I hope folks don't mind some of the humor thrown around. I know we are here for a play by play of the jury selection.

Humor and snark can be a distraction for some folks.....but I liken it to a safety valve.

Well timed release is key to maintaining safety standards in this high risk work zone.

Carry on my friends and don't forget your saftey gear.....keyboard covers, hard hats, hip waders, and most importantly....take stretching breaks for your circulatory system.
In all honesty SOTS, I, myself need it, to get through this. Thank you Mods for allowing us to voice a little reasonable humor. :)

HHJP: asked if they will consider mercy. they had proposed a jury instruction on mercy. the defense cites a supreme court case 1967...Davis is a 2003 Supreme Court case involving the DP. Davis says the motion to strike the juror because the juror indicated he could never consider mercy. Davis argued he should have been dismissed, and the court said we do not agree that Pool and Thomas applied. What makes this very interesting is a 2009 decision of FL supreme court Orme-during the first stage of the voir dire the defense asked if mercy had any part in the sentencing procedure.

(skip)
HHJP: We agree. Lets see the case I was reading earlier today...

I had to run out when the woman was on and she basically didn't know anything about the case, is she in or out?

I also heard on the tail-end that the potential juror with the mugshot was released; is that true?

Yes, on your first question and the Defense had to use a strike to get the DUI guy out because HHJP denied their motion for cause.

Side bar with all attorneys. Casey is sitting with the new mitigation specialist, who has her hand on her back.

I noticed yesterday she was back in helper bee mode - innocent young mother didn't make it all the way to the trial - anyone surprised? Nahhh.

Wow - she has been VERY hands-on with ICA.

Personally after reading all about her - she makes MY skin crawl.

Don't trust her as far as I can throw her either.

You MUST work out alot.............:floorlaugh::floorlaugh::floorlaugh:

you cannot give a jury instruction on mercy..

both sides are right to an extent

reading all the cases together that is the court's ruling..

cannot be used as a challenge for cause but finnell can ask the question

She's still in and the mug shot guy is out - I think JB had to strike him.

I'm in and out so don't quote me on that's how it went down, but I think it is.

AND cannot being given as instruction to the jury either.

Then what would be the point of asking the question about mercy?

.

Now this is where I draw the line. No one should be able to touch her or rub on her. I remember -- back in the day -- while I was home on maternity leave watching the Menendez brothers trial on court tv and I remember Leslie Abramson getting in trouble or talked to or about because she was always doing the same thing. (((gee, back in the day when they covered the whole trial)))
