You're right Mac, that the defense has every right to address any point brought up in MN's motion, including the portion where he cites CM's remarks during the 6/21 presser. However, every other exhibit attached to back up the rest of his 'response' is in reference to MN's earlier representation of the Anthonys or about some book deal MN is contemplating. I don't recall any of that in MN's initial bad faith motion. It is just mudslinging and nastiness. The purpose of a response (aka Answer) is to ANSWER the opposing counsel's points in their motion. Not to include a bunch of garbage that was never addressed in the first place. If Baez was so darn intent on throwing this trash out there, he should have filed his own bad faith motion against MN. (Good lord, I can't believe I even said that. ack!)
Seriously, this nastiness NEEDS to stop. It has gotten totally out of hand, imo. It reminds me of a 3rd grade playground mentality - "I know I am and so are you!" It is ridiculous and totally non-professional. I pray that HHJP slams down his gavel and makes it clear this is not going to be tolerated any longer. I also hope that MN doesn't file a response to this trash. It isn't worthy of one, imo.

Not only does Mark have it writing, Brad specifically waived it on their behalf on the record!!!
Saying there is a conflict of interest makes no sense, whatsoever.
I am not surprised, if one has been listening to the defense lawyers in this case. Three times ,that I know of ,one of the lawyers for Casey stood and argued in court that Mark Nejame had a conflict of interest for representing TES after having resigned from representing mom and pop. Not only does no conflict of interest exist, but he has in his file a SIGNED WAIVER OF CONFLICT, just for perfunctory reasons. Brad Conway corrected them and informed the judge that is not true, there is no conflict, and his clients certainly are NOT asserting any such thing. Do these folks even talk to one another?
For some reason that escapes me, these like issues seem to be of a huge confusion to mom, pop, Dom and Baez. We have had this problem before.

I know who is not in a fog and who can edify them . Judge Perry.
Help, at the 1:30 minute mark what do you make of Mark saying we wanted to assure George and Cindy that no one had disturbed the remains of Caylee, and that no one had been out there ( paraphrased ). What do you make of that, that they and their lawyer knew where Caylee was?
Judging by his own exhibit, the fact that Mason wanted to review the boxes that were administrative, that detail the names and contact information for all of the searchers brings illumination to the fear of Mr. Miller all along, that this is what they really wanted not to review the maps and reports of what the search results entail.
