2010.07.01- Motion for Emergency Hearing

The Special Master, often a judge, is someone who would maintain the integrity of the evidence chain of custody and control, while not subjecting the defense members to direct observation by LE. Not in and of itself an unreasonable request for certain types of evidence. Especially if it is just for 2 days.

BUT

I predict HHJP is going to go b@tsh@t on the defense over this sudden "emergency" motion, with insufficient time for the SA to even properly generate a response. What exactly is the reason this needs an emergency determination? Why was it not included with other more normal motions and proceedings?

If I understand this right, from watching the local news, the defense "Is flying in experts from all over the world in a few days to look at this evidence."

Ummm, so they just realized that LE would be watching? WTH????

That one I know the answer to. Nope! Judge Perry said he is scrutinizing every penny, every need, every concern, by the laws that govern. Don't think Judge Perry is too fond of the call everyone up in Hollywood business approach. It is just a capital murder case, not a banquet for all.

Sorry nums24, those are myths. Dr. Lee found 1 hair, LE found the rest after he left. Post #27 in Mythbusters. And he did come back after lunch Post #38 in Mythbusters. JB keeps saying Dr. Lee found 17 hairs and obviously Dr. Lee does not feel the need to correct him.

The defense would like a special master appointed before the depositions later in the month. They do not want the prosecution to be allowed to be at these depositions with their "expert" witnesses.

Any clue who filed this motion for hearing....Baez...or Mason?

So, I just noticed this. JB is flying in these paid experts, then he will depose them on July 16-17,10. Wasn't JB and crew given complete disks, including Caylees autopsy photos, of the evidence and cried foul to HHJS stating his experts weren't computer literate. These experts were also given all the forensic evidence tests results as well.

Oh I can't wait to listen to Jeff A give him the whatnot, then HHJP.

Dear Judge, I mean, your Honor:

Please just give us everything, bend all of the rules, and let us do all the digging and fishing we want. It's only fair we get to do this since we have no other way to defend our client. And our experts are so special, they need to look all evidence with no one else present but us so we can all get our stories straight, er defend our client's needs to the fullest.

P.S. Please don't be mad that Andrea left. We didn't like her anyway, and the ruffle shirts had to go, I mean, we are sorry to part ways, but it better serves our client's interests that she is no longer a part of this case in an official capacity, just as a consultant.

P.P.S. Jeff Ashton and Linda Drane-Burdick are big meanies, er, they aren't being fair at all to our client's interests so just pass this motion even though they tell you nothing but mistruths, we mean please pass this motion and disregard the argument of the SA.

P.P.P.S. Sorry for the confusion, we don't have our slaves, I mean Depaul law students, to write, no help us, with our motions anymore.

Wonder how Judge Perry is going to take to these forgotten but not misplaced "Emergency" hearings? Couldn't this just be handled through the filing of the Motion, and Judge Perry decides and Orders? Or is it common in Florida for "Emergency" hearings in a murder case? I thought they were just for domestic cases??

Emergency hearings which can also be called "Ex parte" are heard in all types of cases including civil cases.

Well you gotta think about the strategy of this filing and it's timing. Tomorrow is the day before, for what will be for most, a 3 day weekend.

I have a case that we changed the briefing schedule just so we WOULDN'T have to file tomorrow. Monday is a state court and federal court holiday. IE they'll be closed.

If I recall CM has been talking about special masters for a long time in dealing with evidence in this case. I'm not sure why he felt it needed to be done Ex parte before the hearing on the 15th though.

I can just see Bruce Jenner or Anita Bryant bringing the Florida sunshine oranges. OMG Cherry Baby that is too funny.

The judge is going to make short order of this big ole bag of b s. Do you remember in the indingency hearing hearing Cheney asked for a special master? Judge Perry did not even feel the need to dignify it with a response. He flat out ignored the suggestion.

This is what the defense pulled last time with the witness, the lady who had never ever testified before, having flown in all the way from Neverland and the defense just hoped for and did indeed get the opportunity to put her on the stand without having given proper notice to the state. Mr. Ashton, did not need time to prepare, he said, no ...thank you judge, I can do it now, and so he did. He mopped the floor with her testimony, and it backfired on the defense.

So here they go again thinking if all of these famous folks are in the courtroom or said to be en route to Florida the judge will feel pressured to agree to this. You give them an inch they take a mile!

That wouldn't be prudent, they are messing with the wrong judge. News flash to the defense....you have a year still to spend with this judge,it matters if he respects you or not. Hello!!!! Come in Tokyo. Hello!!!
