New motions filed in Richard Allen murder case; Friday status hearing closed to the public

Friday’s hearing was scheduled as a status hearing, with the first half set to be closed to the public and later open up after a recess.

The closed-door hearing with Judge Frances Gull began at 1 p.m. and lasted 35 minutes.

When it was over, Carroll County Prosecutor Nick McLeland came out of the courtroom and went into another closed-door meeting with investigators and family members of the victims.

Defense attorney Brad Rozzi also came out, but would not say what happened in the closed hearing. Rozzi briefly spoke with Allen’s family members who were sitting outside the courtroom.

At one point, Allen’s wife Kathy could be seen wiping tears from her eyes.

I'd cry at the drop of a hat if I were KA. Just walking into the courthouse would make me cry.

This is also a reporter's spin, which is pretty subjective.

Maybe the judge has decided to recuse herself?

Or maybe JG has kicked RA's attorneys off the case again?

Or something to do with Judge Diener's recusal and abrupt resignation?

It feels like something major has disrupted this case's momentum.

If I Google "juror questionnaire Delphi" I get a link to the WANE video through Yahoo. I searched the WANE site and can't find it, takes me to another story about RA/Delphi.

This makes it sound like they came to some kind of agreement to work out a plea deal. But IANAL!

I'm too much of a cynic to expect it, but it doesn't stop me hoping.

It would spare both victims' and defendant's families the circus of a trial.

It would prevent a long, drawn out appeals process, that would happen were the defendant convicted at trial.

It would put something of an end to all of this. It would allow people to start the rest of their lives.

I say this because I believe that RA is the culprit, and he has confessed, and if he truly wants to spare his family further hurt, then this is the right choice for him to be making.

Nothing is obvious, that’s for sure but yes, it does seem as if something major is coming down.

RA’s family (wife and mother?) must’ve had an inkling of what was happening or they wouldn’t cry and get upset over the announcement that the public hearing was cancelled, as if they were expecting something positive about to occur at the open hearing. And so I’d expect as that didn’t happen, whatever is going on negatively impacted either RA or his attorneys from their perspective. MOO and JMO

IMO, None of the individuals looked distraught. Rozzi looked comfortable, smiling. What do you make of it all?

Perhaps RA has confessed yet again, but this time to the judge during the closed meeting? That would be best case.. No need to continue all the theatrics.. just get a deal done so we don't have to hear about RA again. Just my opinion.

If he is innocent, then I agree, he should not plead guilty. He's entitled to a trial in front of a jury of his peers.

But if he did this, and he was in earnest trying to take responsibility in his confessions, then he should feel free to plead guilty if that is what he wants to do. For himself, for his future, for his own conscience.

I think any plea would involve him admitting to exactly what he did, when, how, etc. I mean the state wouldn't have to accept a plea deal, so if he didn't fully explain what he did, why would they agree to a deal? I would guess the family would want to know also. Perhaps not graphic details, but basics like did he plan it out for a long time, did anyone else share info with him about where the girls would be, how did he pick the girls, did he go to the trail that day specifically to abduct Abby and Libby, how did he leave the CS, what did he do after that, what did he do with his clothing, etc. I don't see a deal with RA being one of those pleas where they admit the state has enough to convict, but they don't want to say they did it.

I think how much he would have to reveal would depend on the terms worked out between the parties.

He can't take an Alford plea in Indiana. So that's not in the cards.

I meant I'm afraid that all the others won't be brought to justice if he takes a plea. I'm still on the fence about his guilt or innocence, but if he's guilty (or of course innocent), there are others involved. I believe this 100%.

That's what I meant about us having a difference of opinion - I think the opposite. I think if he did this, he did this on his own.

But that's fine, that's the whole point of this place, to discuss a case with civility even if our opinions differ wildly.

Only time will tell what the truth of the matter might be.
