"Baden-clay update: prosecutors waiting on 5 statements before case can proceed on sept 24th "

"Court hears Gerard Baden-Clay's defence team has received 446 statements. Still waiting on five more, including two from police. "

  • #470
Court is adjourned folks til Sept 24th.

I wonder why the prosecution are still waiting for 5 statements. Witnesses on very long holidays perhaps? Maybe our insiders there can tell us if the magistrate asked why they are not available yet. Seems like the prosecution may have said they will be available to hand to the defence in a couple of weeks, hence the adjournment to 24 September for the magistrate to check that has been done.

No doubt GBC has been occupied with lots of interesting reading lately!! He is going to have more to read than we have threads.

Article in yesterday's Sunday Mail about 2 men recently committed to stand trial for the murder of a policeman in May last year. Committal hearing only took two days but "court availability in Brisbane means the matter is unlikely to be heard before the second half of next year"

Gee Doc, for once I happen to agree with you. I had my say on the legal system yesterday - lawyers are the only ones who benefit.

BN, I appreciate why you are down on the lawyers. But to be fair, ask why are the lawyers forced to come back on the 24th at further cost? Because someone else hasn't done their job.

POLICE have provided 446 witness statements to the defence team of accused wife killer Gerard Baden-Clay.
Prosecutor Danny Boyle said the bulk of the brief had been supplied to the 41-year-old's lawyers, although five significant statements are still outstanding.

They include statements from two of the primary investigators although they are due to be completed by the end of this week.

In July, a four to five month delay was expected for the provision of Baden-Clay's financial records, but Mr Boyle said they would be ready by September 14.

He said a forensic pathologist received results from Western Australia last week, with his statement due by the end of this week.

A total of 32 exhibits have been examined in relation to phone and computer records, with their report also due by the middle of this month.

He asked for a three-week adjournment, which was consented to by defence lawyer Darren Mahony.

But Magistrate Chris Callaghan questioned the prosecutor as to why some financial documents had not been provided to the defence last month

Mr Boyle said the material was a little more voluminous than expected, but that the rest of the material could be provided after court.

The case was adjourned until September 24 when Baden-Clay will not be required to appear.

Baden-Clay, 41, who did not appear today, is charged with murdering his wife Allison in April before dumping her body on the banks of a creek.

Earlier court hearings have heard how Baden-Clay is $1million in debt and stood to gain about that from his wife's life insurance and superannuation policies

Alison Sandy - Gerard Baden-Clay case adjourned for 3 weeks and set to proceed again on Sept 24

Amelia Birnie - Court hears the bulk of the Baden-Clay murder investigation brief has been supplied. 446 statements, 32 phone and computer exhibits

I think the reason for missing statements could be understandable. People could be away on holidays, overseas, police could be in court cases and these might not be the only statements they have to provide. Also I just think it's a huge administrative job for this case. I think that one of the reasons there is so much information to be gathered is that a lot of it is circumstantial, so they need to trawl the depths of every possibility and get documentary evidence of every minor detail and every possible indidvidual who has even the tiniest bit of relevant information - so that it will be the weight of information and lots and lots of small pieces fitting together that win the case. In other cases where there are actual witnesses or which are less circumstantial there might not always be the necessity for so much other detail. Ths is just IMO - I feel like the police have had to work so hard to get any little thing that is going to help. Not that they wouldnt do that in any case, but this one is a hard one with possibly others involved in a cover-up.

Interesting wording...

"Baden-Clay, 41, who did not appear today, is charged with murdering his wife Allison in April before dumping her body on the banks of a creek."

Got to say though surely its considered poor form if the two main detectives have yet to do their statements. Considering they are waiting on others wouldn't that make them all the more aware to get their own done??

The morning show just reported that GBC is no longer in medical wing or solitary. Apologies if already posted. IMO

thats interesting news, i wonder if he is making friends and has a cell mate, isnt there a code in prison where women and child killers and rapists are treated with contempt and shunned or worse, by other inmates?
he seems quite effeminate so can imagine his time there will be hell and he will be bullied and broken. i wonder how long before hes back in solitary or the medical wing.
i agree, prison isnt a good place for children to visit and as a parent you wouldnt think you would want your children to see you there either.

The Brisbane Magistrates Court has heard prosecutors are yet to complete the brief of evidence against alleged murderer Gerard Baden-Clay.

He is charged with killing his wife Allison Baden-Clay in Brisbane's western suburbs earlier this year.

Prosecutor Danny Boyle told the court he is still waiting on several statements including an analysis of Baden-Clay's finances and statements from the lead investigators in the case.

Magistrate Chris Callaghan has ordered they be made available to the defence by September 14.

The charges against Baden-Clay are due for mention again in court on September 24.

Baden-Clay remains in custody and will not be required to appear at the next hearing.

I'm removing the off topic posts.

Adding to the "not for discussion list"... there will be no further bashing of lawyers/court system at all.

You will be put on time-out if you do.
