2010.07.01- Motion for Emergency Hearing

All strategy and has really nothing to do with AL's motion to withdraw yesterday. IMO

Maybe LDB or JA is on vacation...anyone know? lol

I do remember Ashton saying he had some vacation time in July, he didn't say when though and hasn't filed a notice about it.

Emergency hearings which can also be called "Ex parte" are heard in all types of cases including civil cases.

Does anyone have a copy of this motion???

Are we sure it is an ex parte hearing?

I agree with what you are saying, JSR. Yet, I still say this is strategy. I think the defense has known the what and when - I think they just decided to 'spring it' now. Ergo, the reason for the Emergency hearing request, iykwim.

Oh I totally agree it's strategy. I'm just answering the question why it may not be able to be heard on the 15th. And I offered the possibility of a conflict of the briefing schedule.

There's no way you file a motion like this at 4 something in the afternoon right before a holiday for anything other than strategy.

There isn't a doc dump tomorrow is there?

Ok now again, This getting me wondering now that AL removed herself, just what did JB have or say to convince these experts to review and then testify.

We know Kobi did a 180 turn and I thought he removed himself from the case.

HL is a disaster waiting to talk.

Sorry, no can do. Our van is due for it's 90,000 mile checkup. I can't buy airline tickets for ANYONE!!

Hey, I think we've got a Greyhound station somewhere . . . .

I have seen a bus, it is ready, all loaded up with all the faves.

I think it is called The Magical Mystery Tour, but it may be the Blue Bus. ;)

Thank goodness you all figured out my real question, finally, I have to get some sleep now.

Oh dear mercy! It was dead as a doornail around here for weeks and now we are on overload. LOL

Not that I am aware of, but that would sound like typical timing right before a extended weekend.

Unbelievable. After 2 years they are finally getting around to looking at the evidence....

IKR? I assumed they already had experts agreeing with there, um, story. I wonder if they tried to get a feel for how these experts would roll by sending them stuff first? Things like a long stretch and a big chance to me.

What if these experts don't agree with what the defense is trying to *IMO* force feed everybody and their dog? Do they get to hire more and more until they get experts that will?

I think JB has been shopping around for quite some time to seek the experts he needs who can support the 'facts' the way he wants to spin it. They have been briefed and now just need to go through the motions, so to speak to pretend to review the physical evidence, have the pre-planned revelation and, agree on it in deposition. They don't want LE seeing them 'fake' it.

IIRC I noticed that there are experts from Canada who specialize in human skeletal remains and torture. This sounds to me like they are weaving an explanation for the duct tape, that SODDI did things to Caylee that a Mother (KC) could never do / would ever do to rule her out and focus the Jury on some horror to sidetrack their thinking. IMO.

MuzikMan got the Notices of Taking Depositions:

July 13, 2010 - Defense depositions
Michael N. Burnett - Oak Ridge Lab
David C. Glasgow - Oak Ridge Lab
Madhavi Z. Martin - Oak Ridge Lab
Mark Wise - Oak Ridge Lab

July 14, 2010 - Defense deposition
Arpad Alexander Vass - Oak Ridge Lab

If he set the hearing for the next day it's gotta be ex parte.

:banghead:

I want the SA there anyway!

I don't care if they didn't get an invitation, I still want them there.

This reminds me of when JB cried foul, not being able to investigate the site where Caylee was found, being made to wait then not going back when the SA cleared it for their review. He had his " team" waiting on the sidelines. HHJS said he wouldn't interfere with LEs rules and procedures.

Believe HHJP will say similar and add more opinions tomorrow. By the way, again, another koinkidink, JB has a status hearing on July 15, Chaney is on another case and his expert witnesses will be in town reviewing the physical evidence then deposed. This should be interesting.

Anyone have a link to the actual motion? I'm dying to know if they served on the SA.

Great minds think alike! I was just thinking is this tit for tat, because LE would not let JB's expert team be involved in the crime scene so JB does not want LE to see his experts work. Hmmmmm?

Me and you both!!!

I am dying to read that motion and the certificate of service!!!

I'm dying to see this too, if it's doesn't go up tonite I'll get it in the morning.

A pity that they didn't file it BEFORE I was down there this afternoon. :furious:

Ok, something is not really adding up for me. I found this article when looking for other information about the emergency hearing:

DEPOS SCHEDULED FOR LAB EXPERTS IN CASEY CASE

Casey Anthony’s defense team has scheduled its depositions of the experts at the Oak Ridge Laboratories in Tennessee. That lab was involved in the air tests on Casey's trunk that showed evidence of human decomposition.

Court documents show Casey's lawyers will question five lab experts under oath over two days starting July 13. They'll be done at the University of Tennessee, which is affiliated with the lab.

The defense has already publicly challenged the lab's method and conclusion.

So the defense is going to Tennessee to do the deposition of those listed above on the 13th and 14th of July. There is a hearing on the 15th of July. What happens if, for some reason, the defense is not back in time for the hearing?

Also, is there any word as to when the defense is planning on having their own "experts" review the evidence?

http://www.wftv.com/news/24114206/detail.html

Ok, again something is not adding up. According to that article the defense is going to Tenn to depose the folks at the lab and yet they are saying now that the "experts" will be in town (Florida) on the same exact days?!?! What am I missing?

ETA Thanks JSR for getting that for us!!!

And for the love of God will JB learn to properly cite case law in his briefs!!!!! It drives me crazy when he uses short form before citing the whole case first!

You freakin' ROCK!!! :blowkiss:

And the SA WAS SERVED!

So, it doesn't HAVE to be ex parte.

omgosh...please LDB or JA be in town!
