I am very interested to see what Kaine's attorney has to say about TH wanting visitation with baby K.... IMHO that will tell us a lot.

She could have been fighting to see her daughter from day one for all we know. Seriously.

I'm sure if any emergency motions were filed, the media would have been all over it. Not sure what you mean by she could have been fighting to see her daughter from day one. 3 1/2 months have passed since the RO was filed barring TH from contact with her baby. The only way to unring that bell is to stand before a judge. Today (3 1/2 months later) is the first time we are seeing that.

They are both very attractive women. TH is very put together today---hair, clothing, makeup.

Attractive on the outside is no indicator of what lies beneath the surface. Just saying. This woman has much to hide and her attorney, in my opinion, just makes her seem all the more guilty of Kyron's "disappearance. Methinks he doth protest too much!

It seems to me that since MFH allegations and TMH's possible role in Kyron's disappearance were the basis for the RO, then that information would be relevant for her lawyer to have.

Any real lawyers want to weigh in?

Well that is the first time I've heard that she wants her baby. Of course, that's coming from her lawyer, not her. It's probably just another tactic to make her look more sympathetic to the court. I won't believe it until it comes out of her mouth.

With all due respect, Terri's attorney DOES have the right to that information, and should have long before now gotten it, since the State felt it necessary to give it to Kaine, who is using it in this civil court case. The State had no obligation to give it to Kaine.

If they had left it at "Look, we need you to take K and leave. We can't tell you why, but just do it." that would have been one thing. kaine horman indicated the State gave him specific information regarding an ongoing investigation which he is now using against Terri, and in this case, denying her the right she has constitutionally to know what it is the State has against her.

this may be a good thing to ask on the lawyer thread as I am not sure he does have a right to that info for the general divorce. Maybe if they have a future hearing on custody as that is what the RO was about.

No, earlier it was reported that it could take up to two years to sort through all the muck. Today the attorney stated he would proceed straight to a divorce if Kaine was willing to divide everything today.

IANAL, but in the documents (on file here at WS) didn't KH specifically state that he wanted the RO because TH had tried to hire someone to murder him? As well as his belief she did something to Kyron?

As for the MFH plot, yes, I would think it would be relevant, especially with the failed sting. And especially because the MFH allegation was made in June, right? And the LS said it had happened 9 months earlier? That's just about a year ago.

If someone wanted to hurt Kaine, they would have done it by now. All there is, as far as we know, is an alleged statement by the LS that TH used words threatening him.. No nutjob has shown up at the courthouse, KH's workplace, or job and threatened him, as far as we know. So I think the talk about MFH has been, pardon the awful pun, overkill.

Then again, maybe today's hearings will bring out more about that. It's all so confusing.

It will be interesting to hear what the judge has to say. I don't expect a decision today, but I may be wrong.

MY OPINIONS

Because she has Constitutional Rights, and no one has to like that but the 5th Amendment also protects against the State bringing unfounded charges without allowing the Defense to address them, and especially when those accusations have denied her the right to her home and her family.

Terri's attorney argued just this, today. The State refuses to turn over evidence, evidence they apparently truned over to Kaine Horman about a MFH plot including the 911 tapes that Terri made the night of the foibled sting operation, to proceed through a civil case. They argue that it provides one side with an advantage, and forces their client into a position of having her 5th amendment rights violated by having charges like this where she cannot prepare a defense due to not knowing what it is the State provided Kaine and seem to accuse her of.

This same violation was used to get a restraining order keeping her from her child.

Separating the divorce, the custody issues, and the criminal charges (if any should ensue) is what the lawyer seems to be attempting to do.

If LE was genuinely worried for Kaine's safety they had an obligation to give him the info.

Where's Gitana? This thread needs an attorney.

Actually, it's Kaine who's thinking about money, IMO. He wants to know where the $ for Terri's lawyer came from, so he and attorney can decide if he can claim half of it as marital assets. Let's see, half of the rumored $350,000 = a lot of money. A lot.

*sigh* And that's the entire problem. We will never know how she feels unless she talks. Her lawyer can say what he wants to paint her as this victime of hatred living in fear, and oh yeah, she now wants her baby too. If we were to believe Baez about Casey, she's just a misunderstood young woman who has a massive conspiracy/frameup from everyone against her and is totally innocent of anywrongdoing against her daughter, who she loved. We know that is NOT the case.

How nice that 3 and 1/2 months later she's finally going after her daughter, and only through her lawyer. Doesn't change a thing in my eyes.
