This will be interesting. I'm sure his lawyers will milk it for all it's worth and go for self defence....ie...a reason for locking her out on the balcony... because she had something dangerous. Was this that metallic sound that was mentioned?? Perhaps a knife??

Ms Ryan referred to part of recording that appeared to demonstrate Ms Wright was wielding something dangerous during the encounter which led to her death.

“He said let it go let it go,” Ms Ryan said.

“At that point a heavy object dropping with a thud is heard.”

Gold Coast man Gable Tostee is due to learn if he'll be released from prison on bail over the alleged murder of a New Zealand tourist.

But Tostee has vowed to clear his name and if released his lawyer says he will abstain from alcohol, stay off Tinder and live with his parents.

They have pledged to pay a $200,000 surety.

Justice Mullins is expected to deliver her decision at 9.15am.

I hope they also explain how 'something metallic' can sound metallic on a soft surface like carpet. The clatter of metal on a hard surface is pretty distinctive. And the only hard surface near the balcony door (we hear the door a few moments later) is -- the balcony. He was out there with her, I am totally convinced of it.

(sorry for the potty mouth, Marly, I just get so cross at the idea this guy will get to walk around free on bail...and I come from a long line of sailors and scotsmen... I promise to be good tho :angel2: )

Sorry, I'm so ansty this morning about this decision, ha.. lotta posts! I am wondering though, how many people truly believe Tostee (a supposed alcoholic with behavioural issues) would stick to bail conditions O'Gorman is pushing - abstinence from booze, abstinence from Tinder, being in every night by 6pm -- and how many believe his incredibly indulgent parents would *make him* stick to it all?

I think there's a very long history of Tostee not being forced in rehab, therapy and just consequences of bad behaviour, on their behalf. I personally cannot see any of those conditions being upheld in that home.

Police trying to prosecute Gold Coast man Gable Tostee for murder will use the same legal argument that saw two men convicted for the fatal 1973 Whiskey Au Go Go nightclub firebombing in Fortitude Valley.

... police believe they can prove a murder case because Ms Wright, 26, was allegedly in fear for her life while trying to escape the balcony early on August 8.

In the Brisbane Supreme Court on Tuesday, prosecutor Ben Power drew links between the Tostee case and that of John Andrew Stuart and James Richard Finch - two men convicted of murder over the March 1973 Whiskey Au Go Go fire.

On that occasion, Stuart was found guilty of murder because his decision to instruct Finch to light a fire was an act with an unlawful purpose that was likely to endanger human life.

Police will draw parallels between Mr Tostee's decision to allegedly lock Ms Wright out on the balcony and Stuart's choice to plan the fire."

I don't like this judge. Pushing for the autism thing to be included, despite NO visible proof he's autistic. Now, granting bail for a guy about to go to trial for spectacularly evading police. Not to mention the horror show of Tostee's dad and him, evading police. No sir, I don't like it.

I hope those strict conditions include him having to spend his bail time in NZ under the watchful eye of the NZ police and public!!!!!!!!!!!!!!!!!!!

Me either, Ausgirl. The only hope now is that he is jailed for his spectacular car chase incident, and that will keep him inside until his murder trial. :pullhair:
