JB: Judge I'm not going to respond, uh I will respond in this sense that.. Our original plan for the inspection of evidence included all of our experts to meet together so that one could consult with one another and make use of the important time and the travel required for the evidence inspection to take place.

We attempted in good faith to be able to complete all of the examination. With all due respect to Mr. Ashton he is not an entomologist or a forensic scientist. They have uh attempted to do it expeditiously and in a united front where all experts could meet and consult with one another. Unfortunately some things did not work out.

We immediately brought that to the courts attention when we returned at the following status hearing. As to time uh uh I don't think uh Mr. Ashton or the State of Florida is prejudiced in any way basically they uh uh we keep running into an issue of where we're being handed discovery as previously mentioned 70 additional witnesses and 8000 additional...


HHJP: "All I'm interested in Mr. Baez is the expert witnesses that is the subject not the new ones. We'll get to those as we come."

JB: Well, that would be that would be my response Judge we made it a good faith attempt by bringing them ah uh We didn't bring Dr. Huntington to Orlando so he could go to Disney World. We brought him down here to do a job. He attempted his best effort to do what he did and unfortunately things didn't work out based on the amount of evidence and the uh lack uh of proper equipment. He did bring uh two separate microscopes uh with him. Traveled down and made the best efforts but uh after a short period of time he advised me "this is not going to be able to be done properly what should I do". And I said well I, uh in fact I think we brought it immediately to the states attention while they were there and we came to the agreement no problem we'll send it to them we have an agreement uh uh I I just don't understand what the issue would be um Mr. Ashton hasn't stated how he's prejudiced in a way just that it delays his preparation. Unfortunately it's not a scripted event, we didn't try to do..uh we didn't try to uh do anything intentionally to stall it wasn't a we weren't able to do it when we had in the manner which we tried.

I couldn't help but chuckle when JB said the word stall and raised his voice like KC did when she said "sorry" to Amy H. in the check case.

Just so I don't have to listen to Baez rambling on and on - can anyone please remind me what two documents Baez did not want ICA to sign? HHJP's comments were Death is different, and because your defendent is here, you can have that accomplished by the close of tomorrow?

Anyone? To me it seemed Baez was fudging around either because he didn't want to have to explain them to ICA, or he thought she would refuse to sign them. Either way, something odd was going on there.

I don't think it had anything to do with having to esplain it to Ms. ICA I think it had more to do with him not wanting the record to be so darn squeaky clean. JA wants the defense boxed in and everything of importance (i.e. possible appellate issues) to be clear and on the record. I don't think that JB wants every t and i to be crossed. It doesn't bode well for filing appeals.

For the record, IMHO, JB should not be allowed to wear any shade of purple or lavender! The one defending Caylee's murderer should not wear Caylee's favorite color!

Oh now I'm REALLY mad! Purple is my favorite color too! What in heck was he doing wearing purple? Does he think he's royalty or something?

Oh wait, look who I'm talking about! I just answered my own question, lol.

The funny part for me was when the judge was letting the defense know they could work nights and weekends to finish the depositions, and Cheney
said (unclear if he was unaware of the hot mic), "I am in trials and you are in trials," Hello......come in Tokyo, this is why we all laughed out loud when Cheney took on another high profile case AFTER signing on to this one.

You just can't make this stuff up!!!!

TWA, I was saying that last line throughout the entire hearing!

JA: Sending shorts overseas, we can't subpoena witnesses. I have concerns about Eikelenbooms, not sure they are accredited to do this kind of analysis. They are "world-renowned" but I only found that on their website. (Hee hee hee)
...and they have CBS in their back pocket!!!!!!! Ya think these guys are going to uproot themselves... leave their business back in Europe...and work for nothing in Denver?

Oh my Gawd. Please tell me Baez is not of those "if it's on the internet, it must be true" people. Oh Jeebus!
I kinda liken them to rogue investigators (I do realize they are scientists)...they've found a niche...national tv.

IMO...their work is fascinating...at least the work I've seen on CBS.

PS- does Dateline use them too?

Okay JSR, thanks for the explanation. Baez was looking pretty fudgey and hemming and hawing and she won't I meant I can't blah blah, it sounded to me like he didn't want to have to explain it to ICA in case she threw a fit.

I wonder why JB would want to have everyone wait till a lab can be set up and go thru getting all the neccessary credentials, etc....when there already IS a lab in the US that did the Touch DNA analysis for the Jon Benet Ramsey case??

So after reading the entire thread...

I think JB's bumbling behavior is all an act. Not that I think he's boy genius...but he wants to delay, and if playing it like Columbo gets him that...then bumbling it is.

He does manage to pull off those press conferences without falling all over himself, now doesn't he?

If JB could be given one magical power during each hearing which one do you he would choose?

a. The ability to recall greater that .035 % of the Rules of Criminal Procedure.

b. The ability to freeze time in order to locate by color, the answer to a question without the painfully loud ticking of the clock.

c. The ability to complete a sentence without using the terms: "actually", "well", or the phrase "I don't see why that won't be possible".

d. The ability to instantly create a large cloud of smoke and drop through a trap door in the floor.


I haven't laughed this hard in forever. :dance:

It was bugging me too what these stipulations were about so I went back and listened to Baez ramble. What the stipulations' details are and why he didn't want ICA to see them was not covered.

Here's the short version:
The 2 stipulations pertain to the defense receiving the evidence they want their experts to examine regarding the entomology and the hair. Sounded like Ashton would send the evidence to the defense once they signed the stipulations.

Here's the long version, transcription of the hearing:
19:27 mark:
Judge Perry:
Now, Mr. Baez, have you had all of your experts review all of the evidence that you need to have reviewed? As you know the deadline for them to review is the 31st of October. You got anybody that you still need to have to review evidence?

Baez:
We just have the air evidence and the entomology which is I believe being worked out. This stipulation I will be signing.

skip to 25:40 mark:
Judge Perry:
Mr. Baez, based upon what you've told me all of your experts should be able to have their review of all the evidence complete by Oct. 31st.

Baez:
Yes, sir. I don't anticipate that being a problem provided that they receive them within the next week or so. We've requested it of Mr. Ashton. He's asking that I sign a stipulation. I can sign it right now but I think he wants my client's signature which honestly I don't necessarily think that that would be necessary.

Judge Perry:
Well, death is different, so your client needs to sign it so that should be accomplished no later then tomorrow afternoon.

Baez:
Yes

Judge Perry:
Since your client IS local.

Baez:
Yes I can have , if Mr. Ashton can get me the other one for the hair, I can take them to her today or tomorrow.

Ashton:
Yes and we discussed this a moment ago. If council can give me a list of every item of hair evidence he wants sent, cause what I'm doing is attaching the list to the stipulation so there's no confusion of record on what's sent.

IMO Today was very telling regarding JB's strategy. It is becoming clearer that even beyond mitigation, the defense is planning for KC's appeal.

It wouldn't shock me in the least if that old "defense bus" shifts into auto pilot and rolls right over the previous driver. "Self inflicted injuries" IYKWIM??????????
