This is some info on how an Oregon GJ works re a felony although this is a dif county & I don't know if they have dif criteria in Multnomah County.

GRAND JURY (if the charge is a felony)

A grand jury is a panel of seven people. The grand jury listens to the witnesses presented by the district attorney's office and based on that evidence, may indict the defendant if five of the jurors concur. The defendant or the defendant's attorney are not present during the grand jury process. If the grand jury panel determines, based upon the witnesses' testimony, a felony crime has been committed, the defendant is indicted.

BeanE would they really convene a Grand Jury that way? She would still be able to go in front of a Grand Jury and plead her 5th amendment rights wouldn't she?

That's my question too. I've never heard of a Grand Jury convening that has nothing to do with an indictment. Azlawyer, or any other lawyer types, can you help out here? Would they convene a Grand Jury just to get information out of someone? Seems like a large waste of time to do that, IMO.

Dateline was scheduled for this date for a while, IIRC. It just works out better for them now...

And...I wanna know who else was in & out of that courtroom! The press must know!

OR doesn't need sunshine laws, cuz it seems the state is just filled with reliable unnamed sources :wink:

How come Dede is the only one testifying to the GJ?

I don't think she is the only one. Just the only one the media has been on to. jmoo

Kaine Horman asks court to have estranged wife pay half of his attorney fees

Kaine Horman has filed a motion in court this morning, asking a judge to order his estranged wife, Terri Moulton Horman, to disclose the source of the reportedly $350,000 she has paid to retain criminal defense attorney Stephen Houze

Spicher appeared very briefly, but is expected to return before the grand jury for a more extensive session at a later date, Stavley said. Stavley could not accompany his client as the proceedings are closed and secret.

"It's just an investigative grand jury,'' Stavely said. "Today was a preliminary, very short session. I anticipate she'll be back in front of the jury sometime in the future.''

Spicher wasn't called in until sometime after 11:20 a.m., and was done before noon, her lawyer said.

Stavely also disputed allegations that Kaine Horman and Desiree Young made last Thursday, contending that Spicher was impeding the investigation by not cooperating and advising others not to talk to law enforcement.

WTH???? What kind of legal grounds are there for Kaine to demand this information, and what do you guys think that he suspects here? That is just crazy, there is more going on in this case than we can even consider, I think.

I would think this would be cause for a mistrial down the road.. I don't know, hopefully Azlawyer would!

My personal opinion is that it's a GJ convened to get an indictment in a murder case where the body has not been discovered. I don't have a lot of GJ experience, but I do believe it's common to seek an indictment under those circumstances b/c it is much harder to prove murder w/o a body. Maybe RoughlyC can check in on this one.

You are right grandma... you aren't reading it anywhere. I think they have plenty of other testimony and evidence that could be presented on paper/via documents as well.

Ah, AZlawyer answered the type of question I asked here (only it was Calliope who asked in the attorney thread). Grand Juries meet for indictment purposes. So apparently a Grand Jury is not convened just to get information.

What grounds does he have to inquire into where the money come from?

Well, lets just say that Terri has decided that she can tell Kyron's life story up to this point on some major network news show...

Wouldn't he have the right to know, and to stop anything in the making where is son is concerned?

For what it's worth, I'm glad DeDe's dad seems very close and protective of her daughter. And, is apparently a very honest man. This person can be our saving grace in this case.

This is awesome news. DS at the GJ. If the GJ agrees, We should have the indictment/arrest announcement when they adjourn. I'll be they are scheduled to meet on testimony & deliberations today & tomorrow - given the scheduled presser. How in the world did they keep that under wraps so long? DS's cousin's info was very good. wowza.

From what I understand (I read it somewhere on this thread), GJ in Portland/Multnomah are continuous. They meet on an on-going basis, and take whatever case or individuals the DA brings. Because of that, I'm thinking this isn't a GJ specific to TH/Kyron, but is somewhat routine in a manner that speaks to DDS being lawyered up and not speaking unless compelled to.

Further, I think that DDS claimed 5th amendment rights, as she was in at 11:20 and out before noon. That's a very short time to do much more than say "I stand on my right against self-incrimination", unless they had only a few questions to ask her, which also may be the case.

In the LDT it's likely IMO she told the truth but the answers are all yes and no. This doesn't make a very efficient process for finding out some things. They already had probable cause, so they call DDS to the GJ to get more specific details. They have to already believe this will pay off because of her performance on the LDT.

I can't find anything saying anyone else testified. The reporters are camped out and nobody else mentioned.

Has anybody else found anything saying anyone else testified? I'm not seeing it.
