Andrea Davis, 36, has been charged with manslaughter concerning a 2012 death at her Hot Springs home that authorities say was related to a planned drug purchase, the Arkansas Democrat-Gazette reports. During a Friday court hearing, she pleaded not guilty, and in a matter unrelated to the manslaughter case was sentenced to 15 days for contempt of court stemming from her failure to appear for a Garland County court hearing on the day the AG announced their involvement.

AG Dustin McDaniel was a candidate for Arkansas governor but dropped out of the race over the issue of his relationship with Davis.

“I’m really disappointed with having to do this,” Garland County District Judge David Switzer told Davis on Friday as he sentenced her for misdemeanor contempt. “All these years on the bench and you’re the first lawyer I’ve ever had to hold in contempt. I shouldn’t have to be in that position. I find it distasteful for me to be in that position.”

Davis is expected to appeal the contempt sentence.

She and her brother, Matthew Davis, 32, were both charged with manslaughter in the Feb. 29, 2012 shooting of Maxwell Anderson, Arrest affidavits say Anderson was shot by Matthew Davis in “a drug transaction gone bad” that involved a planned purchase by the Davises of $1,200 in methamphetamine, the newspaper reports.

Attorney Bill James, who represents Matthew Davis, said his client has a strong case for self-defense. Attorney Jeff Rosenzweig represents Andrea Davis. He said he expects her to be acquitted.

“The fact is, the evidence clearly supports a self-defense issue and the evidence is also of course that Andi Davis was not the person who fired the shot,” Rosenzweig told the newspaper. “And there’s some I think significant legal question as to whether you can be an accomplice to a negligent act.” http://www.abajournal.com/news/arti...se_gets_time_for_court_no-show_on_day_ark._ag

This is in my town.

Both defendants got a slap on the wrist and pretty much walked free. Widely held belief is that it was a drug deal gone bad. They had given MaXx money to go buy drugs for them and he came back without the money or the drugs. He wound up shot in the back and dead.

The sister (who was a local lawyer before her spectacular fall from grace) has since been arrested for having stolen property.....a couple of times. The brother has moved to California and I believe he was the one that actually pulled the trigger. He got like probation and nothing more....he also gets to serve his probation in California.

I can't believe they killed this guy and basically just walked free.

I still find it hard to believe that there is video (or anything else) on that phone that experts cannot or have not already accessed due to the lack of a "code" that can only be supplied by AL. Have I just watched to many police television dramas?

Well, you can probably bet if they didn't find them beforehand, they're definitely searching for them now since AL claims there are 4 videos.

BBM I agree. Having read a lot and also sorry to sound like a broken record, after they were able to get into Trayvon Martins phone, it too being locked and not knowing the password, they were able to retrieve TONS of stuff.

Also, the phone allegedly was in Crystal Lowerys name, so they could have gotten permission from her. I doubt they did but who. JMHO, it may be one of those things where they had enough to build their case with all the info they had. I feel sure they had a lot that they felt strong enough about. They charged both with Capital Murder and Kidnapping, equally. And had a month after Arron arrest to build the case against Crystal. Wondering if Arron said something about having videos during his interrogations that they didn't go there (looking into his phone), leaving that to his defense team to deal with?

He (AL) was strong in his belief in speaking to the Judge, that whatever he had on his cell that he needed it for his defense. I guess we shall see.

I'm sorry but I'm so behind but want to skip up a little bit.... What 4 videos?

Cliff notes: AL said there are 4 videos on his cell phone that he needs for his defense. But, he will not give the passcode to his cell phone to anyone because he doesn't trust anyone. This is from when he did not have an attorney.

Hey, girly! For sure go back and read Arkansasmimi's account of what happened in court. She was there. Her report is waaaay more thorough than any news. :) Glad to see you!

Did anyone see that he's got a parole hearing set? For October? How does that make sense?

I got a call from Vinelink today stating that AL has a tentative parole hearing scheduled for Oct 15. The reason is, its for the current charge that he is at Tucker Max for, Parole Violation. (otherwise he would be being held at Pulaski Cty Regional Jail same as Crystal). That hearing doesn't have anything to do with Beverly Carters Capital Murder and Kidnapping case. EVEN if he were to get parole, he has a detainer from Pulaski County. He isn't going anywhere... so as they say its moot ;) as far as him being released as in free. JMHO

Ok thanks for clarifying. That makes sense..

I have this feeling that AL is going to plea in a deal and sell CL up the river. I wouldn't put it past him to squeal like a piggy to save his own skin and to set up CL to take the rap!

Oh, I can see where this is going. She will plead guilty, get a plea deal, then everyone will claim that she is still innocent and clueless, but just did it to reduce jail time. Innocent people don't need a plea deal in a murder and kidnapping case. They need some good evidence to convict of those serious crimes. If someone accused me of it today, no way my innocent butt would say I did something.

If I have to guess, sounds like Crystal had more knowledge or participation than people are willing to admit! That's my opinion. But, I already figured that or she wouldn't be sitting in jail right now. She would have already been free because they had no evidence.

Well the great thing is none of our opinions matter. What you or I think or believe has no bearing whatsoever on any of this.

It matters to me. If I wasn't interested in hearing everyone's point of view, I wouldn't be here. It won't affect the outcome of the case, no...but I like to toss around different perspectives.

Weird that opinions have no bearing whatsoever on a crime forum! But, ok. We can go with that. Guilty is is guilty- plea bargain or not. All guilties are created equal. No opinions needed.

Reminder folks ... we provide links to back up what we say, we don't engage in rumors, and we don't let on we know something that others don't.

My point is our opinions will not have any bearing on this case or others. We can toss around ideas all day long but that doesn't make them fact. I would think anyone found here that is on a jury would be kicked off, or anyone working any part of the case. There is no winner here regardless.
