2011.05.18 Sidebar Thread (Jury Selection DAY NINE)

Talking about all this Southern food, made me think about how much I miss fried-green tomatoes.

I can't see how we won't have a jury by Monday.

There are 15 remaining PJ's, and only 4 strikes total from the 2 sides. That knocks the PJ's down to 11, only 1 needed for the jury to be sworn in, leaves 10 for possible alternates. Let's just say due to "cause" 3 or 4 of those go out, plus the 2 strikes for alternates. That leaves around 5 or 6 alternates. Plenty to go to trial.

IMO this will start Monday morning.

I am still confused about all these strikes. Last night on JVM, this was discussed.

VELEZ-MITCHELL: It`s a separate set of strikes for the alternates?

CASAREZ: Yes. They are getting additional strikes for the alternate; one strike for each alternate.

Snipped from Azlawyer post # 233 Legal thread

RULE 3.350. PEREMPTORY CHALLENGES
...

(d)" Alternate Jurors. If 1 or 2 alternate jurors are called, each party is entitled to 1 peremptory challenge, in addition to those otherwise allowed by law, for each alternate juror so called. The additional peremptory challenge may be used only against the alternate juror and the other peremptory challenges allowed by law shall not be used against the alternate juror".

So I guess if we are looking for 5 alternates that means 10 more strikes. Do we only have 15 PJ's left? If so, this is not looking too good. JMO

To be fair I think there's a difference in pronunciation for pasties and pasties! When I first suggested to hubby we have them for lunch, living in this country all of a month, I pronounced it 'paysties'...his eyes got HUGE! :blushing: I learned quickly to forevermore call them 'paaasties'.

BBM

For your WHAT??? :floorlaugh: :floorlaugh: :floorlaugh:

Today has been very enlightening, on both threads.

Goat ropes, pasties with bug die, hee haws, and who knows what else.

lol, was going to use the correct wording but thought better of it.

Stuff in the bowl is the tasteless mush, better known as grits:

Just take the bacon and eggs on the plate and mix in the groups ... YUM !!!

Good Morning all! I hate to ask this but I just got online after having trouble getting online and I'm reading both threads for today and understand that:

1. We are on a long lunch break

2. Only one pot.juror was interviewed this morning

And that is all I can surmise, except for peeps posts about motions and DT stalling.....can someone please, please do a brief update? I hate people who ask for that, but I can't make heads or tails of what is going on.

Pwease!!!!

the truth is we dont know wtf is going on either....but I will give it a go...

defense sent poor miss fryer up to try to argue that doing the jury this way is unfair, and hizzonner smacked that down, basically saying for one thing they've known he would seat this way ages ago, why not probs til now?

then they get to the last PJ so far, the only one today whom the state peremptorially (is this a proper word?) struck, who was apparantly amazingly dressed, and absent yesterday due to no gas in the car.....

then they went to in camera, then to in sidebar, and just before that HHJP said they wouldnt have court after tomorrow (as in actual facility) and did also say they might start over again in another county!!!!

then they come back and go to a major long lunch break, just before which HHJP said they have the courtroom til saturday.... that they WILL begin opening statements 9am on monday...in orlando.....so long as they have seated a jury.

sorry it's all over the place, now you see why I usually dont recap, my memory does not work linearly :biglaugh:

Here is a laugh for you guys while we wait. I moved into a new house this week and my husband is out town. I got a little scared so I let my huge german shepherd in and let him lay in the floor at the foot of my bed. I wake up the next morning and cannot move, I look over and my dog is stretched out right up as close as he can get to me, I guess he got scared too!

awww, i had to log in just to respond to your post... i have a beagle and bagle (bassett + beagle) and as small as they are they end up taking the whole bed as well (sorry hubby, lol)... German shepherd's are lovely dogs! Last week a young boy decided to rob a check cashing place a few blocks from my house and decided to run from the police thru my backyard. One of the "officers" was a huge german shepherd with a big black vest that read POLICE! When they walked thru my yard, after catching the robber, i made sure to say "god bless you" to the dog! JUST LOVELY!

Thanks, guys, for the updates...looks like I didn't miss much after all. Glad I chose to sleep in instead.

:floorlaugh:I can just picture him doing that. My dog does it too, I think they just like to be close to us....making sure we are okay. My dog also hates when I turn on the light when she is still sleeping, she tries to block out the light with her paw...too cute! I love my big baby.

Tell my kids all the time how lucky they are that I didn't discover my babies (dogs) before I had them...

OMG, that is what my DH thought I was on one day using his laptop. What is Web Sl*ts and why are you on it. ROTFLMAO, that is just too funny!

My DH very rarely watches this or keeps up (alright--mocks me)--anyways he walked by my computer yesterday when the inmate was so animated and happy go lucky...and said "I thought she was crying? What does she have to be happy about"....this is from someone who doesn't follow, changes the channel...I Did question him on the theory that men would be easier on her...he said probably not...He would go after her with vengence...

Motion argued by Fryer that

"waa waa we don't like how you're doing the jury selection, here's some case law on judges abusing their powers - you know kinda like you"

Pot juror questioned

Recess

Side bar

Pot juror tossed out by state (although I thought he was a smoothy)

Judge Perry advising being tossed out of court by end of today/ then told by Judge Perry they were to be given till Saturday

Opening remarks to start Monday at 9 am IF there is a a jury

Long long long lunch

Somewhere in there Baez told us all what a great guy he is because when he took this case he swore, like for realz, pinkie swears and everything, that he would get ICA a fair trial.

We all got our hankies out, it was quite touching, ahem...

That summed it up nicely. :floorlaugh:

Fry up a ham steak in butter in a heavy skillet. When it's nicely browned, take it out, and use hot coffee to deglaze the pan. Make sure to scrape up all the browned bits on the bottom. Pretty darned good!

OK, so far this morning we have seen one potential wit questioned at length. He very much polarized the board in terms of everyone's impressions of him. When voir dire was over and he was sent out of the room, CJBP gave a loooooong speech about the process, how long it was taking, whether they would be finished in time, they are paying for hotel rooms in Orlando since Tuesday... JB said in open court that when the jury was picked it would be "time to get to work" (but we all know he doesn't want jury selection to ever ever end).

Then they took a 30-minute "5 minute break." Then they came back and went into sidebar immediately. Then they went back into open court and the SA used a peremptory to remove the PJ from the morning. CJBP pulled strings and got the courtroom in Pinellas through Saturday. He said we WILL start on Monday in Orlando, IF we have a jury.

And WSers worldwide screamed aloud in despair.

That's about it, I think.

Talking about all this Southern food, made me think about how much I miss fried-green tomatoes.

I'm growing tomatoes, love to eat them fried, I pick them green, use egg batter and cornmeal/flour and fry them up yummy

:floorlaugh: poor lil puppy :D he forgot he was grown!

I got a funny for yall too....I used to lurk from when this case came out til I signed up, and the delay was due to not having an ISP email to sign up with...so I couldnt hold back any longer and asked my FIL if I could use his email to sign up with....and he said yes so.....

the next day, after I spent all night gleefully posting, my FIL comes to me and says...real embarassed like....."was that you using my email for web sl*ts??!"

although I did correct him, we've been personally calling WS "websl*ts" ever since!

LOL, I am calling my hubby today and tell him I am a member of Websl*ts! I will make sure I am holding the phone a long ways away from my ear though so he doesnt bust my eardrum!
