I don't think anything will get the sound of Warriena's terrified screaming out of their heads, first and foremost.

What a win....because those jurors couldn't possibly hold more than a few hours worth of info in their minds. Recency theory probably isn't going to save Tostee. The strategic actions of the defence are to be applauded - well done to them! And their minds won't be clouded by...oh 22 witness testimonies beyond just a recording played in court.:clap:

I am not impressed with the prosecution either.
Manslaughter seems a better outcome, due to their poor performance. And maybe that is what they are angling for. They were judicially informed a long time ago that they had a weak murder case.

As you'd be aware, I'm of the opinion that a case for manslaughter cannot be made either but I would have been infinitely more comfortable with a manslaughter indictment as opposed to a murder indictment. The fact that the Crown has persisted with the choking theory which totally flies in the face of the evidence presented by their own witness is mind bogglingly stupid IMO. Upon closing of the prosecution case the proper course of action would have been to inform Justice Byrne that they did not wish to proceed on the murder indictment but would persist with the manslaughter allegation but the Crown has allowed itself to become a joke during closing and any credibility they may have had with the jurors has long since vanished. Upon completion of these proceedings there needs to be a thorough investigation into how we wound up with this mess.

Well, it is for the Crown to exclude that hypothesis which is clearly open - He more likely expected that she would lower her rage, and start conducting herself more appropriately after tossing rocks at him and belting him with that telescope. That is far more sensible than to conclude that Tostee put her there anticipating she would climb over the balcony. I have no idea what his IQ is. What does that matter? He was not so stupid as to climb over the balcony. She did that, according to the Crown.

Yes just the evidence. Wasn't it mentioned earlier in the trial that the critical 6 minutes of Gabe's recording, before Rrie plunged to her death, should be concentrated on.

No, I was referring to the 'dumb' comment. Whilst I think that word is offensive even if describing someone with lower than average IQ, I assumed you had access to information that made you come to that conclusion and use that derogatory term to describe her.
Why Tostee's IQ? Well, he has proclaimed it is 150, so my bad, I was been naughty in asking for proof...since you might have access to Warriena's I cheekily thought you might have access to his?:oddsmiley:

This - I don't think the chilling sound of a young lady in a state abject terror will be far from the juror's minds - when I first heard the tape i almost felt sorry for GT but that changed as the audio took on a sinister twist with the cat and mouse stuff, whispering into the phone, stealing the lady's phone and refusing to return it, tackling her, strong-arming, threatening to throw off balcony etc - he turned nasty when she challenged his manhood and said he sounded like a "******" - i think she may have hit a raw nerve there - irrespective of the outcome here GT is a very dangerous individual, despite what the apologists on this forum would suggest.

Odd, he had his recording that demonstrated he had done nothing wrong. But he chose to phone his solicitor at speed and failed to call 000.
imo

Not to forget that he didn't freely give it up to the Police - they found it.
