"I don't know why I'm being charged," suspect in toddler's murder tells judge

This video was from inside the courtroom today when the 2 arrested were brought in. No sound as it had to be filmed outside the courtroom (guess no cameras allowed in courtrooms? IDK). Not from AL. Does anyone understand why both individuals were brought to court at the same time and even seemed to be seated close together? I found this surprising. Does anyone local understand if this is just how a situation with codefendants would be handled? Are these 2 being tried together or separately?

I would agree - she seems to be on track with someone using kids for personal power.

MOO- I got the same feeling when I viewed DBQJ Instagram. The lude photos of herself, then other photos of her children sprinkled throughout... seemed like she was taking pictures of a car for sale; pics of the children at each angle (front, back, side), strange video of the kids in bed, etc... not like loving mother's photos of candid moments or happy selfies together. Stark contrast and made me feel very uncomfortable and sorry for her children. MOO
I also get the feeling that this is how she & PS crossed paths, and may be the reason law enforcement made comments about investigating involvement of any other persons. IMO CP/abuse ring locally. She lost her kids (payday) & needed a child to exploit (MOO). I feel that both individuals are equal partners with sick minds. All my opinion only of course!

It will be interesting to see if they are tried together or separately. I see them trying to throw blame for KM's death on each other in their trial/s.

I am not sure that having them in court together for this first phase is any indication of whether or not they will be tried together.

Do you know of any other cases in the U.S. where the perps. were tried together at the same Trial? I can't think of any offhand.

I also don't think it matters in a crime where more than one perpetrator has an accomplice to help enact the crime. From what i have seen in those circumstances they are both charged with the same crime. IMO.

Some famous examples of joint trials include the Enron fraud case, the organized crime prosecution of John Gotti and his mob family, and the conspiracy and espionage trial of Julius and Ethel Rosenberg.

In contrast, judges may not join the trials of defendants who simply happen to be charged with the same crime. For example, a judge can’t join the trials of all armed robbery cases on the docket unless those cases involved the same set of facts.

There is no constitutional rule governing joint trials. Judges have broad discretion to decide whether to join trials, and will weigh a variety of factors when making this decision.

No, you are probably right but it was just so strange to see them sitting together on the bench when it seems likely one is ratting out the other to LE. Just seemed to be odd. MOO

2 of the West Memphis 3 were tried together. Jesse Misskelley was tried separately. I can't think of any others offhand but I know there are more. Maybe one of these upcoming court dates will determine whether they're tried together or separately. If one turns on the other I would imagine they'd have separate trials but I'm just speculating.

I also wonder if we might see any motions from either of the co-defendants about competency to stand trial. I have major doubts about DB ability to stand trial and do hope that adequate representation for her is found and psychological testing is undertaken, especially if this becomes a case where the State will seek the death penalty as this is a capital crime. Its been a long time since I saw a defendant with such an extensive history of mental illness and from such a young age. The crimes alleged here against the 2 co defendants are horrific but the mental health history of DB allegedly goes back to her being 7 years old and born to a crack addicted mother.

Thanks, quite some time ago. It can happen like that but i don't think it happens very often where they are tried together in some of the more recent cases.

Maybe in the Holly Bobo trial? I think so, but have to double check now.

ETA; they were originally scheduled to be tried together, but then the prosecutors made a motion to sever the cases.

State Wants to Sever Bobo Cases
Nov. 18, 2015 - Prosecutors have filed a motion to sever the cases against the three men indicted for murder and kidnapping in the Holly Bobo case. Zach Adams, Dylan Adams, and Jason Autry are all facing possible death penalties if found guilty.


In the meantime, Judge Creed McGinley said he doesn't expect the trials to begin until 2017.
State Wants Separate Trials for Accused Holly Bobo Killers

A hearing has not yet been set on the motion to sever the trials of the three men. If granted, Zach Adams, his brother Dylan and Jason Autry will all be tried separately for Bobo's murder.


The three have been in jail for more than a year, and no trial date has been set. Judge McGinley told the attorneys in the case that he wants the case to proceed as quickly as possible.


"This case is my highest priority and council has described this case like none other," he said. "I am interested in moving this case along but we have significant obstacles."


The judge said the discovery process is why the case is progressing slowly.

As a young woman, Derick Brown pled with a judge to help keep her from becoming a “failure,” according to a letter uncovered in court records.

In the letter written a decade ago, Brown described a violent and unstable childhood and a desperation to keep her family together.

Her criminal record in Alabama stretches back to 2009 when Brown was 18 years old. At the time, she was using the alias Quentesa Evon Jackson, according to court records. Jackson was charged with burglary and theft of property and eventually found guilty of theft.

Jackson was arrested in December 2010 by Birmingham Police and charged with two felonies, robbery and fraudulent use of a credit card.

In January, she wrote a letter to the judge over the case, apologizing for lying during a court hearing. In the letter, she wrote, “I was scared from all I heard about you being mean and all I wanted to be with my babies and fiancé and father of my kids.” The then 20-year-old described her concerns for piling bills and her inability to buy diapers and baby wipes. “[My fiancé] only makes $7.50 a hour part-time,” she wrote. “I don’t want to be the reason we loses [sic] our home and our kids.”

Jackson goes on to detail her childhood which she said included sexual abuse, treatment in mental-health facilities and years spent in foster care. “I made a promise to myself that I won’t become a drug addict, do drugs or drink or hang around people that do. Oh cry me a freakin' river. The woman had excuses for all of her bad behavior and skipped past the part where she should have admitted her responsibility for her actions. Looking at her criminal record it's clear she never bothered to make those changes in her life that she "promised" the judge she would make.

From the get go what did she do - or rather what did she not do? She didn't report to her probation officer and she didn't pay the court fees. That doesn't sound like someone working hard to better herself. Instead she graduated from burglary to robbery. GMAFB.

IMO people do what they want to do and don't do what they don't want to do. The difference between the DBs of this world and those coming from similar crap backgrounds who actually became better people is that those who made it were willing to work at it. DB chose to steal credit cards and abuse her kids - her own doing and no one else's. Grr. MOO.

It's actually pretty common: The Menendez brothers, Garcia and Magbanua (Dan Markel), Derrick Almena and Max Harris (Ghost Ship fire), the Central Park Five (two trials, one with 2 defendants, the other with 3), Sacco and Vanzetti, Perry Smith and Dick Hickock (Clutter family killers of In Cold Blood fame), the Manson family.

Thanks, i haven't followed any of those cases but saw about the Menendez brothers case on T.V. some time ago. And the Manson family is also a very well known case too.
I was wondering more about Trials in the deaths of very young children like KM on this thread.
It's okay i can research it though.

Couldn't have said it better!

Without going into too much detail, as this is not about me. I had a very abused childhood, alchol and violence included...my mother committed suicide when I was 12....(I can understand in my older years why)..lived with foster parents....etc etc...

Life in my teens wasn't easy, I made bad choices, but I did better myself to be able to study, maintain good jobs, buy a home with my amazing hubby and raise 2 beautiful children. I was dedicated to make their lives far removed from my childhood...

So, no I don't buy that either, we have choices....we can choose to change...it does take a lot of strength to overcome obstacles in our lives....IMO

DB admitted she had issues....she was aware of it...that's half the battle...so IMO she could have consciously made different choices.
