I don't understand what you mean by "gives too little to Warriena".

I did not want to imply victim blaming because I knew that was not the OP's intentions BUT to suggest that Warriena could hear that a few times and then decide to act on it just seems insulting that she would stoop to that level.

But when a person is intoxicated, their conscious mind is not working logically so the thoughts are embedded into their subconscious mind which is more literal and really has more influence over our behaviour that most people are aware.

That's true, but intoxication (where either victim or accused consumed the intoxicating substance of their own free will) cannot be taken into account during any objective legal tests. For the purposes of this case, the jury faces the difficult task of deciding whether both Gable's and Warriena's actions were reasonable/forseeable/proportionate if they were both sober.

The common ground between both sides was that Wright did assault Tostee more than once, throwing rocks and either attempting to strike him, or striking him with a telescope. That leaves a “provocation” defence open to the accused - however the prosecution’s case was that the force used by Tostee in response was not reasonable or necessary.

The defence says he was "de-escalating" the situation, and used reasonable force to do so. The jury must be satisfied beyond reasonable doubt that Tostee was not using self-defence to find him guilty.

The kid's going to walk.

Anyone else notice the bias in Journo @GregStolz tweets!

How can there be any bias? He is just retweeting the Judge's instructions?

Is that why he posed with a Llama?

Yes, I believe that was his response to the media highlighting her as an animal lover. As another poster noted at the time, there's also a creepy similarity to that photo and this one of James Holmes (the Aurora, Colorado shooter):

please explain? Trying to create confusion about defending Warriena is stooping low. Projection at its finest. JMO

Being intoxicated does not relieve a person of responsibility for their actions, the judge tells the jury.

The fact that Tostee was under the influence of alcohol should be considered relevant to the question of intent, the judge instructs the jury.

It's noticeable to me when following #tostee on twitter. It's all in the comparison to Greg Stolz tweets compared to say Sharnie Kim IRT.

Your observation could be right but he might also be a slack transcriber of the events. Luckily, the jury hear it all and hopefully can come to their decision, whatever that may be.

And the jury will know that Gabe couldn't possibly be in fear of his life from a few pebble strikes.
