According to his open letter he didn't know for sure whether she had fallen all the way or climbed to another balcony. By the time he went downstairs, he discovered emergency had already been called.
In his situation you would have to be crazy to surrender yourself to police without legal representation after someone you had just met had died after you had an argument with them. He would have been taken into custody, held for hours until his lawyer woke up and likely pressured into talking. He was also probably quite intoxicated and not in the best frame of mind.

Who thinks like that when someone has accidentally died? Who has that clarity of thought? I thought you said Tostee would be in shock therefore no reaction after her death. Pretty cold and clear, the thought to ring a lawyer (on recording and backed up by phone records) and call Daddy, eat pizza and remove himself from the scene. He only surrendered the next day...well after Rrie had gone over the balcony.
Dozens of investigators are not wrong. They have arrested the right man. Only a matter of time now for Tostee.
Sorry, but I find that kind a rationale absurd. It is evident that some people think it was fine for Tostee to protect himself from any inquiry until he was good and ready, the majority of Australians are disgusted.

It won't change the outcome, Tostee will get his just desserts and his apologists may learn a thing or two.
You can clearly hear an altercation, whatever you want to call it, my point remains the same.
As far as the sounds in the audio go, only Tostee knows for sure what happened. We can only speculate as to whether Warriena was actually choked or not. So far police and prosecutors have not provided any evidence other than speculation. Arguably you can hear worse sounds at a gym. It is interesting to note that Warriena can never at any time be heard saying "ow", asking to stop being hit, flinching, or giving any indication that she has sustained any injury. Tostee on the other hand did numerously, and there is physical evidence of it.
Not because they thought he dropped a person over a balcony. They concluded she climbed over herself while Tostee "probably wasn't on the balcony". Why do some here seem to believe she was dropped off?
Shock does not mean doing nothing and becoming paralysed.
Anyone who has been in trouble with police or dealt with lawyers would be well aware that they would not help anyone in that situation. How he reacted given his previous experiences does not make him guilty.
I would have thought someone would care less about jeopardising their defence and be more concerned with reaching out to the family. If Tostee was so concerned about his defence, why write a statement on a public bodybuilding forum that could be used as further evidence against him? Not having deep feelings for someone does not negate his behaviour that night.
Anyone with a semblance of decency would have called an ambulance if she had fallen off, showed some emotion, most likely screamed themselves as she fell and gone straight outside to wait for help to arrive. How did he know she would definitely not have survived?
Who calls their lawyer 38 seconds after someone falls and shows no sign of emotion on a recording they made themselves for the entire couple of hours post fall?
Who a mere minute after someone falls off their balcony goes and (quite clearly on recording) starts moving stuff around (sort of sounds like hiding evidence), opens a bottle and shakes out what sounds like pills and proceeds to take off?
Who hides behind a pillar and watches the terrible scene? A sociopath does because they like to continue to revel in their crimes and don't want to get caught.
Tostee posted himself that he turned around and saw her (somehow hover magically) before she went over. Pretty incredible timing right there...but that aside...surely if you saw someone fall, regardless of whether you liked her all that much, if you had nothing to do with it...you would react. There was NO REACTION other than heavy breathing (as if he had exerted himself excessively during the screams and also as the screaming dramatically dropped off - as if he had held a weight for some time - such as a body over a balcony ledge) and a call to a lawyer. It makes no sense, just no sense at all.

As with majority of murder cases, the full brief of evidence isn't handed to lawyers until a date is set by a judge.
The committal hearing will be very interesting when further evidence is usually released to general public.
I don't agree Jimmy Russel that there would be no physical or audible reaction from a person witnessing, suspecting or knowing that a person had fallen 14 floors onto a hard surface below - when it was their balcony they had fallen off.
