2010.07.01- Motion for Emergency Hearing

This might be a stupid question but do we know exactly what lawyers are still on the defense team? We know that Lyon is gone. Mason has another case that he is now working on as well as this one. Baez is still there (or as there as Baez can be). What about the other woman? Is she still a part of the defense team? If so, why is her name not on any of the motions like Lyon, Mason and Baez?

So we have a hearing at 1:30 tomorrow, FOUR depos to be done tomorrow as well. What lawyer is going to do the depo and what lawyer is going to be at the hearing? Do they really trust Baez enough for him to do either solo? Wouldn't they want more than one lawyer at the depos?

Also about the 13th and 14th. Same thing, experts in Florida those days and depos in Tenn those days. What lawyer does what? Do they really trust Baez to do either solo?

Why do I feel that the defense is up to something? It just makes no sense to me for them to have a scheduling conflict like this not once but twice.

Ok, something is not really adding up for me. I found this article when looking for other information about the emergency hearing:

DEPOS SCHEDULED FOR LAB EXPERTS IN CASEY CASE

Casey Anthony’s defense team has scheduled its depositions of the experts at the Oak Ridge Laboratories in Tennessee. That lab was involved in the air tests on Casey's trunk that showed evidence of human decomposition.

Court documents show Casey's lawyers will question five lab experts under oath over two days starting July 13. They'll be done at the University of Tennessee, which is affiliated with the lab.

The defense has already publicly challenged the lab's method and conclusion.

So the defense is going to Tennessee to do the deposition of those listed above on the 13th and 14th of July. There is a hearing on the 15th of July. What happens if, for some reason, the defense is not back in time for the hearing?

Also, is there any word as to when the defense is planning on having their own "experts" review the evidence?

Ok, again something is not adding up. According to that article the defense is going to Tenn to depose the folks at the lab and yet they are saying now that the "experts" will be in town (Florida) on the same exact days?!?! What am I missing?

Also, JB is flying his expert witnesses in from around the world :waitasec: ..... so it says in his motion. Okiedokie. JB has had months and months to schedule this. Betcha HHJP will want to know when the tickets were purchased and at what cost. Boy of boy if this is true HHJP is really gonna be pizzed.

Well just because they filed that proposed schedule doesn't mean the depositions weren't rescheduled. I thought I read here that JB put dates of depositions of certain witnesses and never bothered to contact them for their availability. He might have randomly put a date for a deposition with the full intent on rescheduling them but wanted to put SOMETHING down to comply with Perry's orders to have it filed by a certain day.

I think with all this Defense partnering with universities that JB has actually been cloned and JB[1] will be at the emergency motion hearing while JB[2] will be doing the depos and, original JB[0] will be on GR's boat fishing. The only way this can all work.

Well, this should be interesting. In AZ, people are always asking for communications between experts and lawyers--and asking experts at depos what the lawyers told them. Now I'm wondering if I should research this issue...I'm not totally comfortable relying on JB's associate's research lol.

This will never happen. The State needs to maintain custody and control over evidence. If allowing anyone to examine it outside their presence, would compromise said evidence. Unless that is what the defense hopes to do...tamper with evidence.

Once the evidence chain of custody is broken, evidence is tossed. HHBP won't allow that to happen. And in my opinion, a ridiculous request on the part of the defense, but that is just one of many.

Is the state allowed to bring up the evidence tampering that Dr Lee was found responsible for in the Spector trial...when he was working for LKB??

I have a feeling that LKB will do the depositions in Tenn. She's the person who handles all the scientific stuff and has been busy all these months amassing all the information.

That leaves Baez and/or Mason with the experts in Orlando.

Baez flies solo on the hearing on the 15th.

This is going to be VERY interesting!

I printed out the Baez Law Firm's website on 8/24/08. At that time, the only two Attorney's (sic) were Jose Baez and Gabriel Adam.

Due to the bar complaint about his "history", the website was virtually non-existent for a long time.

That's the best I can do on the issue!
