I don't think the jury is likely to be discussing honking, yelling "fire," or bullying to suicide. Frankly, at this point, I would wager that they're wondering how much longer they have to sit in the jury room before the judge will accept their inability to agree on a verdict and send them home.

Someone didn't understand what I was talking about when I discussed legally drawing that line between what is, and what is not your obligation when it comes to others' actions.

It's an analogy. It's food for thought. It's an attempt at reaching common understanding.

I only need point to this thread, this message, as a demonstration of how intent is completely mis-read, and misinterpreted by those very same people that are certain they can read GT's intent that night.

As has been explained before, an attempt, is as good as if the offence was committed fully. Attempted greivous bodily harm, and the Crown, agreed that she committed this offence.

But why would anyone bleat over and again that she "hit" him, when even HE says she did not.

Who said anything about peaceful restraint? If he wanted her out, he can grab her by the wrist with her hand behind her back, take her to the door and push her out.

I've done the exact same thing when a 6'2 drunk footballer started getting disrespectful with my property in my apartment. Except GT has far more strength/height/weight on WW and so could have gotten her out even more effectively.

And what are your dimensions and gender? You could be 7' and 230 pounds.

I remember hearing my children say similar words when they were bickering but I think their ages were in single digits and they were experiencing the normal narcissistic stage of childhood.

That argument swings both ways if you think it through. Who's to blame for what she did?

If WW hadn't chosen to climb over the balcony, IMO she would still be hear today. IMO Tostee would not have killed her. Even if he had got violent with her, she still would have been alive to press charges for assault. IMO the only reason WW died that night is because she chose to climb over the balcony.

I cant see him pulling over for the cops. Cops labelled him a serial pest and he had previous for assaulting police officer.

1. That is untrue. I know a link cannot be supplied for this fabrication (bolded above).

2. Also, the assault charge was dropped , the police offered no evidence. In other words, the charge were trumped up.

So there are two pure fabrications.

Wouldn't it even make more sense for him to lock himself somewhere? Why not do that if he was afraid of Warriena?

Did he not lock safely himself in his own apartment? What am I missing?

I wonder if Warriena saw GT pick up his phone when calling his lawyer and she thought he was calling the police, that's why she attempted climbing down from the balcony. :thinking: I still believe neither Warriena nor GT wanted the police involved at anytime during the night. Both had a chance to involve the police. We know why GT avoided getting the police involved, but Warriena, she could have walked out of the apartment earlier, left her phone etc, and gone to another apartment and asked for help, she chose not to.

Warriena was at about three times over the limit of alcohol. I don't think anyone can assume what was going through her possibly panicked mind at the time. We don't know what alcohol level GT was, because he wasn't tested at the time. So there's that.

When men discuss similar incidents they have had with women, they tend to qualify the genders, so the story has a little more impact.

That's not how it would happen, and what you are actually demonstrating is exactly how men are held to some impossible standard of being able to control every situation physically with a woman, otherwise they are labelled and mocked as a wuss.

What on Earth would make him dare open that door again without someone else present, like law enforcement? He had to have known police were going to be on the way shortly the second he made the decision to go to the balcony. The neighbors, and likely several of them, were going to call police the instant they were started awake by a woman screaming. Virtually everyone here would be on the phone just as fast.

You want to talk common sense.

Perhaps it wasn't FINAL enough for Gable just to put her on the balcony. Angry people can do very very illogical things.

I completely agree, that makes no sense whatsoever. Which is why I think Rrie knew he was had something else in mind.

I know some dismiss it as feminist nonsense, but I think this is a great illustration of the way male victimhood is often belittled and minimized. It only serves to further entrench gender stereotypes of women as victims and men as "alphas" or "betas" (to quote another forum).

The apartment is in the heart of Surfer's Paradise. I wouldn't assume peeps would call the police unless they saw something suss. Schoolies week is an example, screaming, yelling, planking galore.

This may be true, but I think the judge stated that her fleeing could be seen as reasonable if she was trying to escape GBH. Who is to say what she felt would be a fate worse than death?

And then you listen to the recording and hear him acting like a public nuisance and kicking police cars.

Wonder if this is where he got the idea. He walked away that time, why not this.

No wonder those detectives are just all sitting there, waiting for the verdict.
