Yes, it is a wonderful article, isn't it? Randy's article is on the front page of LFP's print edition this morning.
Thank you once again, Randy, and to your colleagues, for such excellent, heart-felt coverage over the past three years. I know there are Websleuthers here, and readers of the LFP, who feel that they are going to miss Tori too.
I wonder how Tori's family feels today, after the big focus of the trial has suddenly ended, as emotionally exhausting and horrible as it must have been.

Agreed. That is the only thing I want to know. How does someone become this sick vile creature and act somewhat normal and go under the radar for so long.

I just dont understand why they would move him. Seriously WTF is with this country and the rights of these horrific criminals??? I am sorry let them be annoyed, let them go crazy because that is what they deserve.

Well last night as I lay in my nice warm comfortable bed my thoughts drifted to Michael Rafferty. I realized this would be his first night in the big boy jail, even if it is for assessment. I smiled to myself, picturing him scared s***less, and perhaps finally realizing, actually realizing that this is his reality for a very, very, long time.

As the Globe itself has reported, police fumbled the case by failing to obtain the secondary warrant they needed to search Rafferty’s computer. They had warrants to search his house and car, but to search Rafferty’s hard drive as well, they would have needed a warrant specific to that purpose. The Justice of the Peace and an O.P.P. forensic detective explicitly told investigators this, and there’s no question that they would have received the needed warrant if they had just asked for it. But they didn’t.
Had Justice Heeney ignored this and let the laptop in, he might have introduced an element of vulnerability into Rafferty’s conviction upon appeal. He could have put the crown’s case at risk and opened it up to legal challenge by accepting evidence the defence could have argued was inadmissible. The judge erred on the side of caution, and it’s hard to fault him for that.
Even if the laptop had been legally searched, one has to wonder whether the Crown should have been permitted to use the evidence gleaned from it. Let’s consider the implications of Judge Heeney allowing the jury to hear the Crown’s argument that by Googling search terms like “underage rape,” Michael Rafferty was actively planning his crimes. I might very well Google “murder” when planning a murder–and in the Shafia trial, that was indeed the case–but there are limitless other reasons why I might do so.
Rafferty’s searches were more specific, but proving that they were done in order to plan his crimes, rather than say, out of a deviant erotic interest, is very problematic. The Google searches, just like the child police found on his laptop, would have provided jurors with damning evidence about Rafferty’s character, but little proof of his guilt in this specific crime. In other words, they would have succeeded in characterizing Rafferty as an absolute - the kind of guy you don’t mind sending up the river, whether or not you’re absolutely certain that he did it. As Judge Heeney ruled, their value as proof–their “probative value”–was “minimal,” but their capacity to prejudice the jury huge.

Over the years "Thrill Haven" has seen its share of violence. J unit is considered one of the most dangerous places in Canada's prison system. The most unruly inmates are often housed there. On average, there are 5 inmate murders per year. (source: Corrections Canada)
On Oct. 12 2010, a correctional officer with a rifle shot a convict who refused orders to stop assaulting another prisoner in an outdoor recreation yard. [10]
On Dec. 7 2010, 120 inmates in the assessment unit refused to return to their cells at the end of a recreation period. They began to barricade themselves in the area and guards fired shotguns and used chemical agents to gain control of the situation. [11]
On Mar. 21 2011, inmate Jordan Trudeau was killed in an altercation. The event took place in the gymnasium area during exercise for "J" Unit (Maximum Security) inmates. Officers deployed chemical agents and fired shots to attempt gain control of the situation. Trudeau was killed by correctional officers via a shot form 9mm rifle to stop him from harming other inmates.[12] Two other inmates involved were wounded. The OPP Prison squad investigated the incident, and found CSC staff acted properly. [13]
UPDATE: Convicted murderer of Toronto teen Stephanie Rengel (David Bagshaw, 21) was charged with attempted murder in regards to this (Jordan Trudeau) incident. He is an inmate at Millhaven (MSU) and was involved in the attack on another inmate that forced guards to fire shots. Bagshaw and another inmate (the attackers) were shot to stop them from assaulting a third inmate

I personally think he lives in an alternate reality where he believes he will be granted an appeal and won't live inside those 4 very tiny little walls for life. Someday....someday, reality WILL sink in.
