DT wants a list from SA of the order of witness they will be call...HHJP cant order them to do that....CM complains endlessly about DTs lack of resources, says SA has unlimited resources. LDB can be heard in background saying "no we dont".
HHJP says I thought I was told all files are digitized.....CM says talk to Mr. Digit...JB is now going by Mr. Digit.

HHJP: okay folks. count there are four...seat (numbers) from this last group and then from the new group that we looked at there are seven with great possibilties...two had opinions but I did not ask them what that was.

HHJP: it is the seat chart...seat 30 the last one. Only way to find out is to bring them in and ask them. You don't have any J and S es... Judgements and Stipulations. The other method is...

HHJP: okay, ah we should be able to get to these quick, I will do a schedual for those folks, have a short lunch break tomorrow. Okay, anything else prior to being done?

HHJP: whoever wants to go first, go first.

CM: having had some experience with trials we request you to order or strongly suggest when we get to trial the state gives us an expected order of witnesses to be called and we will do the same.

HHJP: I have no authority to tell them what order as long as they are on the witness list...

CM: we will just be asking for the time to look for the files, our help is non existant.

HHJP: i have seen more folks on your side than their side.

CM: we are all pro bono workers, they got FBI, etc...

HHJP: I can understand someone leaving to retrieve a file, as long as the witness is on the witness list.

CM: we have two little rooms where we can't put the files in, not big enough to do it.

HHJP: plenty of room in front of your table for your files. someone told me you digitized the files. Mr. baez now known as mr digit.

JB: among other things. just a block of witnesses, it is a next to impossible task.

HHJP: you are talking to the wrong person, that is beyond my pay grade. If you need more space I will try to locate safe space. you have seen what is inside of the court room I will see if near the sound room maybe put a table there. I am told I have to be there Sunday afternoon to make an inspection so I will see about taking care of that and if there is somewhere close by where you can put them. Put them on a drive.

JB: then we have to print them out.

HHJP: I will work with you.

JB: there may be situations when we need to delay. I discussed with LDB guildlines on how we want to proceed with opening statements what is acceptable and what is not. She said ask you for guide lines.

I have never heard of some of these requests the defense asks for. haha they want to prepare right before the witness shows up. They need to be prepared for all of them now. how much space can 300 files take up? 1 file cabinet?
