I worked as a bankruptcy paralegal for 4 yrs., however that was prior to the HUGE changes in 2005. State laws are different and I am not familar with those in FL. That said, I still think this is possible.
They can file a Chapter 13 bankruptcy and include the 9 months worth of arrearage into the bankruptcy. They could reaffirm their mortgage with their lender. That would mean that they would have their mortgage payment AND a Chapter 13 payment. Both would have to be kept current....and I do mean CURRENT. More than 30 past due and the mortgage company would file for a "lift of stay" and the entire amount financed would be immediately due. However, their Chapter 13 payment would be based on their 2009 income, so it would probably be extremely low. I am questioning myself now...I know to file a Chapter 13 you have to have income...usually be employed. I am not sure that Cindy's disablity pymts and whatever income GA may have would allow them to qualify for filing a 13. I do know that they would have to report every.single.cent. of income and debt. Not sure of FL laws, but I am pretty sure their schedules would be made public.
My speculation:
LP: Hey, Cindy, I'd be willing to help you guys out with your house payments.
Cindy: Really? Great.
LP: The deal would be, I give you the money and you let me and my guys dig up the yard and go through the house for 48 hours with no interference.

I've been thinking about this all evening and I have to agree---that I think something is definitely "up".
The Anthonys (in particular CA and GA) obviously took a great deal of pride in their house/home. They are neatniks and worried incessantly about people standing in their yard, etc. They are totally territorial and it is clear that their home has been extremely important..paramount, actually. So, how is it...that they would "forget" to pay for it?
Even with all that has happened..the house has always been such a huge big deal to them. The reason CA didn't want to divorce GA was because he could wind up with half or more of "everything that CA had worked for" (ie: the house!) It seems so incongruent that suddenly they would simply give it up. There is something afoot, a scheme of some sort. UNLESS they have truly lost their marbles and stopped caring. (Which seems so doubtful..when you consider how much they clean things, get tattoos, have haircuts and wear jewelry).
These are people who have "pride" in spades. So how and why could they let their house "go"? It just does not add up.
Very true! My own mother-in-law does that for a living. Cindy can work as an Advice Nurse over the phone, or she can become a Traveling Nurse. If she had a good track record as a Nurse Case Manager, perhaps she could even sweet talk Gentiva into giving her a reference.Out of curiosity I just looked at Careerbuilder and Monster websites and searched RN positions in Orlando. So far I have 25 pages .... there are many telephonic Case Manager positions available, no public contact, on the computer and phone, she would not even have to give her last name to clients- M-F hours. She could do that work and pay her own bills.

IMO The A's did not forget to pay the mortgage they, for whatever reason chose not too. I speculate that they put the money in Casey's Defense fund but someone posted they believe the A's have put that money aside, also a possibility.
I agree with the many posters who say Cindy should have returned to work...I say( and maybe grandma Shirley already has) pull yourself together and go back to work before you lose the home that you have worked hard to keep over the years.
