The only thing that makes me think that this is not the case, and it probably is not JB leaving, is in order for JB to depart, KC has to sign off on it. Under the new law she has to agree to it. Not simply know it is happening. I am thinking we would have caught a whiff of it if there was suddenly a lot more activity from the defense team around the OC Jail. I would like to think that they wouldn't do that to her with a phone call.

Thank you for your input, faefrost. I respect your opinions, and you clearly know the legal rules here better than I do. Just wondering if a loophole might've been found???? Dear God, PLEASE? lol

Didn't we hear Ann Finnel say at one point (when $$ was being discussed) that she would have no problem staying in Orlando? Perhaps she has family/friend who will put her up for her time in Orlando?

At first when I saw the news I thought, rut roh, Jose's in trouble ... maybe the Florida Bar caught up with him ? Then I thought .. nah ... he's gotten away with his less than ethical dealings so far and nothings been done to him ...
I still think the only way out of it for any of them is for KC to fire them .. JMO

Could be simply wishful thinking on my part. Just wonder: when is enough, enough? Watching him has become very painful for me. And I can't begin to imagine how painful it is for everyone closely involved in this, from HHJP, to the SA, LE, to the other DT members (well, DCS and AF, anyway,) the witnesses, the court reporter, all of us watching, etc. And all of the needless tax money he is incurring by his delay and deflect tactics. I know I am far from alone in my wishing. Sorry for preaching to the choir. :maddening:

It doesn't have to be the other DP lawyer filing the memo in support but you are certainly right the other DP atty could be filing as you said above.

But more than likely the memo in support is showing "good cause" why the requesting atty has to withdraw. If a DP qualified atty were to leave at this juncture they would certainly need to show good cause and they would need to assure the Court that Casey would still have DP qualified counsel to represent her.

And once/if one of them leave then they're stuck. Completely. Because there is no way in hades that HHJP would let a DP qualified atty leave and have to substitute himself/herself with new counsel that would need to get up to speed.

Depending how who it is that is withdrawing HHJP may not let them leave. I've seen that happen too ...

JSR, does the brief/memo in support necessarily have to be from another member of the team. If one of them is withdrawing for health reasons, for example, could the brief/memo be a physician's statement? TIA. :0)

I wonder if one of the Orlando TV stations will have the information on the 10 o'clock news. Can we watch online? Like at My Fox Orlando?
Maybe they purchased the motions. I hope.

JB is not death penatly qualified..... so it could be him but I doubt it..

I really doubt it would be anyone but Simms? :dunno:

It says the "appointed" attorney. Which one was appointed? Baez was hired. CM came on voluntarily. I don't know where Simms came from so my guess is it would be her, but it's strictly a guess.

Yes if it's a Memo in support than that means it's written by an officer of the Court. Otherwise it would be filed as a declaration or affidavit in support.

When I file things in my cases we file a notice of motion, a memo in support (or opposition), a supporting declaration (most of the time it's either by an expert, client, or another atty or staff member), and then a proposed order granting or denying our request. Some jurisdictions also require a motion for oral argument as well.
