On the last juror, Mr. Mason asked her what kind of books she likes to read.

Her answer was "Usually, novels" - which he heard as "mystery novels" and then continued to question her as if that is what she had said.

And this illustrates exactly the problem that hearing impaired folks have. They "mis-hear" a lot and they don't even know they are doing it.

I have a family member who is hearing impaired who does this ALL the time. Sometimes it can be funny, because they have a tendency to "fill in" according to their own background and knowledge. Other times it is not so funny at all because their interpretation of what was said is just flat out incorrect.

I once worked with a physician who was losing his hearing. He had the finest hearing aids money could buy, but eventually he had to give up dealing with the public. He was simply not understanding enough of what patients were telling him, plus he could no longer listen to heart sounds.

Increasing deafness can become a career stopper, depending on the career.
 
Defense will strike her for her veiws of the DP.
 
I hope the trial starts Monday and NOT Friday. That is my daughters 19th birthday. As much as I want to hear opening statements I just could not do it on THAT special day.

My prediction:
DT will strike
SA will object because of gender
HHJP will deny the states objection
Juror will be out, we will still be at 11 starting again tommorrow am, DT will only be left with 1 challenge...

Just a guess....
 
Ugh, more meetings, I've missed the last couple of hours....So where are we at?
 
HHJP explaining mitigating and aggravating circumstances, juror will be required to look at both. State will have to prove aggravating circumstances by the great weight of the evidence. After establishing aggravating circumstances, you will have to look at the mitigating circumstances.

I am betting on Monday, a few more issues will be appearing tomorrow, maybe even Thursday. Tell your dd Happy Birthday, mine is Friday too, but far from 19.
 
It sounds like HHMP is thinking that by 1:00pm tomorrow they will have at least 12 jurors and they can be sworn in at 1:00pm, sequestered, and bussed to Orlando. That would give them one day of rest before the trial starts on Friday. OR, would HHMP send the jury to Orlando, while the court stays in Pinellas to continue selecting alternates?

His Honor thought that for today and it didn't work out. Strikes from the DT, strikes from the Prosecution....and we keep bouncing along.
 
I wondered that too... maybe her eagerness to be on this jury suggests to them she has an agenda?

I have to agree. I think it is because she wanted to be on the jury because it would be "interesting" rather than she feels it's a civic duty.
 
It goes without saying that a competent lawyer is essential for a fair trial.

There are a few other things that impinge upon a fair trial such as media coverage and funding issues. However, these don't seem to be having as much of an effect as the representation issue and certainly the media issue the judge seems to be doing his best to rectify with voir dire.

Agreed. I'm not sure about Judge Perry, but Judge Strickland asked her several times if she was satisfied with her team and she always said yes.
