Interesting comments from Hornsby, aren't they? Wonder if he is trying to sound sympathetic to the defense side for a particular reason? Wonder if he is considering joining the defense team at some point - if they are ever in need of another lawyer?

Surely, surely Richard Hornsby has enough sense (and dignity) to never even consider joining the defense team!

Richard has publicly expressed his disgust with JB so I will give RH the benefit of the doubt here.

Richard please don't prove me wrong! lol

Exactly Trapshooter - we know how he feels about JB, he's told us in bold and frank terms - and I would like to think I can trust his comments when he's on our threads or on his own blog.

But occasionally I see a lapse in judgement from him, and I believe he should have given more thought to his comments and their timing, because his most recent clip may be viewed by those less familiar with the case as a talking head who is supporting the defense's behavior rather than saying they need these Equisearch files to blow up a sandstorm because they don't have anything else to use as a defense and this won't work either.

IMO of course.

He may have said more and the tape may have been cut to just show those comments we saw, but the combination of his comments and the timing of them to me were just wrong. I expect better from him.

I got the impression that he was making controversial, what-he-thought "interesting" comments to make himself relevant as the talking head for WESH. He seems to like to say somewhat shocking things to draw attention.

I think it is a sad state of affairs if the fishing expedition into 4,000 volunteer TES searchers is the "heart" of the defense case! OMG! shows they are desperately searching for a defense, and do not have one to date.

The judge cannot deny their access to review the documents, because then they could claim the defense "might" have been in those records. So, nobody is denying them access. It is what they do with the info after they take notes on it, that matters. IMO

Agree I have always understood at the heart of the issue was the appeal and I applaud MNJ for asking for the moon in his motions and receiving exactly what he wanted for protection for the searchers.

I fear that is exactly what RH was doing - saying something he construed as "shocking" but why not take that sound bite to point out MJN got exactly what he wanted and the defense is no further ahead except their inspection of the files will be much more closely monitored than originally ordered. Geez Baez - you are actually going to actually heave your butt up and away from that presser table and go and look at these files now - and how's that lump on the side of your head feeling today where I suspect HHJP gave you a good smack? LOL

I did not hear what RH said but I would imagine he is speaking from a defense attorney's perspective because that is what he does and it is who he is.... He does seem to play fair, refreshing to say, considering what we have seen down there in Orlando. But that is just my opinion.

Exactly! I saw no "huge victory" for the Defense. They get to take notes - big woop!
And now the Defense has Judge P's ire up and his sensors on high alert.
They CANNOT make any notes or any information from the notes PUBLIC.
Huge victory for TES and their volunteer searchers.
Why the WESH commentator chose to make his comments seem defense favorable, I can only guess... as much of the WESH reports seem to be defense slanted ....

It is easily available to watch - look up thread or in the news from yesterday. While you watch, pretend you don't know much about the case.

Attorney: Equusearch Docs At Heart Of Casey Case
Perry Grants Defense Team Big Victory In Casey Anthony Case

POSTED: 5:13 pm EDT August 17, 2010

"Defense attorney Richard Hornsby told WESH 2 that raising reasonable doubt over who placed Caylee's remains in a wooded area along Suburban Drive is critical to Casey Anthony's defense.

Hornsby said that critical critical issue is at the heart of why Anthony's defense is entitled to Equusearch records.

"If they can't determine she placed the body there, they're going to have a hard time determining she killed the child," Hornsby said.

During a closed door meeting Monday, Judge Belvin Perry gave Jose Baez and the defense a big victory -- the right to determine which volunteers searched the closest to where Caylee's remains were later found.

"The bottom line is, we want to know what happened out there," Baez said.

Had Perry not given the defense this ability, Hornsby said any conviction would have likely been overturned.

"It would have come back on appeal, this is the heart of the defense," Hornsby said.

I saw this and thought to myself, Ok, I get his point but it was like receiving information in a vacuum. He is talking about proving that ICA dumped the body, which is something entirely different than ICA killing Caylee. The way I understand what he is saying is that one includes the other and that just isn't the case. There is much evidence that ties the remains to ICA's car and then the remains back to the Anthony home, then you factor in ICA's behavior, lies, etc. Using common sense, a very clear picture emerges. When RH spoke yesterday, he was strickly speaking about getting the documents so the defense could determine who searched, where and the conditions. The problem with all this is that Baez ALREADY had that information, remember JJ and Laura Buchanan? Only now JJ has recanted and LB isn't talking anymore. I call BS, they don't want the documents to determine what RH said, they want them to look for someone they can lay the blame on.

People have referred to Mason as the master of reasonable doubt but the key word there is reasonable. It's got to be believable! Trying to make me believe that Kronk, who had no ties to the Anthonys, somehow has something to do with this is NOT reasonable. Neither is trying to blame someone who searched with TES! I could make a list of reasons why...but first on the list would be that they weren't the last ones with the child.

here is a rough transcription of what RH said on the video ....
VIDEO
RH: It's a huge issue in this case
that's a very strong argument and a jury is going to consider that for a long, long time because if they can't determine that she placed the body there, they're gonna have a real hard time determining that she even killed the child.
they need these records so they can go and determine who exactly was there and look at those people in the eye and say tell me exactly where you searched, what you saw, and what the conditions were
it would have come back on appeal cuz this is the very heart of their defense....

I'm still not clear on what the parameters are for determining which TES volunteer searchers searched "close to" where Caylee's remains were found?? Is it going to be within 50ft? within 200ft? or more??

I wonder if Judge P set any guidelines as to distance? Or, if Judge P will just look at the files which the defense tabs, and make a determination on his own, using his own criteria, to decide if the defense gets more info on more searchers, or not?

Ummm RH? What happened to Zanny??? Isn't she the heart of the defense?

Hopefully we will actually get to read the motion for ourselves this week.

Yes, apparently the news reporters have read Judge P's Order .... we, the public, want to read it! Why don't they publish it??? Or, are the reporters only going by what the defense team or MN told them the Order says?

  • #917
With all respect - I understand you agree with RH and yak yak, but here's my point. RH was making a big deal about proving ICA put Caylee in the woods, and if SA can't the jury will be thinking long and hard about that. My question is - is he telling me the SA had a witness who absolutely saw Scott Peterson dump his dead wife off of that boat in the bay? What's that? Just the cement in the boat? Kind of like - just like the laundry bag, the duct tape, the garbage bags and even more so - the DNA in the trunk? And let's not forget the 31 days.

So is he saying she won't be found guilty cause she did the dirty work but hired someone to put the body in the woods? Huh?

And yes, I understand the defense is making a big deal about the records cause they have zip - nada - zero.

Sounds like misdirection to me. Typical defence move, I imagine, moving the focus from the fact that the perp murdered Caylee into some silly realm about who dumped the body.

Exactly - step back to yesterday, read and watch clips, make that leap in assumption and there you will see me beginning my rant - lol! DID they do those pressers from just what the defense says happened?

If, as CM claims, nothing has changed and the original motion stands.....why would the judge want to seal the order????? Am I missing something????

I'll trust Mr. Hornsby to stick to what he has said in the past regarding this. I wish I could find the exact link to his statement. But the gist is, that among other things KC could not afford him.
