It appears that MN is asking the Judge to throw out his entire Order regarding the review of the TES documents. MN is saying that the Defense does not need ANY of the records because they have agreed that the area around Caylee's remains was impassable at the time.

I'm sure the Judge will not throw out or alter his Order, but at least MN got all the facts on the record, and makes it more likely that the Judge will not give the defense access to any more than the (32) searcher's documents.

That's the way I understand it too. All we need now is a hearing date.

I'm shocked that MN did not ask for sanctions. It is obvious his disdain for JB and CM approach the dislike area.

In paragraph 17, he quotes Cheney Mason's crazy press remarks after the 6/21 hearing! :floorlaugh:

Then in paragraph 18(e) and paragraph 19, he uses CM's OWN WORDS from that presser to contradict the defense's assertations!

Nothing like biting yourself in the butt. lol Wonder what how they are gonna argue that? :innocent:

eta: I don't even know what to say... I don't *think* this will have a major affect on how Judge Perry plans to rule, but MN makes a very good point. How do you argue, "Sorry your Honor, I didn't know WTH I was talking about when I said that."??? LOL

I really thought he might ask for sanctions too -- but it appears that MN wants to go further than that, and wants to put the brakes on any further digging into TES searchers by the defense. That is more important than a slap-on-the-wrist financial fine anyway. IMO

On the Google map attached as Exhibit A - where is the remains site?
Is Suburban Dr. and the elementary school in the middle top portion of this map?
Under the "Lee Anthony/Black Mesa Dr." notation?

I put my :twocents: in on the Atty. thread.

Really can't figure out any other reason than MN wanted to use CM's own remarks that directly contradict the basis for the defense's motion, showing "bad faith". Other than that, the first 9-10 pages are almost identical to his prior motion. :waitasec:

WOW! Thanks! how did you get it so lightened?
I'm not familiar with the streets shown on that map and Suburban Dr is not typed on it, so I can't tell where the remains site would be on that map.

I guess the question is did MN really agree or was he railroaded by JB or HHJP? He did not look happy as he was leaving the hearing. JB/CM offered to withdraw his motion, but I'm guessing MN had an issue during the sidebar and said that he would file the bad faith motion. I inverted the image in photoshop, then I played around with the levels to try and get the map legible, but it's still pretty bad. Here's a google map screen grab of the same area, the purple mark is where they found Caylee's remains.

Slightly OT but I wonder who decided to use the purple colour for Caylee here?

I inverted the image in photoshop, then I played around with the levels to try and get the map legible, but it's still pretty bad. Here's a google map screen grab of the same area, the purple mark is where they found Caylee's remains.

I hope the motion to quash is granted. I certainly hope that Judge Perry spells out specifically what kind of note taking will be allowed and with specific tools i.e. pen & paper, computer, etc. and then make the defense prove the relevance of a searcher that searched 8 miles away.

It's not exact. Caylee was found on the other side of Hopesprings drive.
