2010.06.28 - Kyron's Dad files for divorce and restraining order

There was, however, a hearing already set for 22 July 2010. One week from today. It's not like there hadn't been a hearing date at all.

If I were someone ordinary, who had to stand in line like the regular folks for my court dates, I might feel a little peeved that KH can't wait a week. And if it were my hearing that got bumped to make space on the schedule for KH, I'd be more than peeved.

Perhaps I am being unduly cynical and the judge in the case will give up his lunch time or stay late so as not to disaccommodate any other petitioner.

While I can see your point, under these circumstances, it would be better for the wee daughter to back in her familiar surroundings. Other than her dad, the house is the only other 'constant' at this time. I am totally befuddled why the step mom should be allowed to remain in the family home given she was the source of potential domestic violence (why hasn't she been charged on that?).

what I don't understand when the RO was issue why didn't Kaine stay in the house and LE could serve and tell her she must leave? It would make more sense for Kaine and the baby to be the ones in the house.

I don't understand why he wants to go back to the house. He was so focused on keeping his current location secret -- was that to protect his daughter? to protect the person(s) he was staying with?

But now he is going back to an address Terri clearly knows.

IMO, he could care less about going back to his house. It's a pressure tactic from LE.

Exactly! I understand that in some jurisdictions the officers arrive and watch the DV person pack up and leave.

The request for an RO was issued, but the actual RO hasn't been processed. Either party is free to reside at the home, but KH chooses to avoid TH in light of suspicion. This is the reason he is petitioning to expedite the hearing. AFAIK

at least in Orange County, Family Court, there are specific judges that take specific days for the ex parte (and or expedited) hearings. It's earlier than the rest of the court times -

I would imagine that in order to request an expedited hearing that there are specific criteria that has to be met to be heard. (including service on the court and the other party.)

But now he is going back to an address Terri clearly knows.

Terri knew his "secret" address too, based on its being mentioned on the RO.

So maybe he now has a choice of living in an address that Terri knows that is his own comfortable house, in familiar surroundings for the baby, surrounded by memories of Kyron, or an address that Terri knows which is a cheap rented room or an uncomfy shelter or somebody's guestroom. Terri knows where it is either way and he really wants to get home and put the porchlight on.

I question where TH's parents are.

On KOIN News last night, a reporter went to their home in Roseburg and the reporter said that the parents decided not to comment. The reporter didn't specify if one or both parents answered the door (or neither?).

Well, I dunno what's the right way to divide their money (I have no clue about what they have and what each have contributed or if they have a prenup or any other factor that might play in) but IMO in the normal ebb and the flow of a standard divorce the couple has the option to continue to live together until such time that they get it sorted out who is going to move and what each of them are going to take with them. The RO complicated this process because living together was no longer an option and apparently Kaine chose to leave his home to get away from Terri faster.

I hope the first thing Kaine does when he gets home is throw away every bit of food, drink, spice container, shampoo, deodorant, body lotion, baby powder, cleaning product, and medicine bottle in that house. He also needs to change the locks immediately and have the place checked for cameras and bugs.

Then he should send the bill to her attorney.

Did Terri's errands include a visit to the gym? I thought they did but I might be wrong. There is the babysitter option.

I'm not really interested in the material possessions of K and TH. What I find interesting is that TH agrees to move out of the home in exchange for money, but she waives parenting time. So what's more important - a few bucks, or time with your baby?

A few bucks, I guess.

Hope she has stayed away from Kyron's things.

I think she would if she's got any rational thought going because it would just be another nail in her coffin in the court of public opinion (and mixed metaphor) than for Kaine to come home and invite the camera crew in to witness any destruction made in his room (or the house altogether).

I wonder if it was because he knew about the "sting" and assumed he'd be moving right back in?

I would love to see Baby K and K be able to go home. But I feel this is something more. The hearing is only a week away. Why the push for a faster hearing? I'm waiting for the next shoe to drop.

If LE were to come to the house to arrest her, I wouldn't put it past Terri to try to barricade herself in there and go down in flames, taking a few cops with her. I'm not sure that homeowner's insurance covers that, if the person doing the damage is your wife! Maybe Kaine prefers Terri would do that somewhere else. (without hurting anyone else, of course!) :truce::truce::truce:

Good thinking!! Especially the spices, etc. I wouldn't trust her any farther than I could throw her!!

MC's actions scream his involvement. Befriending Terri, sexting, seeing and photographing RO, google mapping Kaine's new address, etc. What else has he done? What is he capable of? How can any of that be innocently explained away? Perhaps Kaine needs to obtain a RO against him as well.

What, you don't believe Becky Owen's explanation that the photographing documents, Googlemapping the address, sexting, and viewing nekkid photos of TH were all attempts to help their friend find his son? Why jump on this poor, wholesome guy?
