I am sorry and not trying to insinuate anything but that train of thought gives too little to Warriena. His comment about the balcony just seems like something a lot of people may say BUT not actually ever believing that would happen.
I don't understand what you mean by "gives too little to Warriena".

Yes I predict a hung jury.

Possible, but hung juries are actually remarkably rare these days. In any case the Crown had better cross all of their appendages that they get a conviction this time around because historically retrials strongly favour the accused, and often they aren't even retried at all.

The ordinary person with reasonable foresight is someone who is sober. The jury needs to consider what such a person would have done in the situation in which the accused found himself. The prosecution contends such a person would have foreseen Wright's actions. The defence contends the jury should not be persuaded beyond reasonable doubt that Tostee could have foreseen death as a possible consequence of what he did.

The defence says he was "de-escalating" the situation, and used reasonable force to do so. The jury must be satisfied beyond reasonable doubt that Tostee was not using self-defence to find him guilty.

The prosecution alleges that Tostee used more force than was reasonable or necessary when he locked Wright outside.

But when a person is intoxicated, their conscious mind is not working logically so the thoughts are embedded into their subconscious mind which is more literal and really has more influence over our behaviour that most people are aware.

The judge continues to outline the concept of "self-defence" from Tostee's perspective: the judge explains that when someone is being assaulted with such violence they reasonably believe their life is in danger the victim of the assault is not criminally responsible for using such force or actions they risk their attacker’s death.
