2010.06.28 - Kyron's Dad files for divorce and restraining order

Whether or not TH was on steroids, I wonder if there was a basic personality conflict between her and Kyron? She's into building her muscles and he is a little science guy, more introverted possibly. I've seen it happen where a step parent is frustrated with a step child because they don't meet his or her expectations.

I was getting ready for work this morning when I heard the news on GMA. Like many of you, I was floored.

I agree that Kaine has learned something big enough about Terri's role in Kyron's disappearance to make him take such drastic action.

And I would agree that to take out an RO, there has to be some real perceived threat of danger to the baby.

But I will go out on a limb and say that I don't believe for a second she would harm her "OWN" child but I do think that taking the baby away from her may very well be the thing that breaks her and causes her to confess.

Hope it is OK to post this link...

Standard LE statement I guess.

Sheriff's spokeswoman Lt. Mary Lindstrand said Monday night her office is "not talking about personal issues going on with the Hormans." She said Terri Horman is neither a person of interest nor a suspect.

reposting Dan Abrams take on poi/person of interest statement

KATU says that it's a physical restraining order, meaning that it's not just one barring removal of the child from the state, etc. It is so Terri does not come near Kaine or the daughter.

I have seen the bodybuilding pics from 2005 and she was definitely in shape, oiled, tanned and muscled. Pics were from a bodybuilding competition where I believe she placed in the top 3.

She placed 4th in the competition; the photos are all in her published album still and some of the photos have been shown on major media outlets - including Jane Velez Mitchell as recently as last night. A few months after the competition, she had the DUI with her minor son in the car. He is now living with grandparents.

But back on topic, I am sure JVM will continue Kyron's story tonight and have a panel discussing Kaine's filing for divorce and obtaining a restraining order to protect baby K. It hurts to type that - baby K has got to miss her mother. Terri's actions have not only harmed Kyron and his other 3 parents, but also her little baby girl. SAD SAD SAD!!

Can you imagine being Kaine right now and having to come up with what to tell this baby - and not just once, I am sure she will ask over and over and over about where her mommy is. SAD, you guys!! SAD SAD SAD!

Sure is no winners in this situation.

I haven't posted on this case in weeks. I keep going over scenarios in my mind that might result in the order of protection being issued so quickly. Every time I come up with something plausible, something else makes me rethink it. Part of me thinks Kaine knows something big about T and Kyron, the other part of me thinks it could be a set-up from his side. As usual, wish we had more information.

If they have evidence strong enough to convince Kaine that Terri is lying about Kyron's disappearance and to support the granting of a restraining order, then why hasn't she been arrested?

[...]

A lot of the rumors have already proven false, and while some of Terri's known behavior is odd, and even inappropriate, there is no rule book about how to deal with a missing child. Perhaps even those behaviors could be legitimately explained away -- it's like the picture where you see an old lady and a young lady. Sometimes there's more than one way to view what appears to be a singular picture.

Can someone clarify the everythings-fine-thumbs-up reference? Not familiar with that one. TIA

Also, I realize I'm a newbie, but it's disappointing to be called an ostrich or for the inference to be that some posters are less intelligent because we didn't charge with our cyber pitchforks after Terri that first day. Either way this story pans out, Terri was with Kyron in school that day, and if it is her, it's sure an elaborate and risky plan to dispose of a child many here speculate that she hated when people who know the family say she was a model stepmother.

Marvelous post.

Shortly before Terri was served with divorce papers and the restraining order, a reporter asked her if it was true that Kaine and baby K had moved out. She responded by saying that they'd heard that rumor, but it was false, and everything was fine between them.

BBM. There is a big difference between knowing someone is guilty of a crime and being able to prove it in a court of law. If this case ends up being a capital murder case, then it's going to a grand jury first and the grand jury will issue an indictment for murder. This can take weeks, months, sometimes years. LE avoids rushing out to arrest people unless they are a immediate threat to the community. There is only one shot at a conviction and an arrest happens when there is enough evidence to take the case to trial.

Maybe we need a legal thread but IMO I don't think the SM would be able to have any Press type conversations regarding the RO because it may get her in trouble if she talks about her husband/child could be looked at as harasment. IMO she's walking on thin ice if she has one.

Time will tell.... IMO IMO IMO

I respectfully disagree, isn't WS beautiful in that way? To my knowledge, nobody, and most certainly LE, has said that she has harmed anyone. If it turns out she has, I'll be the first to pick up the pitchfork. But not one moment sooner.

I do agree with your thoughts on poor baby K. This has got to be so confusing for her right now. First Kyron suddenly isn't there, mom and dad are stressed, all sense of routine and normalcy is out the window, mom and dad are crying and stressed all the time. And then, as if that is not enough to shake up this little girls life. POOF! Mommy is gone as well.

It really doesn't take much to be granted a restraining order here in Oregon. I went through this with a friend not long ago,and it was as simple as getting the judge to sign off on it. Oregon has very VERY strong assault laws. If you have been threatened or are under the assumption that a person in your household could become violent, a judge will sign off, no questions asked.

Our county (east side of the state) actually has a program that will ensure that an emergency order is reviewed and signed by a judge and served the same business day.

essentially, when reached for comment yesterday afternoon about kain moving out, it was terri's version of 'mission accomplished!" or 'pay no attentio to the man behind the curtian!"

Exactly!! LE said awhile back that they do not plan to make any mistakes in this case. I think they are doing a fantastic job and it is their patience and caution that is going to seal the deal in the end. The case is actually progressing at a fairly rapid pace, all things considered.

Oh geeze. Wonder if they talked about divorce right before Kyron went missing..and IF she did this...was exacting her revenge in a way that would hurt Kaine the most. OMG!!!
