It reminds me of when my brother would beat me up while yelling "stop hitting me" loud enough for mum to hear.

Exactly... Warriena doesn't seem the meek type, but look at her language - "sorry", "no no just let me go" -- clearly she is terrified out of her mind. She isn't arguing back, she's trying to placate him, IMO.

My house is getting a good clean up this morning. I haven't felt this angry in ages!!!!!

Now I am wondering how many times he's pulled that stunt, so girls would be intimidated out of complaining...

He seems exactly the sort to do it, too.

I am not going to pass judgement on poor Rrie regardless as I think Tostee is a hideous predator and she genuinely feared for her life. I do agree though that it will be interesting to see if Rrie was drunk or drugged or both. Even being drunk can make you behave in ways you normally wouldn't. For some reason I thought I read somewhere that they were drinking jager?

This is just so hideous. It would be good to hear all the comments in context as I thought "it" might have meant her stuff or handbag when he was telling her to go. Tostee is so warped he would be doing that weirdo, manipulative double talk rubbish we heard in that link from the bb forums. I bet she wasn't being rough on purpose unless he was hurting her...and if she was mega intoxicated you aren't really at your best so who knows? She might have accidentally hurt him...but even so no person deserves that horrific treatment.

The part about her legs dangling makes me wonder. Does that mean her legs were facing knees out or knees in? Knees out and she must be facing forward going over and knees in means facing into the balcony and climbing over. It seems he locked her out based on the door sound and 26 seconds later there are fading screams. I am just thinking out loud. He deserves to go down for murder regardless of the fact that it doesn't seem he pushed her over. He didn't get help, called a lawyer, left the scene and ordered a 🤬🤬🤬🤬🤬🤬🤬 pizza. He must pay for this...

I have unfortunately met someone very similar in an encounter once. Mega insane and manipulative. So so so glad to have been able to leave...such similar language and behaviour. It makes me shudder...

There is no judgement to be passed on Warriena in any way whatsoever ... no way .. no how .. hasn't even crossed my mind in the slightest.

He plied her with drinks, they had sex, she did what she thought he wanted .. what he suggested, he didn't like it, he refused to let her take her belongings, he threatened her, he tried to choke her, he stopped her from going home, he held her against her will, he locked her on the balcony, he did not call for help, he evaded police.

I'm really wondering if police will pick up the sound of the balcony doors being opened a second time. I have a hard time believing he wasn't out on that balcony with her, with the phone left inside, still recording. It's *possible* Warriena was so scared (and she did seem very scared) that she tried to climb, but something tells me not. I feel like Tostee is manipulating the whole recording, anyway, to make himself sound blameless. Whether for lulz or rape-insurance, or maybe even to make sure he came across as 'innocent' after he killed somebody, who knows.. I mean, what type of person kills a woman, then nips out for pizza? fffffffnsicko.

He may well have been out there with her, Ausgirl. But either way, she did not want to be there. He would not let her take her belongings (did she even have her clothes on?). He was holding her against her will imo.

GT maintaining his right to silence, yet has plenty to say on the recordings. Thank goodness that night was recorded.

I wonder if he dumped her stuff on the way to Dominoes.

I also wonder if he closed the door from the outside and he did struggle with her on the balcony...I do believe he carried her out there which is when she screams "No no no"

How can it be more than manslaughter, if he did not physically throw her over balconey?

Just bumping my post from pg 7, to answer your question nao.

Just as info for astorytold, and a reminder for any other interested people, here is the murder case that is apparently being looked at as a precedent for Tostee's murder charge.

Police evidently have proof that Warriena was in great, substantiated fear of Tostee.

Kelly Healey was in the shower when her boyfriend broke down the bathroom door, grabbed her throat and punched her in the face.

Terrified and in fear of her life, Ms Healey is thought to have climbed out the window and fallen 21m to her death.

Her boyfriend, 33-year-old tattooist Kim William Royall, was found guilty of her murder – not because he necessarily threw her, but because she fell trying to escape him.

I reckon he forced her over, or left her dangling (legs were seen 'dangling', says msm, not climbing... ) to 'show her a lesson'. imo at 14 storeys that = legal definition of murder as he was illegally detaining her at that point.

The low on August 8 was 9 degrees, it would have been very cold on that balcony, with or without clothes!

  • #257
the way i read it, he forced her out on balcony, and shut her out there by herself, unpleasant situation, but she just met the guy, why would she have such fear?

And if it was damp out (condensation can be heavy in the cold weather) and he'd left her dangling (as I think he did) - well, it wouldn't take much for her to slip loose.

Perhaps because he made a direct threat to take her life by throwing her off!!!!!!!!!!

Nao, as I read it: something went wrong in the bedroom, my feeling is Tostee got rapey (as he had with other, documented dates) and Warriena was made very deliberately to look 'guilty' and to blame on tape while Tostee choked her (she can be heard choking, gasping for breath), and he was talking like an effing psycho at her. If that was me, I'd be scared, too. She was also pleading 'no, stop' and the screaming before she fell. Plenty of evidence.

There's no doubt Tostee was being a creep here, and no doubt in my mind he a/ illegally detained her and b/ forced her onto the railing.
