I just thought of something...

Does anyone recall the details of what Mason stated during the press conference in Baez front lobby (to introduce new attys) when he said that a secret hearing had taken place already and JJP had extended some dates? Was it in reference to depos?

If so, what was the point of today's extension request....or was Mason pulling our leg?

I don't remember verbatim but I recall CM slipping in the tidbit alluding that he had reason to feel confident Judge Perry would loosen up on the deadlines. It caught my attention. He either had reason or is arrogant enough to believe that their definition of 'good cause' would be interpreted the same by Judge Perry. Its a toss up.

After seeing HHJP's reaction today, I feel sure that he had no clue the number would be 12 (which is actually 15, I believe:angel:). And....to endure Baez's disorganized rambling.... silly requests to transport vital evidence overseas to a lab...the awkward silence as JB shuffles papers while trying to concoct a new excuse...it is painful. I think Judge Perry sees Baez's ill-prepared disorganized everything as a lack of respect for the Court. And he would be correct.

It's a mess.

Perhaps the deadline of November 19th was already agreed upon and JB was trying to slide in a few more. Typically HHJP does not rule on much during the hearing so perhaps this was simply argued for the record???

Watching that hearing - I finally truly learned the meaning of the word "aghast" - that would be me with my mouth open in shock and complete WTF???

Perhaps. It could also have been off-the-record informal chat and no date was specified. Or it could be CM's arrogance.

I may go watch the entire hearing again. When I watch live I am focused on the info and dialog exchanges. I want to go back and hone in on the reactions of HHJP and the attorneys. I saw a lot of body language going on.

eta: in re. Nov. 19th - ya know, he wasn't near as generous as I am pretty sure JB & CM were hoping he would be. 19 days...that isn't much of an extension considering all the defense has to accomplish. They better get busy fast.

I just went back and reread the old thread from the Sept 14 Press Conference, and what Cheney Mason told the media during that presser is "What you don't know is that the judge extended the deposition date to October 31 in a "secret hearing".

So this might be why JP kept driving home the point of October 31st today and referring to it as "drop dead day".

Now, was the November 19th extension given only for specific expert depositions or all depos in general?
So this would be TWICE that JP has extended due dates.....:banghead:

I wonder why JB would want to have everyone wait till a lab can be set up and go thru getting all the neccessary credentials, etc....when there already IS a lab in the US that did the Touch DNA analysis for the Jon Benet Ramsey case??

Because the Dutch are pro bono?

JB wants defendant present during deps of jail employees, HHJP not impressed.

Perhaps HHJP will have Cisco wire up the jail, a real time demo for JB and team (cough) and choose option D.

I believe it was for a certain category of witness and date added to witness list by the state. It should be interesting to see what happens after the TES docs are reviewed next week. I see that as a tool to buy the defense time.

What if they are truly going for ineffective counsel? It really is the only thing that would make sense of the ramblings and mishaps we keep seeing, not to mention no prior effort to depose witnesses or test evidence until now( with feet held to the fire)
Snipped:
D. Common Ineffective Counsel Claims
Below are some of the most common ineffective counsel claims that have been pleaded
successfully. This does not mean that these claims are always successful or that this list
includes every possible ineffective counsel claim, so when you plead these claims, be sure to
check the case law in your state.
(1) Counsel is not qualified to practice law;48
(2) Counsel had a conflict of interest;49
(3) Counsel failed to investigate50 or perform certain pretrial functions;51
(4) Counsel failed to properly select a jury;52
(5) Counsel failed to pursue defenses available to defendant;53
(6) Counsel did not properly advise defendant as to a plea;54

Just got done watching the hearing. Danke for the links!

I couldn't believe Mason's arrogance towards Amy H. My God, the girl is trying to earn a living and have a life after his client stole hundreds of $$$ from her and abused their friendship! I mean, doesn't he think Amy has been put out by KC's bullcrap quite long enough? I know I do. Go to Miami, Mr Mason. I was so glad to see LDB point out that Amy had been available for more than a year.

I know what you're saying and you are correct. However, you work with a HUGE firm that handles big cases. Baez can't even hold on to even one partner, doesn't have one competent paralegal and has NEVER handled a case 1/100th the size of the cases your firm has handled.

For instance, when they did the depos of the 35 LE in one day ( ) I seriously doubt they reviewed 23,000 docs in TOTAL, much less 23K for EACH one of them. Honestly, after listening to CM and JB, in all seriousness, I doubt they have reviewed 23,000 docs during the past 2 years. And, yes, they are most certainly lazy. There are 5! attys. on the defense team now. There is ZERO reason they can't divide up these tasks and stay on schedule.

ITA...I'm also thinking that they should know this info inside and out---esecially jb since he has been at it since day 31.....It was interesting that the SA could stand up and answer without looking thru mass paperwork---None of this is new info that they haven't had for the depo....I just don't get it....guess cm isn't having the "fun" for a Saturday....:loser:

The 19th is for expert witnesses ONLY. If anyone is brave enough to watch the whole thing again, keep a running tally of how many times HHJP says "Bottom line" and "October 31"!

(Actually if anyone can figure out what the whispering is at 1:26 I would love to know; I couldn't figure it out yesterday and am at work today. LDB and JA had some kind of interchange while JB was burbling and flurping about... TIA!)

Since the hearing is now over and the recent posts are going a bit OT towards ineffective counsel, I have started a new thread for that discussion and copied these last few posts (with links) into that thread for discussion.

Please continue discussion in that thread as this thread will now be closing...

Part 1 9:45 mark...
Baez is telling Judge Perry that they are fully booked (in regards to depos) for the next couple of months, that they are not sitting around doing nothing...

Ashton...The evidence has been available for 1.5 years, the Defense has chosen for whatever reason to delay looking at any of this evidence after repeated attempts of when they want to do this up until July of this year..I think in the last 2 years the defense has not been diligent in getting this evidence examined
