Deceased/Not Found Australia - Lynette Dawson, 34, Sydney, Jan 1982 *husband guilty* #5

I wonder what the timeframe is with Chris Dawson's carnal knowledge case? I assume it will still go ahead, regardless of the fact he will be spending the remainder of his life in jail anyway. I guess the priority of it being heard anytime soon is now reduced? Perhaps his appeal, assuming he carries through with one, needs to be sorted first?
There would be a couple of factors that would contribute to this. Firstly if JC wants to continue because she would be the key witness. She hasn't been shy in telling her story in the Inquests and in the murder trial. From the murder trial she seems to understand what was happening to her at the time better than she did then.

With a sentence of up to 8 years it could cover him over 100 if not served concurrently.

From the article above the date had been set as follows.
Acting Judge Graeme Henson agreed, and relisted the trial for May 18, 2023.

Another factor that could come into play is Chris Dawson's mental ability to stand trial.

I believe this is dated July 2022...

The trial for carnal knowledge was due to proceed before the court next month, however Mr Dawson’s lawyers successfully argued that it needed to be delayed because the publicity around the murder trial needs time to die down, and because Justice Ian Harrison has yet to deliver a verdict on the charge of murder.
[...]
The trial which is now set down for May next year, will focus on when Chris Dawson first had sex with the student, how old she was, and whether or not he was her teacher at the time.

Below is the charge conditions. School year in Australia ends mid December so I assume 12 December is the last day of school at Cromer for that year. Maroubra was where Chris's parents lived.

"However, the indictment in the carnal knowledge trial is in the following terms:

“On a day between 1 July 1980 and 12 December 1980, at Maroubra in the State of New South Wales, [Christopher Michael Dawson] did unlawfully and carnally know [JC] a girl above the age of 10 years and under the age of 17 years, namely 16 years and who was at that time a pupil of the said Christopher Michael Dawson.”

Witness 28 if anything happens to you now I’m sure they(Paul C or Paul D both) would be prime suspects, with the police having been made aware of the details - surely you are safer now.

EssieMarie83: yes I feel safe in Melbourne
I don't think Paul has contacts with the police anymore these days which is a good thing ,but like the whole family all their lies to protect Chris, he might go to any length even if it's too late.

Sunday January 8th 2023 is my birthday, tomorrow I'm going to have a quiet drink to remember,Lynette Sims, since 2014 everyday on my birthday around 9pm I've had a drink to remember the last time I saw lynnette, not a day go's by when I don't think about Lynette and how she was robbed of her life. R.I.P. Lynette Simms, 8/1/1982.
Michael .

Happy Birthday to you Witness 28.
Today I will quietly remember Lynette Sims, but I also toast a soft drink to her as this year she now has Justice and her name cleared (leaving her Children and home). Peace and Light.

No word on Chris Dawson's appeal?

  • #339
The last I heard was that an appeal had been filed.

Published: 02:04 AEDT, 5 October 2022 | Updated: 02:44 AEDT, 5 October 2022

While an appeal has already been lodged, Dawson's solicitor Greg Walsh could not reveal any details outside court on Friday, telling reporters this would be his last day representing the convicted murderer.

Dawson will now rely on public defender Belinda Rigg SC to handle his appeal.
The challenge will likely be heard some time in 2023, although a date for a hearing in the NSW Criminal Court of Appeal has yet to be set down.
