JB uses the term "garbage" for the mental picture of rotting food. But GB is using the correct term "trash" as it was mostly wrappers, empty containers, napkins, and empty bags.

ohhhh crap! witness destroyed his notes!

forensic people always (mostly I guess) write a formal report and then destroy notes. Not uncommon at all but defense attys always try to make a big deal out of it. LE often do the same thing with reports and rough notes.

Beg to differ. Hearsay is a statement offered to prove the truth of the matter asserted in the statement when not offered into evidence through the declarant.

yes, that is the day my supervisor reviewed the report our report is 43 pages and is logged by day. the supervisor reviewed the report and put the date he reviewed it

If he condescends to the witness ONE MORE TIME with his 'plain English" nonsense, I'm gonna scream! The witness' English is PERFECT, Mr. Baez.

I wonder if Baez means to say "laymans terminology" although I think the witness is doing an outstanding presentation.

I think the question that prompted the sidebar was something about whether Dr. Lee tested or examined the evidence.

This witness really cannot answer to things other people did. Calls for hearsay. JB is trying to sow the seeds of reasonable doubt by putting a "big" name out there and letting the question hang. he wants the jury to think Dr. Lee came up with something different.

It's a sloppy trick. All he has to do is put Dr. Lee on the stand.

oh no no no - Dr Lee was dropped from the Expert Witness list. He's nowhere on the radar.
