2010.06.28 - Kyron's Dad files for divorce and restraining order

Yes, but the grand jury has been suspended for the time being.

All Mult Co. grand juries suspend at 30 days. That's because that's the stated length of their term. Won't be long and we'll see a new GJ empaneled.

The GJ serves more purposes than as merely an indictment-generating machine. It's also an investigative tool that is used to call in and to get people to testify to what they know. With Houze on the other side of this thing, I think that MCSO and DA are wise to do this--to get witnesses in and on the record.

It hasn't changed with Kaine, because he's wanted the divorce quickly since he filed for it.

Um, I don't think so. Terri's lawyers filed for the abatement, which would have been quick, down and dirty and Kaine's attorney was protesting the abatement. (I think?)

Kaine wanted the entire divorce done and finished quickly.

Terri was willing to divorce him quickly if he would hold off on the financial/custody issues until a later date, even years later.

I admit to being clueless as to the Oregon Grand Jury rules. I did find this though:

When the jury service term is completed the grand jury must be discharged by the court; but the judge may, by an order made either in open court or at chambers anywhere in the judicial district and entered of record, stating the reasons, continue the grand jury in session for such period of time as the judge deems advisable.

Perhaps an attorney will come along and clarify.

The RO is already in effect. The deadline to contest that has passed, IIRC. That gives Kaine custody for at least a year. I don't see why Terri would be forced to answer to it in the divorce case.
BBM

Oh wow. I didn't know that. Interesting... I can't imagine being without my baby for a year!!! (IF I WERE INNOCENT in Kyron's disappearance) :( I read things like that and it makes me fall more and more towards the TH is guilty IMO side of the fence. This case is just :waitasec:

Abatement = divorce in name only.

Which are the most important issues decided in ANY divorce.

Well but the big birthday bash and fundraiser at Bullwinkle's is tomorrow. If that was the reasoning, you'd think he'd have waited until Monday.

sigh

Someday I hope the focus can be where it should be - on Kyron. I'm really tired of the lip service that doesn't hold water.

Where's Kyron?

bbm

I'm so glad you said that. For some time, I've wanted to post saying that once, just ONCE, there would be a press conference or interview by KH & DY that would be about KYRON, and only about Kyron. You know, "he's a special little boy, here's his picture, we love him, if you have seen anything, remember anything..." etc. You know, the normal thing parents do when their child is missing. Instead, all we saw was airing (alleged) dirty laundry, family drama, and attacks on TH, all personal stuff.

Indeed, where's Kyron? I frankly am tired of the soap opera that became the focus, instead of "where's our beloved child? Do you have any information? You can talk confidentially if you need to. Please, please help us. Any small thing you remember could be the most important thing if it fits into the missing place in the puzzle. Please help us. And here's Kyron again. He loves tree frogs. He likes science. He's funny. He needs his glasses. He's allergic to bee stings." BTW, I almost did a big thud when that important fact was casually mentioned, off-handedly, quite some time after he went missing. One of my friends was allergic to bee stings. She lived next door. We kept an injector in my fridge as well as hers, just in case. I couldn't believe that the allergy was just...tossed off, later on.

Sad that Terri won't tell.

That wasn't my point. If she's not contesting the divorce, why would she need to utter a word in civil court?

I can see what you're saying but if she never utters a word in court does that mean that she will never see Baby K again until she does? AND would that also mean that she is just going to go along with whatever financial outcome as well?

Not even trying to get visitation with the Baby speaks volumes to me too (I see others have said the same)

P.S. Lawyers have a hard job!

I think Kaine dropped the motion for the reason he stated--to streamline the issues at hand.

Maybe you should go back and review the press conferences and interviews. I recall them talking quite a lot about Kyron--that is how we found out his favorite color-red, that he was allergic to bees, that he liked to play with hot wheels, that he wants to be a policeman when he grows up, and on and on.

IMO, there is no way to completely separate who Kyron was, and the hinky details of his disappearance. I think we have pretty much ruled out that he just walked away to start a new life. His disappearance is inexorably linked to TMH and her strange behavior, and there is no way around that.

Huh?? When have Kaine or Desiree had a presser when they didn't talk about Kyron?? Only one who hasn't uttered Kyrons name in public is Terri. There is just no end to the criticism of Kaine and Desiree.

I suppose the contempt motion has outlived its usefulness. Kaine has moved back to their old house, the address of which Terri knows by heart and everyone can google if they don't already know so the issue of revealing his address has become moot, and if we suppose that MC or other people that Terri and MC may have leaked the details of the RO to are responsible for having the details of the RO in the news it was Terri who it hurt the most since it's her reputation. Kaine is probably safer now because if Terri has any murderous designs in her mind she knows that if anybody shoots Kaine she is going to be blamed.

LOL. Maybe you should go back and review those press conferences and interviews, gwen. It does help to prevent recalling things that didn't happen. It was not Kyron's parents talking and telling us those things about Kyron.

It was LE, Shults specifically, from whom we found out that Kyron's favorite color is red, that he likes to play with hot wheels, and that he wants to be a policeman when he grows up.

It was from a written statement, published in the press, we found out - an entire month *after* he went missing - that he's allergic to bees.

BBM , and adding this: "His disappearance is ALLEGEDLY inexorably linked to TMH."

There are many interviews, TV, radio and print, and many of them have questioned LE, the school, and also how the family handled the media in various phases. For starters, here's an early John Walsh of America's Most Wanted doubts about the school's handling and the parents' early conduct re: the media:

http://www.kptv.com/news/23932306/detail.html

Commentary from various sources has also noted the use of press conferences to attack TH vs. using that precious time to talk about Kyron.

Nothing new here, actually.

The new stuff is the dropping of that contempt motion. I'm just wondering what other "new" will be coming along.

In principle I love the idea of focusing on Kyron, that precious boy being n the center of it all and talking about him and only him because he's the most important thing. But in practice IMO it is almost a certainty now that knowing his favorite color and what he loves and wants to do when he grows up won't help bring him home. He didn't run away from home wearing his favorite color in order to become a policeman. IMO it's likely that information about the perp would help find him better than information about Kyron's personality. Whether or not the perp is Terri is another question.
