The jury has already heard three attempted murder charges related to her estranged husband Simon Patterson were withdrawn last week.

In opening the trial, Crown prosecutor Dr Nanette Rogers will spend much of Wednesday morning taking the jury through all of the reasons why they believe they ought find her guilty on all of the charges.

Patterson's barrister Colin Mandy SC will then be provided a brief opportunity to explain his client's case.

More than 100 witnesses will give evidence at the trial, including Simon Patterson and Mr Wilkinson.

Anyone know the starting time? It’s currently 9am.

I read that it would start at 10:30am every day, in one of the posted articles.

Today's Supreme Court listing appears to confirm that.

To me it sounds like Erin Patterson expected Simon to be there.
What the evidence says is that he was invited. The evidence hasn't said that he was invited but cancelled

Perhaps he told his parents at the last minute that he wasn't going, and didn't tell EP. Just let his parents tell her when they got there.

Or even called/texted his parents, once they were there and said he wouldn't make it, please tell EP.

I think his friend said it was a last minute cancellation. IIRC

It's looking rather ominous

Your link says that EP is sitting in the dock at the back of the courtroom. I envisioned her sitting up front somewhere. It sounds as if she does not sit alongside her lawyers.

I took a look at some Vic courtrooms.


This one is the Morwell Courtroom .... (looks like the pic may have been taken from the dock)

I don't think any defendants sit with their legal rep at the bar table in Australia? ( unlike the US ) - cases I've been too they have been in the dock, but I've not seen a dock at the back of a court room.

I wouldn't want to be hard of hearing and sitting at the back.

Not saying that EP has any hearing problems, and I'm sure the court has that covered, ie is the sound able to be amplfied for the dock area.
Are headphones available.
I'm sure we'll see a court sketch of her.

Look at all the microphones.

I'm hard of hearing, and I was at a tribunal hearing recently--a modern room something like that. There were microphones and the audio was excellent.

Good morning from inside courtroom 4 at the Latrobe Valley Law Courts.

The jury has just been brought in for the day’s proceedings. Justice Christopher Beale has a few more legal instructions to give the jury, before Nanette Rogers SC begins the prosecution opening.

Erin Patterson is in the dock, sitting about two metres behind me. Today she’s wearing a blue and white striped t-shirt.

‘Conscious, voluntary and deliberate’: What the prosecution team must prove​

The hearing is now under way.

Supreme Court Justice Christopher Beale has started by reminding the jury of the four elements of murder and attempted murder using a jury checklist.

Beale is explaining that the checklists will be uploaded to the iPads that jurors will be provided access to.

The jury will be briefed on how to use the devices later in the hearing.

The prosecution must prove the following four elements beyond reasonable doubt. One, the accused caused the death of the deceased by serving the deceased a poison meal. Two, the accused alleged conduct was conscious, voluntary and deliberate. Three, at the time of the alleged conduct, the accused intended to kill or cause really serious injury to the deceased. And four the accused killed the deceased without lawful justification or excuse.
Beale is reminding the jury that the prosecution must prove each of the elements beyond reasonable doubt to find Erin Patterson guilty of murder.

The jury's checklist for a murder conviction​

Justice Beale is running the jury through a slideshow which details the technical elements of the charge of murder.

At the end of the trial, all of these points will need to be satisfied beyond reasonable doubt for the jury to convict Ms Patterson of the offence.

  1. 1.The accused caused the deaths by serving a poisoned meal
  2. 2.The accused alleged conduct was conscious, voluntary and deliberate
  3. 3.At the time of the alleged conduct, the accused intended to kill or cause really serious injury
  4. 4.The accused killed the deceased without lawful justification or excuse
Each of these points will need to be considered for each of the murder charges, relating to Don and Gail Patterson and Heather Wilkinson.

More now about what the judge is doing now - he's going through what called a jury checklist.

Justice Beale is explaining to the jury that the law requires conduct that attracts criminal responsibility to be "willed conduct" - words like conscious and voluntary rule out circumstances where someone is sleep-walking and are not aware of what they are doing.

He’s also talking about intention - has the prosecution proved that at the time of the alleged conduct, the accused intended to kill or cause really serious injury to the deceased?

There’s a series of questions where they have to answer yes or no, at which point they can move on to the next one - trying to work out if the accused is guilty or not guilty.

In a similar vein, there are four elements for the charge of attempted murder.

This is the charge that relates to Ian Wilkinson, who fell seriously ill after attending the lunch, but did not die.

One key difference from murder though is that the intention must be an intention to kill.

For murder, it can be an intention to kill or an intention to cause really serious injury.

‘An intention to kill’: The checklist for attempted murder​

Supreme Court Justice Christopher Beale has now moved to the second checklist for attempted murder.

He is explaining to the jury that the prosecution must prove beyond reasonable doubt that Patterson consciously, voluntarily and deliberately served Ian Wilkinson a poisoned meal. They also have to prove that Patterson’s conduct was more than merely preparatory to killing Wilkinson, and that the conduct was immediately and not remotely connected with killing Wilkinson.

The prosecution will also have to prove beyond reasonable doubt that Patterson intended to kill Wilkinson and that she had no lawful justification or excuse for her actions.
