Here's what happened this afternoon: Witnesses - Garrard's story changed about granddaughter's death http://s.al.com/gYAxifH via @aldotcom

WilliamThornton @billineastala · 9m9 minutes ago

The 911 call was probably the biggest item today in the Joyce Garrard trial. DA Jimmie Harp questioned the dispatcher.

WilliamThornton @billineastala · 8m8 minutes ago

At certain moments, he stopped the tape to make sure the jury understood what they were hearing. For example, the "give me a smoke" quote.

WilliamThornton @billineastala · 8m8 minutes ago

You could also hear Garrard saying "open your eyes" to Savannah and calling her name as Jessica Hardin spoke on the phone.

WilliamThornton @billineastala · 8m8 minutes ago

At one point, Jessica says Savannah is throwing up, but she is always said to be unresponsive.

WilliamThornton @billineastala · 7m7 minutes ago

This contradicts what the neighbor said in the later testimony after lunch about seeing her partially, or fully, alert.

WilliamThornton @billineastala · 8m8 minutes ago

That witness said that the events happened 3 years ago, so he would do the best he could in remembering things.

WilliamThornton @billineastala · 7m7 minutes ago

His version was softer than that told by the Jacbbs'. But during the 911 call, Savannah is described as not convulsing, but unresponsive.

WilliamThornton @billineastala · 7m7 minutes ago

Harp asked the dispatcher if it would have helped to know she had been running. She said yes.

WilliamThornton @billineastala · 6m6 minutes ago

She also asked Hardin if this was Savannah's first seizure. She said yes. Dispatcher also noticed how calm Jessica seemed.

WilliamThornton @billineastala · 4m4 minutes ago

Dispatcher asked Hardin if Savannah was on regular medication. She said yes. Defense questioned as to why she didn't ask for more details.

WilliamThornton @billineastala · 4m4 minutes ago

Defense questioning of several witnesses revolved around what Garrard told others about how Savannah collapsed.

WilliamThornton @billineastala · 3m3 minutes ago

Paramedic who rode with Savannah to the hospital said Garrard took "an aggressive stance" is trying to ride with the child.

WilliamThornton @billineastala · 2m2 minutes ago

Medic said that normally, he and his partner would have worked together to resuscitate the child. But dealing with Garrard meant 1 had to...

...deal with her while the other worked on the child.

WilliamThornton @billineastala · 3m3 minutes ago

Medics also said he did not have any dealings with Jessica Hardin until he saw her at the hospital. Not much testimony about her so far.

WilliamThornton @billineastala · 2m2 minutes ago

Jessica Hardin has been charged with murder but has not been tried. She was charged, prosecutors said at time, because she didn't intervene.

WilliamThornton @billineastala · 3m3 minutes ago

Defense, I thought, scored a little when they got medic to admit that he had not put in his statement that Garrard was belligerent.

WilliamThornton @billineastala · 2m2 minutes ago

He said he had remembered it "within the last 60 days" but did not say it was prompted by anyone, under defense questioning.

Defense also asked him if he could diagnose hyponatremia, or too much water in her system. He said he wasn't capable of doing that.

WilliamThornton @billineastala · 2m2 minutes ago

"You'd have to confirm that with blood tests," he said. It also wouldn't have made any difference in treatment.

WilliamThornton @billineastala · 3m3 minutes ago

A forensic scientist who collected evidence said they found water bottles at the home later during the investigation, some full, some not.

In one, it appeared "a little bit" was gone, from the cap to the label.

WilliamThornton @billineastala · 2m2 minutes ago

The neighbor who testified evidently had been scheduled to go this morning. Under questioning, he admitted it.

WilliamThornton @billineastala · 2m2 minutes ago

"I had to go find you, didn't I?" Harp asked. The neighbor, Wallace Hutchins, said someone had told him not to be there.

