I may actually have to eat my words if there is a lot going on in the case tonight. I'm on EDT, so many folks here are just getting started with their nighttime posts when I'm headed off to dreamland. I'll definitely need some caffeine for an all-nighter :D

No one can be forced to incriminate themselves.

However, if the prosecutor feels that getting a specific person's testimony is important enough, they can be given immunity in exchange for their grand jury testimony. This means that anything they say in front of the grand jury cannot be used to incriminate them in legal proceedings.

If given immunity, then there is no legal way for a witness to refuse to testify.

Just now seeing all of these latest news bits about DS & the GJ...wow!

After watching the video clip of DS exiting the court house, she sure seems to have an air of smugness about her...or am I the only one who's reading her body language that way?

I was doubtful about the cousin, but book marked the site where he was talking about what was going on................18 pages worth when I last looked and that was a couple days ago.

Screen capture of DD leaving the courthouse today. Her attorney, Chad Stavley, spoke briefly with the reporter. The man behind the reporter's head was with DD when she left the courthouse and is with her. Who is that? Her father perhaps?

The hair and stature kind of looks like him, or from what I saw when he was behind the wheel of her Ford Explorer last week.

Here is a link to the Oregon grand jury statutes. It tells about who can be in the room during the proceedings, what kind of evidence can be presented, how the jury reaches its decision, etc.

This answers most of the questions about what rules are specific to Oregon.

(1) Except as provided in subsections (2) and (3) of this section, no person other than the district attorney or a witness actually under examination shall be present during the sittings of the grand jury.

(2) Upon a motion filed by the district attorney in the circuit court, the circuit judge may appoint a reporter who shall attend the sittings of the grand jury to take and report the testimony in any matters pending before the grand jury, and may appoint a parent, guardian or other appropriate person 18 years of age or older to accompany any child 12 years of age or younger, or any person with mental retardation, during an appearance before the grand jury. The circuit judge, upon the district attorney’s showing to the court that it is necessary for the proper examination of a witness appearing before the grand jury, may appoint a guard, medical or other special attendant or nurse, who shall be present in the grand jury room and shall attend such sittings.

(3) The district attorney may designate an interpreter who is certified under ORS 45.291 to interpret the testimony of witnesses appearing before the grand jury. The district attorney may designate a qualified interpreter, as defined in ORS 45.288, if the circuit court determines that a certified interpreter is not available and that the person designated by the district attorney is a qualified interpreter as defined in ORS 45.288. An interpreter designated under this subsection may be present in the grand jury room and attend the sittings of the grand jury.

I'm assuming that these people would be under the same rules not to disclose as everyone else present.

Oh... thanks. I'm fine. Seriously. Years of therapy & cutting my family (who completely support my brother & have since day 1 since it didn't "look good" to admit the truth) out of my life have made a big difference. :)

I wasn't sharing my experience for sympathy ~ I wanted only to share my experience with the grand jury process since someone had asked what anyone knows about it.

Thanks for the well-wishes, though. That was super-sweet of you!

I wonder what Kaine, Desiree & Tony are thinking of today's development. I wonder if we'll hear from them. And, like so many others, I will be glued to this site to see if Terri does get arrested. I would like to see LE present concrete evidence that Terri did something to Kyron. Circumstantial stuff never sits well with me.

If she did have such knowledge and shared with LE, DA, or GJ I would think we would be seeing immediate "swarming" of LE on the location that she gave

searches doubled back to search at the school area just this w/e, IIRC...

I wonder if it's meant for TH - a way of saying you're going down, and I'm not? Or maybe it's meant for everyone, that TH is going down, but Dede isn't? I can't help but think she's not worrying because she's not going to face consequences for whatever her role was in what happened to Kyron.

ETA: I really hope it's not that she and TH are going to get away with this somehow, even though she testified in front of a Grand Jury, like she's telling TH, don't worry, I didn't say anything you have to worry about. That is scary to me.

Oh I wanted to say that Soooooooooo bad. Nope, you're not alone. I wonder if she feels above it all so to speak because her Dad's a law enforcement officer (which I have only read on these boards).

I would totally betray a friend if a child life was at stake, just saying.
Betrayal may not be the operative word here. IF this lady was involved, she is showing she has a conscious.

Boy, don't they? That's what we were saying last week. I can't get over the resemblances.

Interesting that, although they are both fitness enthusiasts, both appears to have put on weight in recent years. I thought about TH having that happen perhaps because of baby weight and also if she had become depressed after the birth. But I wonder what might have prompted the change with DDS.

My brother was arrested BEFORE I testified in front of a grand jury, so I'm not sure that the GJ is needed in order to arrest someone.

In my personal experience, my brother had been sexually abusing me for years and I told a teacher about it when I was 14 years old. My brother, who is 5 years older than me, was arrested at the college he attended. I was interviewed multiple times by police with child protective services there, as well. I had a deposition taken. Then I got subpoenaed for the GJ. I testified and my brother was convicted of a class A felony & sentenced.

This was in Washington County (Beaverton... GJ was in Hillsboro) ~ adjoining county to Multnomah.

So, in my experience at least, the arrest came before the grand jury testimony and it never led to a trial but it did lead to a conviction. So... color me :waitasec: as to why some grand jury testimony leads to an arrest/trial and some leads directly to a conviction. I don't understand it at all!

I would think thats possibly because some would either plead guilty, plea down to a lesser charge and then some would insist on taking it to trial... Its seems as tho possibly in your brothers case he plead guilty, or accepted plea deal on a lesser charge. I would hope for your sake he would have done something of this nature. I am grateful for you to have been spared a great deal more hardship, pain, etc by not having to go to trial. I know, too by personal experience and not being spared the trial I know I experienced a great deal more trauma by going thru the trial.. I am very sorry for your pain that I know you endured and am proud for you that you stood for yourself and made him responsible for his actions, no matter how personally it might have made it even more difficult for you in a way.. I do not know your personal pain but can say that personally I too have endured very similar. Thank you for sharing..

Ah, AZlawyer answered the type of question I asked here (only it was Calliope who asked in the attorney thread). Grand Juries meet for indictment purposes. So apparently a Grand Jury is not convened just to get information.

I 100% agree. :yes: Individuals who receive a subpoena to appear before a Grand Jury are NOT there to simply have "a little Q & A" with prosecutors.
GJ subpoenas are not just handed out to any Joe Schmo who "may" have information!!! Rest assured, the LE detectives had to "bring the goods" to prosecutors in order to have them initiate a subpoena for DeDe to appear before the GJ.
*This is not about some kind of kind of game or ploy by the prosecutors. :furious: They are dead serious about this case!*

JMO....
