I know everyone is wanting to know why he didn't call 911 when he smelled the human decomposition. He stated that he did not see anything from the windows that alerted him. He said the smell could be smelled from inside the car... not the trunk. If he has seen something that alerted him inside the car, he would have called police.

He did not know that a month later a little girl named Caylee Anthony would be reported missing and that the car that his company towed and that the Anthony's picked up on July 15th, 2008 was key evidence in a case of a murdered child.

He didn't do anything wrong.


but he did something that raises a question. which is, you thought a locked car in your possession smelled of human decomp. and you did nothing?

why did you ignore the smell of death?
 
is decomp similar to wounds? from a previous job I do know wounds, never human decomp though. only curious. the wounds were pretty freaking bad and IMO unmistakable.


Yes. If the wound bleeds alot, don't really need an entire body to produce the smell of decomp
 
IS discussing the character issue - saying JB is constantly bringing up her character when questioning about her being a good mother - so State should be able to bring up her character as well.

So true! If JB can say what a great mother she was before Caylee went missing, state should be able to talk about her character after
 
I wonder if perhaps he didn't notify LE because of some kind of policy?

I am sure there is something in place in regards to not tampering with a vehicle until the registered owner comes to claim it or the proper days have lapsed and proper procedures are followed in which they can begin the process of claiming and registering the abandoned vehicle to the company...
LE was notified with the TAG number in order to obtain the registered owners name so they can send a registered letter
The car was not reported stolen
 
If the defence does a good job,they can take this witness and conform him.

He never directly said that car smelt liike it had a body it it . He said he smelt that before and made a funny face.

It is false you cans mell a body outside a car and he knows that, while he did not exaclty say you could he made it sound as if it was hard. the defence can expand on this and ask him if he had ever smelt a body that had been in a car for a month .

Dont get mad at me, but it can happen if Baez is on his game ,or a least part of some game but if he is scripted before the witness took the stand then he iis screwed he seems to have scripted things based of depos but it isnt working because people dont word things the same every time.

BBM again... Caylee's body was not in the car for a month. From all the testing done, they have determined the levels of gases present indicate she was in the car for 2.6 days.
 
Yep, like I posted in the trial thread, I also believe that when the witness placed his hand on the glass or side of the car, an air seal was slightly broken, thus allowing whatever body stench that was in there to eminate.

yes. exactly.
my hubby has been replacing the seals in his sisters car so I am more aware of "seal issues" now than usual. LOL. He talks about the seals every night at dinner. *Sigh*
 
And then what? They would have opened the trunk of the car and... no body. Evidence that we have now may have been compromised. The car wasn't reported stolen. There was no missing child report. What were the police going to do?

He said the smell was coming from inside the car... he looked inside the car and didn't see anything. He dismissed it. I know the defense is going to bring it up, but Simon seems confident and I am sure he will explain to a jury why he didn't call police.
This isn't about the police and what they would have done, or not - it's about the inaction of Mr Birch who smelled human decomp but didn't alert police.
 
The state is saying the body was there for a period of time, My hubby works in a body shop and they have totaled cars that have had bodies in them. He says the smell never goes away. Sometimes the cars sit 6 months before they total them out they stick a bio hazed sticker on them and no one goes near.

He has 22 years exp in collision repair.

There are factors that make a different

  1. Blood from the Body
  2. Size of the Body
  3. If the body was in a plastic bag
  4. If the body was wrapped in something that would absorb the Fluid
  5. That small of a body would only leak about 2 quarts of liquid matter in 9-10 days time
The tiny body was only in there approx 2-3 days... There would have only been approx 1 quart of liquid matter...

Also to add any type of cover up of the liquid matter that had leaked, (like pouring gas on it)
Would all change the amount of smell

Speaking of the tattoo - Am I alone in thinking it was NOT a tribute to Caylee but rather signified Casey starting a new "beautiful life" without her? She felt like she had a fresh start, remember her diary saying "this is the happiest I've been in a long time". I just don't think it was for Caylee at all.

I agree with you. I've always thought it was to celebrate her future life without Caylee.
 
Was he double bagged and in the trunk, then removed for a period of days? Just sayin..

No he wasnt ,his skin had turned to soup and was liquid and pooling on the floor board. I dont think double bagging would have helped all that much as far as the smell goes.

I dont think people are getting a good idea of what a body in the truck of a car would really be like.

Even after two days, but the closest I have seen is Bolonga in the package tossed into a trunk for two days. It might give you A small example not even remotely as extreme.
 
Here's the problem, IMO, Mr Birch didn't have to tamper with the car. He just had to make a phone call to the police alerting them to the smell of human decomp coming from the car.

He didn't. If I were on the jury, his explanation would have to be pretty darn good and have nothing to do with just following procedure/rules.

But maybe that's just me.


I thought about the above point, but then wondered if the odor had been from a previous crime and the sheriff had already released or sold the car to it's current owner. Based on Birch's testimony and access to the vehicle there was really no way for him to know the car would later come into play with a trial yet to come rather than a trial currently complete.

Which means CAYLEE WAS IN THE TRUNK THE NIGHT CASEY AND TONY WENT TO BLOCKBUSTER!! Wonder how Tony feels knowing he rode in a car with Casey while her dead child was in the trunk????
This stuff would mess me up mentally probably forever.
 
Why is Simon B. on trial? Seriously?
We're simply discussing his testimony. I'm sure at least 1 person on the jury is wondering why Mr Birch didn't alert the police about the smell. I can't be the only one wondering about it.

It's close to the smell of a necrotic bowel wound, but a whole bodies worth.
 
Did anyone else see ICA interacting with the jury this morning?? When HHJP was telling the jury about getting to watch the hockey game. HHJP asked, "does anyone want to watch hockey, tonite"? ICA got a big grin and started nodding, yes! Eyes big! Even mouthed that she wants to watch, too. Something was asked about basketball and she wrinkled her nose and shook her head, no. She was looking right at the jury. Was one of them interacting back with her?? That worries me.

That is worrisome. A friend of my friend thought Scott Peterson was "hot" (her words) and wouldn't mind dating him.