WilliamThornton @billineastala · 1m1 minute ago

He indicated defense attorney Dani Bone, who immediately disputed this. "You asked me if you had to come up here at 7:30 to talk to the DA."

WilliamThornton @billineastala · 53s53 seconds ago

"I did not tell you you didn't have to comply with a court-ordered subpoena," Bone said.

WilliamThornton @billineastala · 1m1 minute ago

It sounded like miscommunication, or perhaps the guy didn't realize what was being asked of him in terms of having to testify.

WilliamThornton @billineastala · 26s26 seconds ago

Either way, the case moved on. Investigator Mike Jones said Garrard admitted punishing the child, but also said she cheered her on.

WilliamThornton @billineastala · 36s37 seconds ago

He said Garrard knew she was "loud" and that she wasn't a cheerleader.

WilliamThornton @billineastala · 32s33 seconds ago

Defense attorneys asked several questions toward the end about former coroner Michael Gladden and forensic pathologist Emily Ward.

A few notes on the courtroom - media are seated in the back. There are five rows of benches, with two benches parallel, so 10 in all.

WilliamThornton @billineastala · 2m2 minutes ago

Family has filled about three or four benches on the same side as the defense.

WilliamThornton @billineastala · 2m2 minutes ago

There hasn't been any visible or audible response from the courtroom, but Judge Ogletree has cautioned at the beginning of every session.

WilliamThornton @billineastala · 1m1 minute ago

There have been a few bench conferences as the two days have gone on.

Lol, I have some hive maintenance to do myself. That's one good thing about this trial.....lots of breaks in between information.

I just know little Savannah will get justice.

I'm curious about her dad. Does he believe his mom or is he estranged now?

i'm curious as well..........i know he filed suit against one of the hospitals that treated savannah for inadequate care.....not the one she died in which was in birmingham but the one prior.......sorry no link, just going from memory here.....

and of course the step mom is still awaiting trial.......however, she is out on bond

Court in brief recess. First witness was Investigator Mike Jones, who testified yesterday.

WilliamThornton @billineastala · 20m20 minutes ago

He spoke about two different interviews he had with Joyce Garrard - 1 on Feb 20, 2012 before arrest, other a day later after.

WilliamThornton @billineastala · 19m19 minutes ago

1st interview was at her home-but not the home where Savannah ran. This one was also in Etowah County.

WilliamThornton @billineastala · 18m18 minutes ago

Jones said Garrard spoke freely with them for about 20 minutes on her front porch. Then Jones said he was cold, and they moved to his car.

WilliamThornton @billineastala · 18m18 minutes ago

This was an SUV without cage or other patrol car additions. Interview in car last 1 hour.

WilliamThornton @billineastala · 17m17 minutes ago

Under cross, Jones said Garrard went voluntarily for this interview and did not ask to leave.

WilliamThornton @billineastala · 17m17 minutes ago

During that one, she said Savannah picked up sticks and never complained. She said Savannah "never complained about being thirsty."

WilliamThornton @billineastala · 15m15 minutes ago

in her second interview in custody, after she had been advised of her rights, Jones said she told them she was "tired of Savannahs excuses."

WilliamThornton @billineastala · 16m16 minutes ago

She also told them Savannah had complained of being thirsty. She said she had been with her all afternoon.

WilliamThornton @billineastala · 16m16 minutes ago

But where she had said earlier she had been running for five minutes, she now said 20 minutes.

WilliamThornton @billineastala · 15m15 minutes ago

She also told them Savannah "wanted to be out there."

WilliamThornton @billineastala · 15m15 minutes ago

Defense attorney Richard Rhea again asked Jones if Garrard could have been saying "give me a throw" on the 911 tape. He said no.

WilliamThornton @billineastala · 14m14 minutes ago

Rhea asked, "what does she say after?" Jones said he did not know.

Am I the only one that thinks it's weird that she didn't invite the investigator inside her house after he was cold? Why go to the car?
