Day 2: State crime lab examiners testify about evidence in Zachary Holly trial
Holly charged in death of 6-year-old girl Jersey Bridgeman

Two Arkansas State Crime Lab experts testified Tuesday morning, a lab technician and a forensic DNA examiner.

They told the jury they found a semen sample on Jersey's pajama t-shirt. Both testified to the jury that they can prove within all scientific certainty that the DNA form the shirt sample matched Zachary Holly.

They said that sperm was also found in Jersey's vagina and rectum. The women told the jury they were not able to prove within scientific certainty exactly who this belonged to; however, the odds of finding a match to the sample they found were 1 in 270,000.

According to their investigation, Holly's DNA did match.

Medical Examiner, Dr. Frank Peretti, says displaying the disturbing photos of Jersey Bridgeman are relevant to show the extent of the case.

Mmmmfff. How awful those photos must be, but justice and the People of the State of Arkansas say it must be done. The poor jury -- once you have seen those kinds of pictures, the images stay in your memory for a long, long time.

Closing arguments in the Zachary Holly capital murder trial are scheduled start at 9 a.m. on Wednesday (May 20) in Benton County Circuit Court, according to the Benton County prosecuting attorney.

Holly, 30, is accused of raping and killing six-year-old Jersey Bridgeman in Bentonville on Nov. 20, 2012.

Prosecuting Attorney Nathan Smith said he expects the state’s closing argument to last about 10 minutes. Holly’s defense lawyers said their closing argument will last about 30 minutes. Depending on how long the jury deliberates, a verdict could be returned on Wednesday.

When the jury reaches a verdict, the same panel will have to decide whether Holly will be sentenced to life in prison without parole or death. The sentencing phase, which will begin if Holly receives a guilty verdict, could last several days. Witnesses will be called to testify before the jury for the sentencing phase.

Thank you borndem. I would have been glued to the computer regardless and it was nice to at least share it with others who care for this precious girl.

Question... if the defense doesnt put up any witnesses.... could he later appeal saying they didn't do anything to defend him?

usually the judge will ask him, on the record, if he's satisfied with counsel, he will do this outside of the presence of the jury, and while he's questioning him for the record on whether he will be testifying in his own behalf.........i would be shocked if this doesn't happen as a matter of fact.......it's standard.......

Hi, LibraStarr -- I've never seen it done, but I have only seen the Defense present no CIC a couple of times -- one was when the case had an eyewitness to the murder, and the killer confessed as well. In this case, the Defense was going for 2nd Degree instead of 1st. (Did not succeed.) Another case was when two of the three perpetrators testified against another perp who had planned the murder. No success there, either. No appeals on either so far.

Good question... On its face, it would seem to be a very weak point, but you never know. We do have the confession in Holly's case -- which his attorney brought into the guilt trial. We'll see how it goes during the penalty phase. It should be interesting. And, IMO, it'll have to be dayam good to keep him off the gurney in about 20 years...

Maybe someone has seen such an appeal??

i have seen such an appeal, but rarely and i mean RARELY are they successful and as i told libra starr upthread usually the judge will inquire of the defendant on the record if he is satisfied with counsel also......usually for this type of appeal to be successful, the attorney would have had to have been so egregiously deficit in his or her duties that it would have probably been evident during pre-trial or most certainly during trial.......i don't think that's the case here or at least not from what i've gathered from reading case info released and/or published....imo

I say this with every case such a beautiful child. Heartbroken evil intruded in her life. Angers me people can abuse children

i'm so glad to see you zoey my friend, i've felt so bad since yesterday when i hugged and had to dash on you......so glad you joined us here :hug: :heartbeat: and i know what you mean....doesn't it just make you wonder wth is wrong with people????? unbelievable.....
