What about if the man on the balcony was pissed off about being locked out there, and thought that he would be clever and threaten to jump if he wasn't let back in?
Except the recording doesn't allude to anyone threatening to jump so.... Moot point there.

Potentially, but it's difficult to say if the ODPP will proceed with one. If the case wasn't so high profile I'd suggest a retrial would be extremely unlikely but the weight of public opinion might be enough to persuade them to retry. I doubt you would see murder on the indictment next time around though.

It looks like part of a dumbbell. Perhaps that is what Tostee was unscrewing before leaving his apartment. He wanted the metal rod to use for protection as he left the building. Maybe he was concerned that someone was really going to assault him!

OK you guys probably would of seen this picture already, but, does anyone know what that black disk shaped item is on the TV unit? That's not the end off a weight is it? Sorry just my first time seeing this picture or from this angle. Another thing, that sun bed does look very close to the rail.

It's lunch-time on Day 8 of Gable Tostee trial and still no verdict. Nothing likely now until after lunch-break at 2.15 at earliest #tostee

Sometimes i wish there were professional juries in high profile cases. As a matter of fact i think there needs to be, IMO.

My thoughts & Prayers are going out to Warriena's family & friends, and sitting on my patio today having my cup of coffee i saw two beautiful hawks soaring above a big tree as i was thinking about all of this.

Did you hear such a threat voiced by Warriena on the recording in between the thirty-three times she screamed 'No!', the number of times she asked to go home, her feeble 'help...' or her screams whilst hitting several balconies as she fell 14 storeys to the concrete below? I certainly didn't.

Maybe or it held something in it, so he definitely needed to get that out of the unit!

That's interesting.

Everyone here uses the fact he was bigger and stronger against him continuously.

Notice how he didn't beat her up? He didn't knock her out. Notice how he didn't grab something and beat her to death? Notice how he didn't grab a knife or something sharp and stab her to death? Nor did he strangle her to death. He didn't even throw her off the balcony when he had the chance.

What did he do? In the middle of the chaos, he grabbed her, escorted her outside, and closed the door behind him. When dealing with someone out of control, like with someone suffering from a mental illness, it is called "de-escalation".

When he closed that door, did he think for a second that she would go over the balcony? No? So where was the intent to kill her? Did he shove her somewhere that no one could find her or she would not be able to summon help? No? So where is the intent to forcibly confine her?

She was drunk and upset. It's not beyond the realm of possibility that she started over the edge intending to throw a scare into him, and lose footing or balance.
