2010.06.28 - Kyron's Dad files for divorce and restraining order

Well it's remarkable only in the fact that she was asking for visits with her daughter behind the scenes but not willing to go through the motions of contesting the restraining order. That carried alot of weight for some people on here. So she did ask...but not through the courts, or so it seems.

Thank you for that. I have been away from posting and my head is not quite clear due to meds. I suppose that it would have been mentioned if she had gone to court. Would not her private request to Kaine be a violation of the restraining order? Of course it could have gone through her lawyer.

Brought over from another thread:
Pretty short and sweet motion. Looks more to me like Terri and/or Bunch just want Kaine to pay some money to Bunch. JMO.

Why would this cause Kaine to pay any money to Bunch, per the article "Yet, if Kaine Horman insists on having someone professionally supervise his estranged wife's visits with her daughter, he should pay because Terri Horman is not employed and has no income or significant assets, Bunch argues."

I don't see how Bunch would get any money, unless Kaine chose him as the person to 'professionally supervise'...and that wouldn't make sense at all.

What I see the statement saying is Terri saying I am going to fight to see my child, and am willing to do so however you want...if you are willing to pay for it to be your way.

Many have stated that the psychology behind Terri not fighting and/or wanting to see her daughter is tied to the psychology behind disappearing Kyron. IMHO, this is relevant to that assertion.

She has been fighting for her daughter, behind the scenes.

Maybe she wanted to do things behind the scenes in order to protect her daughter from the media and being in the middle of a national custody battle (not that Terri is seeking full custody).

KH is the victim and anything TH does in opposition to him will be seen as her being a terrible person.

You are so correct. IF, IF, IF, Terri is not guilty in any way, shape or form of Kyron's disappearance, then she too is a victim and no one, that I've seen anyway, not even her family, is saying that she is. (Other than an implication by a friend or two.) :(

Item #2 in the motion.

ETA: I am assuming Kaine will fight this. So is Terri.

Respectfully, we don't know what Terri is thinking.

I highly doubt that the thought process was " I want KH to pay Bunch some money, so I am going to go to court for my child"

I could see something like : "KH is being unreasonable [in her mind] and because of that I am going to court to get my baby...and make him pay for it"

I never said that Terri was a victim (or could potentially be one).

Yep.

I guess 'well if she was innocent, she'd be trying to see baby' doesn't hold much water any longer. So if she's been making repeated attempts to see baby, does that mean she's innocent in Kyron's disappearance?

I have a feeling her lawyers would not allow this if they were not fairly confident about the possible criminal case.

And they're good too.

Got the judge to agree that her 5th and 6th Amendment rights would be compromised if she had to testify in the civil case, then pulled this rabbit out of their hat(s).

IMO, Kaine's attorney is in over her head.

No, I know that, you said Kaine is a victim, and what I said is:

IF Terri is not guilty then she is a victim as well, and some seem to forget that this is a possibility.

My apologies! We are on the same page (pertaining to this issue) then!

I tend to get a little defensive, especially since 'on the fence' seems to sometimes be confused with 'TH supporter/KH basher'

I don't get what is so good about this. So she wants to see baby K, but not submit any proof of why she should get to see her, just go on my word judge. Oh, and if there's money involved so these visits are supervised, Kaine has to pay for it.

Wow, what an entitled, narcisstic motion. If Terri is trying to look good for this, she and her lawyers are doing a terrible job of it. I hope Kaine fights this tooth and nail. What a crock of crap!

Doesn't matter that's she asking, it's how she's asking that matters. This is not fighting to see baby K to me, it's hoping like hell the judge is going to grant a miracle so TH can see her. I guess CYAing her own butt is still TH's top priority.

.
well aedrys, she is the child's mother so she has every right to seek visitation. I don't doubt for one second that she truly wants to see her child. Guilty or innocent, i don't have any reason to think she doesn't love her child. None of these things are necessarily mutually exclusive.

First bold: #7 in the http://media.oregonlive.com/portland_impact/other/bunchmodify.pdf

Second bold: How else should she 'ask'? According to her lawyer they have already made repeated attempts to working it out outside of the court system.

this thread is about TH seeking visitation and modifying the RO.

Kaine has a RO against Terri as to seeing the baby. If Kaine were to give her visitation outside of the court system, that could possibly nullify the RO, and Terri's attorneys know that. Kaine was most likely advised, correctly, I might add, NOT to agree to any kind of visitation unless a judge orders it.

Yep.

She has no right to go behind the court's back and get visitation when there is an active RO in place. It HAS to go through the court and her attorney knows that. Doesn't sound like he was giving her very good advice.

I wonder if the expert will actuallly meet with TH prior to testifying. I thought she couldn't get an unbiased custody eval. I think part of $350k can buy a lot of favorable testimony. Can't wait to see who the expert is and find out how much his/her testimony is costing.

If she truly loved that child, she would move heaven and earth to see her, put all of her dirty cards on the table and not care about the consequences. The fact that she still wants to hide everything but see her child is just not right. She can't have it both ways.

Kaine's attorney, Ms. Rackner, is very highly respected in Portland. She is certainly not "in over her head." She is doing just fine. IMO
