AUSGIRL, Tostee pointing a gun at her might explain why she so hastily climbed over the balcony instead of calling out to neighbours for help.

Even if it is a tyre iron (not that it looks like that) or similar, it would have been very threatening to Warriena, if she saw it in his hand. And make her want to flee, instead of raising hell until he let her in so she could go home.

Doesn't look like it is something that could be proven though, by the prosecutor.

I agree with that.. hopefully they've shown enough to prove she feared for her life. I don't know how anyone could think otherwise, after hearing her pitiful screams.

From one of the pics, closer up it looks like it could be his keys on a long chain. The pic's aren't very clear and there are lots of shadows.

It may not show up very well in these pics, and I could be wrong as it looks a bit different in each pic.

From one of the pics, closer up it looks like it could be his keys on a long chain.

That's why I was asking about a chain earlier, I thought I saw it swinging as he walked but that could be an afterimage or something.

I'm glad to have a reason to discuss this whole thing about WHY Warriena never demanded to be let back in, why she didn't yell "help" but just started begging to be allowed to go home, screamed 'no' 33 times - and then wound up over the rails. Whatever caused her to fear for her life, it's clear she did so. And that Tostee is the reason.

Thanks Amee, this still isn't sitting right with me though. Could the witness, Nick Casey, actually tell from his vantage point whether Warriena was "lowering herself over the balustrade" or being lowered over the balustrade by Tostee? If Tostee was standing on the balcony 2 floors directly above, lowering her over the balcony, he would have been out of this witness's field of vision. Also, the witness says he saw her lowering herself over the balustrade and then he heard her say "I want to go home". From reading the transcript of the audio recording, it seems Warriena started saying "just let me go home" BEFORE Tostee went inside and closed the sliding door. So, Tostee could well have been on the balcony lowering her over the balustrade when the witness saw her going over. I also find the word "lowering" unusual. How does one lower themselves over a balcony?

...you can hear the following:

*he is already holding her down and threatening her life, when he complains she hit him with something.

*the door can be heard opening at 6:43 mark, immediately *before* she starts screaming "No".

*the door can be heard closing at 7.40 mark.

He was obviously out there on the balcony with her for a full minute, while she screamed "NO" and struggled with him. He didn't just shove her out there and slam the door-- he was out there WITH her.

Thank you Ausgirl. This is a huge in my mind - surely the police know this. If he was on the balcony with her for a full minute, why are the police not alleging he lowered her over the balcony, or somehow forced her over? This very strange.

So this is day four of possibly eight (?)
If there is only one more witness, is anyone able to speculate about what the rest of the trial will entail?

Thank you Ausgirl. This is a huge in my mind - surely the police know this. If he was on the balcony with her for a full minute, why are the police not alleging he lowered her over the balcony, or somehow forced her over? This very strange.

I think it'd be a problem of proving it, as there's no video, only audio.

He had a whole minute, while there's a struggle and she's screaming "NO" in the most terrified manner, to dangle her over, if that's what's happened.

Could explain why witness saw her facing outward - and noting how odd that was - and another saw her right before she fell, with feet facing inward (as she tried to get away by climbing down).

That would also explain why she wasn't yelling to get back in - the majority of the time she was out there, HE was out there, manhandling her. I do think this significant to the trial, maybe the jurors will pick up on it.

I have been surprised at how swift the prosecution witnesses have been smoothly oiled thru the testifying process, and the reason for that smoothness is there doesn't appear to be any damn questioning by Gabe's defence barrister..

Which gives me pause for thought.. Thought about the defence strategy. . I am curious to see if the pathologist gets a thorough going over by the Defence, today, seeing he/she is the last witness for the Crown... if not, then.. the strategy for Gabe is a bit of a mystery, in the legal sense, ,..

I suppose Gabe will present expert's of his own, but they cost mega bucks, and I don't expect them to be a gang, possibly one, or two.. .. I certainly expect the Crown to question them deeply ...
