This is the SAME case which has gone through the judicial process from the Trial Court level up to the Supreme Court of Italy.





Trial Court: Guilty Verdict



Appellate Court: Not Guilty Verdict



Supreme Court: "Blasted" the Appellate Court's NG Verdict and sent back to the Appellate Court for re-try



Appellate Court: Waiting on decision today.

US law doesn't apply in Italy.

I believe in the principle of not allowing double jeopardy. It works both ways. I respect non-death-penalty countries that don't extradite their citizens facing the death penalty here.
And folks can call the string of trials in this case "appeals," but they don't correlate with our legal appeals process. They're three separate findings of guilt/not guilt -- not rulings on whether previous trials were fair and legal. So I still contend it's double jeopardy.

I'd rather wait like this than be told that there is a jury question only to find out that there is a verdict which in the end turns out to be a non-verdict verdict. *Shudders*

There is no double jeopardy and US law does not apply in foreign countries.

Different laws, different system. Double jeopardy doesn't apply here imo.

If a person willingly goes to a foreign country they best be advised, not to kill anyone, and don't lie and finger innocent people.

I will say that double jeopardy will not matter in extradition but their are other grounds in which they could fight that on. Having an extradition treaty with a country doesn't mean either country is obligated to extradite someone upon request, and countries with such treaties have denied extraditions.
