a good analogy...

We just have to keep things in context, the defense may ask for the 911 calls not to come in, indeed they should ask, that is their job to try to fight everything they possibly can. Just because they ask does not mean the judge will grant their motion, first second or last bite at the apple, right?

There is no shortage of criticism in the legal community against the defense. I was wondering if Mr. Mason would be able to make a big difference in the case, but I see no signs of progress. For all the jumping up and down they did getting Judge Strickland removed, it has not worked out to their benefit. Do we think Mason or Baez will argue the motion, if the judge even entertains oral arguments in a hearing? I vote Mason will.
Watch the interns ( I assume they are interns, young lawyers or law students ) faces when Mrs. Drane-Burdick explains the various and sundry things wrong in this defense motion. I hope she argues the motion for the 911 calls. I like Mr. Ashton and George too, but Linda just stays so calm it keeps the demeanor in the courtroom focused ( imo) on Caylee. The gentleman remind me of high school rivals for who got the girl sometimes. In fairness, I do notice Judge Perry has reigned in a lot of that snickering and banter.
