I'm thinking he keeps asserting that he is being denied access so that later he can claim that there was no pursuit of the "real killer" and there was a "conspiracy" to convict KC, as evidenced by him being denied access to "vital" records.

Just because he claims it, doesn't make it factual. That only works when your rewriting history or trying to make folks 'believe' a story, without evidence.

That would work in the court of public opinion.. if they believe him. But not in the legal system, where he would have to prove he was denied access.

To put it simply---Mr. NeJame has got a couple hundred thousand miles on his "lawyer odometer" (as my DH puts it) and those MILES of experience are solid and rooted in good case law. He has an excellent track record (and this is coming from me---the wife of a state prosecutor! lol).
When it comes to Baez, he is an absolute "greenhorn" and has a reputation of NOT listening to the advice of veteran lawyers and those who could mentor him through his first 5-8 years of practice. It's not a well-publicized thing, but many a fine lawyer has been mentored by another and owes their success in part to this!!! Who better to learn from than someone who has "been there, done that, and learned from their mistakes"??? Of course, this is assuming you are mentored by an ethical man or woman and not by a sleezebag. Typically, a "new" lawyer will work at a firm or as part of a state agency/office for many years before even thinking about hanging out their own shingle and founding a firm under their own name only. It just reminds me of the hubris of Baez. He was simply not ready for this......any of it!!

You're right about the human part.....we all have our limits.
It's just when you place a person up to a higher standard it can be shocking to see them act in a way that you never expected.
After reading all of the messages on this thread I am slowly getting over the shell shock. :HBwhiteflag:

I had a different view after I saw the short clip on WESH, of NeJame saying what he did in the scheduling conference. He was not unprofessional in his demeanor, he was not enraged, he was not striking out in an emotional rage ... he was simply stating FACTS for the record.

I was disappointed that JB picked the fight to start with ... and further disappointed that the Special Magistrate did not reprimand JB for his nasty, inflammatory comment.

I noticed that Mark Nejame made his statement very firmly, but without a lot of anger and didn't even raise his voice.

I think Mark Nejame stated what needed to be stated and I applaud him for doing so!

The report mentions the animosity between the parties - Jose Baez who's representing Casey Anthony, and Mark Nejame who's representing Tim Miller and TES.

There's no doubt in my mind who created the animosity. How many times has Jose Baez made a motion to the court that he's been denied access to TES records only to be told that the records are awaiting him........all he has to do is get his rear end down to Nejame's office and look at them. Jose Baez is creating a problem where none exists.

I have to wonder if Jose's real goal is unfettered access to the TES records so he can tamper with them? IIRC, just recently Jose did spend some time with the records, but complained about having a guard in the room.

I think Mark Nejame recognizes that he's dealing with an unscrupulous attorney and is being wise to make sure there's no way Jose could tamper with them.

Tim Miller and TES have a good attorney!

I SO agree with this statement! I don't think Baez is beyond criminal activity if he can't find a fall guy in those records. Even someone as respected (I guess) as Henry Lee obstructed justice. It boggles my mind.

I also think he likes to needle M NeJame like the spoiled brat Baez is. But even more so, Baez is completely envious of NeJame's actual competency and skills and feverishly plots to take him down a peg or ten. He can't bear that there are attorneys on this planet that get respect and success that Baez can only dream about. He thinks that NeJame is a pushover and has nothing but contempt for him. Sadly, Baez is dumb as a box of rocks so he's not even a really good saboteur. I mean, if you're going to be a psychopathic lawyer aiming for the stars, at least know your law and know how to use it. He and the perp are well-matched in that respect. Dumb and dumber. IMO.

He's human - angora. There were one too many accusatory statements on JB's part that MN was tired of taking the hits on and turning the other cheek for. Trying to handle things diplomatically and with integrity hasn't proven to be constructive if all the public is hearing is one sided. IMO, for MN, "enough was enough" and it showed.

I agree. And if you are a passionate advocate, that passion is going to show at some point. Better that than a 'principled' reptile.

I am pleased to see that there are people out there whose hearts motivate them to be good and do good, especially for society as a whole. And who speak up when it's needed. Yay, NeJame! :)

You will not see this episode on the Hearing video.
That is what irritates me about WESH' biased "reporting" on the Scheduling Conference which followed the Status Hearing. WESH was the only media filming the Scheduling Conf, which took place in the Special Magistrate's office, and they edited an extremely small portion of the actual conference, to air only what NeJame said about JB being a liar. WESH did NOT air the part where JB first said that NeJame was only in this for the TV exposure (which prompted NeJame's comments). The WESH reporter did a voice over/narration about what JB said first. WESH crafted their video "report" to only show NeJame saying bad things about JB.

Why would JB even bring up that inflammatory comment AGAIN, in a Scheduling Conference?
JB KNEW that his pet media outlet - WESH - would be filming. He did it on purpose to get a rise out of NeJame, for the CAMERAS.

I think JB wants desperately to get NeJame off the TES counsel case! And is goading him to get him angry and to say or do something in an emotional rage that would compromise his position as counsel for TES.


Perhaps it is time to turn the spotlight around and direct it at the local networks themselves. It is very interesting to see who is in cahoots with who, who feeds who, and in particular, which anchor enjoys dinners out with Jim L?!

I wish MN's comment had been caught on video. I can so picture MN saying, "I believe your partner is not only a liar but incompetent. I'm going to say this in light of what he said to me -- he made up complete and total fabrications," with an air of authority and superiority ~ not down and dirty, red faced and yelling. I can totally see him stating it as a fact. . . and it is. JB is a liar.

It is a real shame that we only have the printed words to interpert because the reduction of statements like this into black and white can be easily misrepresented or misinterperted. (Hasn't that even happened to some of us here on this forum?)

This is what I was thinking too. And now that CM has been told in person that his partner is fabricating things and filing them as the truth, shame on him for not doing something about it. Can't say he wasn't warned.

This is the key point. It is one thing to zealously and passionately pursue a strong [legal ethical] Defense for your client, however, JB is clearly willing to cross the line for ICA. He will employ any/every trick in the book ... and then some!

There are many folks who consider an action isn't illegal or unlawful or un-ethical unless you get caught.

yes, and wesh's website article also quoted NeJame but not Baez and correctly spelled Equusearch twice and misspelled, Equeesearch, once in the same article.

I usually don't like to see lawyers stoop to name calling because it makes them look as bad as Baez but in this case, I say you go Nejame!

Baez has been talking smack about everyone, including the SA's office, trying to make them look like they're railroading his client. His grand standing and accusatory remarks in court (for the cameras) are tiresome and an obvious attempt to sway the jury pool. It's about time someone called him out on his accusations and lobbed a few his way. Perhaps from now on Baez will be a little more careful whose reputation he tries to ruin.

Nejame means business and will fight fire with fire. Baez is a bully and knows he's outgunned by Nejame so I think he'll refrain from attacking Nejame in the future. Who knows, he could be stupid enough to provoke Nejame into saying something worse, like bringing up the sale of Caylee's pictures that lined his pocket.

You cannot engage with folks like JB that was why it was best for MN to address CM, assuming CM is more mature and cares. If CM is any good he has to see JB as a liability and determine if he wants to ride along on this case just to get the exposure -- even though with JB it is of a circus kind.

I think HHJP is also trying to appeal to CM's better judgement to make this case/trial more professional and less of a circus.

Like that day after the hearing before last. It was clear to everyone in America and beyond that he has MUCH work to get to doing.
What did he do? He sat next to Beth Karas while she did her broadcast.
He could have used that time to be actually working.
