Yes, he chose his own attorney. Don't know how expensive she is compared to other family law attorneys in Portland. Terri made the decision to hire an EXTREMELY expensive attorney. He shouldn't have to pay for that decision. That's why he wants to make sure he won't be on the line for that debt.

Yes, he has a job, but how much work do you think he gets in these days? 40 hours a week? 30? 20? Should Intel continue to pay his full salary if he is not working?

Yes, Intel has attorneys. Probably lots of really smart ones. But they are not family law attorneys, and don't do divorces for Intel employees. They are corporate or IP attorneys. They can't help him.

He is not making his full salary. He has new expenses like day care. He has huge attorney fees thanks to Terri's melt down. I doubt he is qualified for legal aid. He is not indigent. Just really, really strapped.


Terri didn't hire a divorce attorney. She hired a criminal attorney. Kaine has a divorce attorney. They are completely different arena's and price ranges. The divorce was already filed. Terri's attorney debt is Terri's not Kaine's. Kaine really has no reason to know anything about her attorney or what fees she is paying him. He is effectively separated from Terri and if she has a need for a criminal attorney it's not his business really. The DA is the attorney for Kyron. Kaine really doesn't come into play except as a witness against Terri if she is ever charged. On the MFH Kaine will be represented by the DA if she is ever charged. He really has less right to know how Terri paid her attorney than Terri does to question how much of THEIR money went to pay Rackner.

Well, you are welcome to your opinion, but I'm afraid the divorce laws in Oregon differ. In Oregon, Kaine absolutely has the right to know where she got the money to pay for her attorney. If she were spending large amounts of money on *anything* right now, he has the right to know where she got it. If she wanted to file a motion asking where he got the money for his attorney, that would be her right as well. But I think that is not a mystery as much as her sudden cash flow is. It is against the law for divorcing parties to hide assets. At first glance, it appears Terri miraculously came into a very large asset. If her parents lent it to her, fine. End of story. If there is another explanation, it needs to be made known. That is the law.

I agree that she should be ordered to pay child support based on what her income would be if she had been working. I think his huge attorney fees had been coming up for a while. He may have thought they had worked through there problems but imo they were headed to divorce anyway and I still want evidence of this melt down. I don't necessarily believe she is innocent but I can't say something is her fault until it is proven. I have no proof of a melt down causing him to file for divorce.

I really have no idea why MY OPINION is such an issue.

1. Terri has no income. She did not ask (file motions) for Kaine to pay her attorney. When you hire an attorney, you're the client. You are the only one responsible for the debt. If I hired an attorney and defaulted on the payments, it wouldn't be my mother's responsibility to pay for it. So who gives a rats behind about him getting stuck with the bill. He didn't sign the contract with her. There would be no reason for him to be stuck with the debt.

2. I'm almost positive I stated that he probably hasn't been able to work full time. I don't know his salary. Maybe he's an hourly employee. Maybe he was making 300+ per year and they decided to continue giving him that salary. Maybe they cut his salary in half. Maybe whatever, anything. Who knows. I don't work for Intel. I don't know their wages/salary/benefits/HR process.

3. Maybe an attorney who works for Intel can't walk into a courtroom and represent someone for a divorce, but law is law. Just because you're specialty is in, let's say for example, torts, doesn't mean you don't know the basics of a divorce. I'm sure law schools all over the country teach basic principals about all areas of law. If he walked in to one of the attorneys and said "I need a divorce but I don't know where to start" I'm pretty sure the attorney would say "well first.....", considering his son is missing and it's a high profile case. They seem like a good company to work for. They didn't fire him for loss of substantial time, he still has his job. I think they would be pretty workable given his circumstances.

4. Maybe he is indigent at this point. If his salary was cut in half and now he pays for daycare, food, mortgage, car payments, etc., etc. then maybe he pays out more then he brings in. We don't know his financial situation.
If he purchased Terri's car as a Mother's Day gift then why didn't he ask for it back? Rhetorical question. He wanted her to move from a house that was in his name. However, we don't know his financial situation....again.

3. I work for attorneys. Two of my brothers are attorneys. No Intel attorney who has any kind of intelligence is going to give an employee legal advice for a family law matter beyond "Call a family law attorney." I promise.

ETA: Would you feel differently about this if we found out Terri won the lottery 3 weeks before Kaine filed for divorce? Do you think he would be entitled to some of the money? He would. We just don't know where she got the money. That is all he wants to know. He has the right, according to the laws of the state of Oregon to find out. Pretty simple. Happens all the time. If he suddenly showed up with $350k, don't you think she would like to know where it came from? She would have that right.

Like I said originally, I thought when you filed that effectively ended personal responsibility for anything the other did after that point. If it doesn't work that way in OR and you are responsible until final signing that is different on my side of the border.
I do think it is silly for him to play like he thinks she had this hidden or borrowed it while they were together. If she had it all along and the MFH is true that 350,000 would have paid someone more qualified than the landscaper.
Also a divorce would have made a very small dent in it and she could have moved on without and these crimes she allegedly committed. She could have just kept it hidden until he was long gone.
 
I don't know anything about her finances and she might be the daughter of Midas and sleep on a mountain of money for all I know but presumably Kaine is more familiar with her financial situation and he doesn't seem to understand where it came from. So if she's got little or no income and few financial assets, wouldn't IRS be slightly interested in finding out where that kind of person suddenly comes up with 350.000 dollars?

For the most part, that is true. Absolutely. That is one reason why restraining orders are usually put in place when the petition is filed--so one party can't run up bills or sell/destroy/waste assets. But that is why he has filed the motion. To find out. It would be stupid for him to just "assume" where the money came from and when. He is just asking. He has the right.

Yes, my husband had to pay both attorney's when his first wife filed for divorce because she had no job while they were married. He had to pay spousal for 3 years also even though they were only married for 2 1/2.

I agree Kaine will probably get stuck with her divorce attorney debt but not the criminal attorney debt.

Nope corporate attorney's don't do divorce. I totally agree.

If Terri won the lottery before Kaine filed for divorce then absolutely he should get some of it. I hadn't thought about that angle. In Terri's shoes I probably would have taken the lotto winnings and run. Sure would hate to give it all to an attorney.....
 
The lowest estimate I was able to find online for what People Magazine paid for exclusive pictures of the first Brangelina baby was $1.5 million.

The exclusive photos of the twins are alleged to have gone for over $15 million.

God, truthfully thats the last thing I would buy a magazine for!! Our priorities stink!!!!!!:banghead:

I think I recall, that Teri has a divorce attorney...I'll have to go back and see where I saw that. And the only reason Mr.Houze was the attorney on record at the time was becasue she did not have a divorce attorney at the time. Anyone else remember seeing that ???

Another thought on this is that just as it is in his rights to know where she got the $350,000, it is within her rights to be provided for, since they are "still married".

I realize that the divorce laws differ from state to state, but in my state, until you have a final agreement and final decree everything is marital property.

So in my state, if TH suddenly has $350,000, even though divorce papers have been filed, KH would still be entitiled to 1/2. It's still all marital property until an agreement is reached.

In my state, I sure as heck would be going after 1/2 of it!! You betcha. And in KH's position, I'd certainly want to know where the $$$ came from.
