Figures. How much time have they had and they only ask FIVE DAYS before the trial is supposed to begin? I hope they don't get a delay!!!! Their laziness is unfreakingbelievable!

What CM is asking for is very very common. It's a professional courtesy that is generally granted when you have cooperative parties.

But I'm not sure that this is a case where cooperation from the DT has been routinely given.

The teams SHOULD be making witness notebooks for EACH and every witness. It's painstaking work.

Cooperation from the DT has been non-exisitant. The DT does not even know the meaning of professional courtesy. I would not give them an inch if I were the SA.

You are right. I've never come close to a trial this huge and with just a few witnesses, we do let each other know. But I think there is bad blood. The defense has seemed to play dirty pool at times.

Nevertheless, the state has apparently given the defense notebooks. And while it would be very hard to shuffle through boxes, even if alphabetized, I have little sympathy for the DT. Especially the crummy argument about resources. It appears the DT has much more than the state, with jury consultants, death penalty consultants, experts, etc. The state, on the other hand, is subject to budget shortfalls.

If the DT tries to stall between witnesses, then they will sink their own client because the jurors will not be impressed

HHJP: the only opposition I would have is ? I'm, so you are asking me to rule on something I have not seen or heard. I have told mr baez in the past I do not write blank checks. If you can agree generally I have no prob. If miss anthony signs off on it then...if you are going to be arguing then do it the old fashioned way...have you agreed?

LDB: haven't shown each other...

HHJP: let me say this, if you can agree fine. If you have some minor disagreements and you want my imput I am willing to do that but there are only two times I will be in the Orange Co Court house, don't know what time. And between 7 and noon I am totally unavailable and on Sunday after noon at 4 to the Court house(Orange). You discuss. If there are matters and you are both interested it is going to be all or nothing for some portions. Both sides have seven minutes apiece to flap their gums. As I say I will be there Sat afternoon and sunday for a while. Talk about it and we can deal with that, I think that takes care of both issues.

How does every other DT manage? Haven't they heard of computerised files?

They can have computerized files for the atty witness notebooks but they SHOULD have hard copies for the witness. The witness binders should have any exhibits they might plan to use for that witness.
